Based on those discussions the County is willing to not require at this time the necessity -to improve the roads to the minimum standard we had previously requested. At this time we will consider them as ranch access roads not intended to be used for access to a structure but for access to the property. But should the owner wish to construct a structure at a later date that utilizes one of these roads they will need to be improved to the minimum standard in place at that time as required by Cal Fire and PW, Therefore we will require that,a note be placed on the plans that states'the`following: The roads identified on this grading plan have not been approved for access to any permitted structures at this time. Should the property owner desire to use them for such access the road being used for that access shall be improved to the minimum acceptable standard, in effect at the time of such request, as required by Butte County Fire (Cal Fire) and the Butte County Public Works Department. The improvements shall be done under a subsequent grading permit to be issued at that time." In a ition this restriction note shall be included in the permanent property record maintained by the Department of Development Services, Building Division. We will also require the proponent to provide some form of grading to reduce possible erosion on the roads that have been constructed. This could take the form of cross berms or cross swales to reduce the length and velocity of runoff along the length of the road. We will leave the. particulars as to how to accomplish this up to you and the property owner. But this needs to be on the grading plan that we will approve at this time. My question and somewhat of a request is to look at the request on this project. The owner graded some of the land for internal access and cultivation areas without a grading permit he has paid his county fees and we have surveyed the site and provided a grading plan, he has also done all his BMP and SWPPP items and he is being very proactive to comply with the county. We have been told through county comments that the internal access he graded has to meet county driveway standards. The internal access are too.steep to meet the driveway standard without a tremendous amount of work he is using these interior roads to access his large amount of land. There is no building permit and no structures therefore no need for an access or driveway to be built. To help the owner comply with the county and finalize his grading permit is there any way we can create a large berm of utilize his existing locked gates to define the internal access roads as internal grading since there is no building an no reason to have a driveway standard road. It is somewhat like interior roads that are built on farm lands none of these require driveway standards. We are looking to you for your assistance on this project we understand work was done without a grading permit but the owner has went done everything asked of him to comply and we are looking at a way to make this work let me know if you have any ideas or if it would be better to go over this over the phone I can do that as well or I can come and sit down to discuss with you too thanks again. Here are some of the Grading -related topics for discussion. 1. You say: "The passage of Measure A should not have an effect on the pending violations and Grading Permits. The violation occurred and are in conflict with the current Grading ordinance and had nothing to do with whether they could or could not grow MMJ under our MMJ producing ordinance which is what Measure A'. was about." I understand Measure A is not the whole picture regulating MMJ, please help me understand the full regulatory context. 2. Measure A, BCC 34A changes what MMJ is allowed. It is sound land use policy to issue entitlements consistent with allowed uses. For instance, GRD13-0006 has/had an active grow operation. Looks like Measure A could affect operations at this site. If the operation is in violation to Measure A, maybe we shouldn't issue the grading permit ye t(?) A. Should we holdup grading permits for those permits with grows until Measure A conformance is ensured? Or, do we condition for compliance? , B. Who reviews for compliance with Measure A and when? C. , CECIA looks at the whole of the project. Env rev on grading permits may not ignore land use issues existing/ ' pending, in my opinion, especially if they are inconsistent with code. 3. We're not following this guidance, it seems to me: BCC 13-13 - Director's report. Upon receipt of a complete application for a grading permit by the director, completion of an environmental review pursuant to section 13- 7, and the director's consideration thereof, the director shall submit a report including his recommendations to 'the zoning administrator together with a request that the matter be set for hearing.
