RE: I Use Permit (UP -96-001) for a cellular communication tower on APN 055-180-083.
Dear Craig,
The Butte County Airport Land Use Commission discussed the above mentioned use permit request for AT&T Wireless
Services at its April 17, 1996 meeting and submits the following comments.
The proposed project is located approximately 1.5 miles north of the Paradise Skypark runway. The site is within the
Federal Aviation Administration Federal Aviation Regulations Part 77 (Objects Affecting Navigable Airspace) Surface
regulating height restrictions around airports. California Aeronautics Law Section 21659(a) states that "No person shall
construct or alter any structure or permit any natural growth to grow at a height which exceeds the obstruction
standards set forth in the regulations of the Federal Aviation Administration rblating toobjects affecting navigable
airspace contained in Title 14 of the Code of Federal Regulations, Part 77, Subpart C, unless a permit allowing the
construction, alteration, or growth is issued by the department."f The above described project applicant shall submit
Form 7460-1 to the FAA for review and approval of the cellular tower. If this review determines the cellular tower to
be an obstruction, the project should be relocated to another location.
The proposed cellular tower is also located on the north boundary of the Paradise Airport Overflight (Traffic Pattern)
Zone and directly north of the runway Approach Zone. The Commission determined that the project is not in conflict
with the Paradise Airport Land Use Plan. As with all development in the proximity of an airport, the landowner shall
sign an avigation easement acknowledging the operation of the airport. A standard avigation easement can be
obtained from the Butte- County Planning Division. The Commission also recognized a potential hazard to CDF fire
tankers that may operate in this area in the event of fire and to other low flying aircraft.
The Commission recommends that the following conditions be added to any approval action.
The portion of the tower that rises above the tree line shall be painted with a high visibility red and white
striping pattern and the tower shall be topped with a blinking light so that unsuspecting approaching aircraft
and California Department of Forestry air tankers can easily identify the potential hazard.
2. The project shall submit Form 7460-1 to the Federal A via.tion Administration for review and approval of the
cellular tower.

Mr. Lucas said that the proposal is outside the flight Oath of the Paradise airbort;
Commissioner Frankli'n"said that all traffic patterns veer off to tKe.l;ft of the proposal que to a mo.untain,and
trees. A cellular tower would not be visible from the airport. Lighting on th6 tower wouI6,not 'create a
problem, and in fact might be an asset.,,
Mr. Lucas said that a flashing light foe the tower might be required by the FAA. He would recommend that
Form 7460 be submitted for obstruction to the horizontal surface.

Alternate Hennigan said that since aerial fire fighting takes place in the area, it might be good to paint the
tower to make it more visible -- high visibility red and white paint with a flashing light would work, and sign an
avigation easement.
It was moved by Commissioner Hennigan, seconded by Commissioner Franklin, and carried unanimously,
to find that the proposed cellular tower is not located within the-66undaries of, or incompatible with, the
currently adopted Paradise Town Airport Environs Plan and to require that the tower be painted high
visibility red and white, with a flashing light, and to submit Form 7MO to the FAA.
Mr. Lucas referred to the progress report which was prepared at Bill Farrel's request. The budget is
essentially that which was previously prepared. He said money has already been earmarked for noise
studies for the Ranchaero and Paradise airports, although that money is not included in this budget.
Caltrans is supposed to be providing grant money which will cover the costs of noise studies and updates.
Commissioner Lambert wanted to know exactly what items would be funded from the Planning Division
budget, and what items from the monies from BCAG. In other words, a breakdown of the budget.
Ms. Lesure said a budget breakdown could be provided at the next ALUC meeting.
It was noted that ALUC will be meeting monthly until the policy plan is completed. The next meeting will be
May 15,1996.
B. Continued discussion of the Butte County Airport Land Use Commission Policy Plan. A
report discussing the comments submitted by Commissioners, CEQA requirements and
public hearing requirements. Staff requires.direction as to the schedule for adoption of the
Plan.
COMMENT # 15:
This comment related to the land use charts and footnotes and was postponed to be discussed along with
the charts for land use.
COMMENT #18:
Commissioner Lambert thought that no schools should be allowed in the Overflight zone, although the
chart allows elementary and secondary schools.
Alternate Hennigan said CSA 87 indicated a school west of the Chico airport, which in 1992 met Caltrans
standards but did not.meet the standards in 1995, since the Education Code became more stringent.
CUSD has abandoned the plans for a school at the site. The chart might as well as conform to the
Education Code and not allow such a use in the Overflight zone.
Alternate, Koch said that there might be a situation that a school site could be in the Overflight zone, but
airplanes would not actually fly over the site. The Education Code should be.sufficient.
There was a discussion of how concentrations of people would happen at colleges and universities versus
elementary and secondary schools.

I am enclosing a copy of Nextel's FAA 7460-1 form filed by Nextel on October 19, 1998.
It is my understanding that Form 7460-1 should be completed by the FAA, along with
any obstruction analysis, in the next few weeks. I will forward -a copy to you upon
receipt by Nextel.
I am also enclosm*g a copy of the letter from Nextel's FAA consultant, Walter H. Wulff.
Mr. Wulff has indicated orally that since the lattice structure is already painted and lit, the
FAA will require nothing additional of Nextel since it is proposing to locate 25 feet
below AT&T' present antenna arrays.

Mr. Lucas agreed that it would be better to include the larger area. He said he could prepare maps with
one, two and three mile boundaries delineated.
It was agreed that two miles could be the general default in the policy plan and each airport could have
individual variations.
Mr. Lucas said a two mile limit would have included Foothill Park East, the Cal Soccer field, and only a
small portion of Bidwell Ranch.
It was agreed that the existing CLUP boundaries will be used, and the two mile default will apply
otherwise.

Vill. COMMISSION ITEMS:
A. Budget discussions and status of Caltrans grant funding. The Department of Development
Services has prepared a memorandum addressing the issue to be distributed at the meeting.
Mr. Lucas said the Development Services Department would continue to fund ALUC although not as a
specific item.
Commissioner Lambert said that if any grant money is spent for a consultant, ALUC should discuss that
and might want to be involved with the choice of a consultant.
Mr. Lucas agreed and said that a consultant should probably not be necessary, and he has expressed that
thought to Bill Farrel.
Commissioner Lambert asked exactly what the grant money is to be spent on,
Mr. Lucas said the Caltrans grant is specifically for the countywide policy plan, which includes the
individual CLUPs. Anything related to preparation of the policy plan or CLUP's would be acceptable use of
the money. He said that a consultant is being solicited to prepare noise studies for the Ranchaero and
Paradise airports.
IX. REPORTS AND COMMUNICATIONS: The following items are provided for the
Commission's information and no action can be taken on these items.
