NOTICE
Each project applicant shall remit to the county clerk the environmental filing fee before or at the time of filing a Notice of Determination (Pub.
Resources Code, § 21152; Fish & G. Code, § 711.4, subdivision (d); Cal. Code Regs., tit. 14, § 753.5). Without the appropriate fee, statutory or
categorical exemption, or a valid No Effect Determination issued by the California Department of Fish and Wildlife (CDFW), the Notice of
Determination is not operative, vested, or final, and shall not be accepted by the county clerk.
COUNTY DOCUMENTARY HANDLING FEE
The county clerk may charge a documentary handling fee of fifty dollars ($50) per filing in addition to the environmental filing fee (Fish & G.
Code, § 711.4, subd. (e); Cal. Code Regs., tit. 14, § 753.5, subd. (g)(1)). A county board of supervisors shall have the authority to increase or
decrease the fee or charge, that is otherwise authorized to be levied by another provision of law, in the amount reasonably necessary to recover
the cost of providing any product or service or the cost of enforcing any regulation for which the fee or charge is levied (Gov. Code, § 54985,
subd. (a)).
COLLECTION PROCEDURES FOR COUNTY GOVERNMENTS
Filing Notice of Determination (NOD):
❑ Collect environmental filing fee or copy of previously issued cash receipt. (Do not collect fee if project applicant presents a No Effect
Determination signed by CDFW An additional fee is required for each separate environmental document. An addendum is not
considered a separate environmental document. Checks should be made payable to the county.)
❑ Issue cash receipt to project applicant.
❑ Attach copy of cash receipt and, if applicable, previously issued cash receipt, to NOD.
If the project applicant presents a No Effect Determination signed by CDFW, also:
❑ Attach No Effect Determination to NOD (no environmental filing fee is due).
Filing Notice of Exemption (NOE) (Statutorily or categorically exempt project (Cal. Code Regs., tit. 14, §§ 15260-15285, 15300-15333))
❑ Issue cash receipt to project applicant.
❑ Attach copy of cash receipt to NOE (no environmental filing fee is due).
Within 30 days after the end of each month in which the environmental filing fees are collected, each county shall summarize and record
the amount collected on the monthly State of California Form No. CA25 (TC31) and remit the amount collected to the State Treasurer. Identify
the remittance on Form No. CA25 as "Environmental Document Filing Fees" per Fish and Game Code section 711.4.
The county clerk shall mail the following documents to CDFW on a monthly basis-
✓ A photocopy of the monthly State of California Form No. CA25 (TC31);
✓ CDFW/ASB copies of all cash receipts (including all voided receipts);
✓ A copy of all CDFW No Effect Determinations filed in lieu of fee payment;
✓ A copy of all NODS filed with the county during the preceding month; and
✓ A list of the name, address and telephone number of all project applicants for which an NOD has been filed. If this information is contained
on the cash receipt filed with CDFW under California Code of Regulations, title 14, section 753.5, subdivision (e)(6), no additional
information is required.
DOCUMENT RETENTION
The county shall retain two copies of the cash receipt (for lead agency and county clerk) and a copy of all documents described above for at
least 12 months.
RECEIPT NUMBER
The first two digits automatically populate by making the appropriate selection in the County/State Agency of Filing drop down menu.
The next eight digits automatically populate with the current month, day, and year.
The last three digits correspond with the sequential order of issuance for each calendar year. For example, the first receipt number issued
on January 1 should end in 001. If a county issued 252 receipts for the year ending on December 31, the last receipt number should end in
252. CDFW recommends that counties and state agencies save a local copy of this form. Each time the form is opened orrthe same
computer, the last three digits will automatically populate in sequence. However, CDFW recommends that counties track receipt numbers
on a spreadsheet tabbed by month to ensure accuracy.
DO NOT COMBINE THE ENVIRONMENTAL FEES WITH THE STATE SHARE OF FISH AND WILDLIFE FEES.

Should you desire to appeal the decision or the Planning Commission or any of the

Standard Conditions of Approval
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County Zoning
Ordinance, including Butte County Code Section 24-251.
2. Unless otherwise provided for in a special condition to this Use Permit, or an
approved Extension of Time pursuant to BCC 24-247C, all conditions must be
completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within two years of the date
of approval per BCC 24-247A.
3. Changes to this approval may be requested by the review authority following a
noticed public hearing, or by conformance with the criteria for Minor Changes in

The community building has been operational since approximately 2011 and has been
maintained by the Feather River Park and Recreation District since that time without any
identified detriment to the public health, safety, and welfare of Butte County

or planned services and infrastructure.
The single-family home on site was legally established in 1988 while within unincorporated
Butte County, Building Permit BPI] 62-88. Well, septic, and electric are functional onsite and
adequate to serve existing and planned uses.
E. The size, shape, and other physical characteristics of the subject property are adequate to
ensure compatibility of the proposed use with the existing and future land uses in the vicinity
of the subject property.
The 14+ acre parcel is an adequate size for the existing community park, proposed restroom
and other park improvements. The riparian area crossing the eastern portion of the site will
be maintained in a natural form with the existing use. No tree removal or substantial grading
are proposed with planned improvements.

