Mr. & Mrs. Palmer:
On March 21, 2007, the Airport Land Use Commission (ALUC) heard the referenced project and a motion
was made to find the project not acceptable/compatible under Section 2.4.4(f). The vote� on the motion was 3
to 3. No other motion wa:s made. Under the regulation of the Butte County Airport Land Use Compatibility
Plan (BCALUCP), a tie vote is considered no action being taken.
According to the BCALUCP, the Airport Commission must take action within 60 days of project being
deemed complete. The project was deemed complete on February 22, 2007. The Cor-imission determined
,that if the applicant agreed to include the, conditions in the ALUC report as part of the tentative map
approval, no further action will be taken by the Commission. Therefore, based on no action by ALUCj the
project will be deemed *compatible on April 22, 2007.
Please include the following conditions as part of the tentative parcel map:
1. Provide a deed notice for the sale of all resulting lots notifying purchasers o-l'thd proximity of the
airport and the potential for possible noise related impacts in an ALUC-approved disclosure
notice.
2. Place a note on a separate document which is to be recorded concurrently with the map or on an
additional map sheet that all deeds referencing lots shown on this map shall contain the
following note: "The Butte County Airport Land Use Compatibility Plan identifies that the
parcel is within the Paradise Skypark Airport Influence Area.. Properties within this area are
occasionally subject to aircraft using this public -use airport and, residents may experience
inconvenience,. annoyance, or discomfort arising from the noise of such operations. State law
(Public Utilities Code Section 21670 et seq.) establishes the importance of -)ublic-use airports to'
protection of the public interest of the people of the state of California. Residents of property

near such airports should therefore be prepared to accept the inconvenience, annoyance, or
discomfort from normal aircraft operations. Residents shall also be aware that the current
volurne of aircraft activity may increase in the future in response to Butte County population and
economic growth. Any subsequent deed conveying this parcel or subdivisions thereof shall
contain a statement is substantially this form."
3. Prior to the recordation of the map record as a separate instrument an Avigation Easement
granting the right of continued use of the airspace above the proposed parcels by the Paradise
Skypark Airport and acknowledging any and all existing or potential airport operational impacts.
4. Place a note on a separate document which is to be recorded concurrently with the map or on'an
additional map sheet that states: "An Avigation, Easement is recorded above the parcels for the
Paradise Skypark Airport and acknowledging any and all existing or potential airport operational
impacts,"
5. Place a note on a separate document which is to be recorded concurrently with the map or on an
additional map sheet that states: "Airspace review by the Airport Land Use Commission is
required for all objects over 100 feet in height."

Dear Mr. and Mrs. Palmer,
Thank you for your letters requesting a refund of your application fee for the Butte County Airport Land Use
Commission review of your project within the Town of Paradise., Your request was based on -three reasons:
1. Your parcel is located in an area that was most likely inappropriately designated as a C
Compatibility Zone (as discussed at the hearing);
.2. The Commission electedto take no action on our project; and
3'. You agree to. incorporate the conditions included in the ALUC report.
Although the Airport Land Use Commission may have discussed that the compatibility zones may be
*inappropriately determined (based on the topography and the flight pattern), the existing Butte County
Airport Land Use Compatibility Plan is still the approved document and. determines the requirements for
consistency review.
Staff'did research and prepared the necessary report to present the project to the Commission. The
Commission did take action, it was a 2-2 vote, and under the Airport Land Use Commission Bylaws, a tie
vote, with no other motion, is considered a no action. If no action is taken by the Commission, the project is
deemed consistent within 60 days of application submittal. The requested conditions are included as part of
project consistency. They are included whether or not the project goes before the Commission.
The project was taken forward in a proper manner; therefore, no refund of the application fee will be issued.