• Per decision of the Berry Creek Community Park Board (Park Boardl, the Park does not have regular
hours but rather is opened for planned events. The bathroom will be opened during these planned
events.
• When not open, the park gate is locked and the bathroom closed. Pedestrians may use the park even
when it is not open, but the BCCA does not open the bathrooms for informal day use.
• The applicant has indicated that BCCA does not have employees to open and close the park gate and
bathrooms on a daily basis. Vandalism is another concern with leaving the park open.
RESOLUTION
The following changes to the approving resolution are proposed:
• Delete the second recital. It is an environmental finding repeated later in the resolution.
• Changes to the environmental findings in the approving resolution are recommended to clarify
that both current and future phases of proposed project improvements would be exempt from the

Staff recommends the Planning Commission find the project to be Categorically Exempt pursuant
to Section 15303 of the CEQA Guidelines (Class 3 Exemption - New Construction or Conversion
of Small Structures) and approve Conditional Use Permit UP16-0003 subject to conditions in
Attachment B.
PROJECT DESCRIPTION
The applicant is requesting approval of a conditional use permit in Berry Creek to add an
approximately 144 square foot restroom building to serve an existing Community Park in the first
phase, and to add a bocce ball court, horseshoe pit, flagpole, hiking trail around the perimeter of
the property, and/or storage shed in future phases.
The proposed restroonts would be detached from the existing Community Center and tie into the
existing septic tank and leachfield. The bathroom would typically be locked unless events are
planned at the Community Center. .
SITE AND LOCAL VICINITY DESCRIPTION
• A single-family home on site was legally established in 1988 under Building Permit
BPI 162-88. Well, septic, and electric are functional onsite.
• The project parcel was created by Parcel Map, recorded in Book 107, Page 51 Record
Maps, June 15, 1997.
• After a lease period, the property was purchased by the Pioneer Union Elementary School
District (PUESD) and it was utilized as a classroom until about five years ago when a new
school was built next door that serves about 40 children.
• After the classroom relocated, the old building sat unused for many years. In 2011, PUES.D
leased the site to the all -volunteer Berry Creek Community Association (BCCA) for $1.00
per year, with the mutual understanding that the project site would be turned into a park
and the existing building into a community center. See Attachment D.
• BCCA cleaned up the grounds, restored the building; and maintains the property, under the
'umbrella' of Feather River Parks and Recreation District, which pays utilities and
insurance.

The Park was established in 2011, when the PUESD(property owner) entered into a lease with the
Feather River Recreation and Park District (FRRPD) and turned the project site into a park and the
existing building into a cornmunity center.. No use permit was requested in order to allow the
school district to lease the facility to FRRPD, or for conversion of the building to a community
center for use by BCCA
In September 2016, the BCCA requested a conditional use permit for the established park use in
order to obtain a building pen -nit for a restroom.
Zoning/General Plan Consistency
• The project parcel has a General Plan land use designation of Foothill Residential and is
zoned FR -5 (Foothill Residential, 5 acre minimum parcel size).
• Butte County Code Table 24-1.9-1. requires "Parks and Recreational Facilities" to obtain a
Conditional Use Permit within the FR zoning designation.
• Conditional Use Permit UPI 6-0009 is consistent with the following General Plan policies:
LU -P6.1 The County will encourage school districts and park and recreation districts to
locate school sites and parks within or adjacent to existing or planned residential and
mixed use neighborhoods.
The PUESD confirmed use of the subject site, which is adjacent to the Berry Creek Elementary
School, as a Community Center and Park. in 2013 (See Attachment E). Approval of the Conditional
Use Permit to build bathrooms and other facilities demonstrates county support for the adjacent
school and park sites, consistent with L U -P6.1
PUB -P6.1 Review of development proposals shall be coordinated with public agencies in
order to designate sites for new parks and recreation facilities.
PUB -A6.1 Coordinate with park and recreation districts to allow the development of park
and recreation facilities on publicly -owned land.
Staff'contacled Glenda Nelson of PUESD and April Ramage of'FRRPD, consistent with policy
PUB -P6.1 and PUB -A6.1. Both Administrators supported the Conditional Use .Permit for the
Community Center and Park in verbal discussion and as demonsyrated by the signed lease
agreement.
PUB -P7.2 Implementation and development of recreation and park facilities within park and
recreation district boundaries shall be consistent with the applicable district's master plans.
Required Findings
Butte County Code section 24-222 specifies conditions and findings necessary to approve a use
permit; as follows.

24-222 Findings The review and decision-making authority may approve an application
for a Conditional Use or Minor Use Permit only if the proposed project
complies with applicable standards in the Zoning Ordinance, other County
ordinances, the General Plan, any other applicable community or specific plan,
and the County Improvement Standards, and as supported by all of the
following findings:
A. The proposed use is allowed in the applicable zone or meets the criteria for
the reconstruction or intensification of a nonconforming use per Article 111,
Division 12 (Nonconforming Uses and Structures).
Parks and Recreational Facilities may be permitted within the FR -5 zone (Foothill Residential
5 -acre minimum parcel size), with the issuance of a conditional use permit. The Park was
established in 2011, when PUESD (property owner) entered into a lease ivith FRRPD and
turned the project site into a park and the existing building into a community center to be
operated by BCCA.
A conditional use permit was not requested by FRRPD to lease out the.facility as a park or
for conversion of the building to a community center. BCCA, which operates the property,
noiv seeks a use permit for the park, which. is needed to secure building permits) for a .
restroom building and other future improvements.
B. The location, size, design, and operating characteristics of the proposed use will
be compatible with the existing and future land uses in the vicinity of the
subject property.
The Park is a compatible land use with the adjacent Berry Creek Elementary School, Berry
Creek Volunteer Fire Company (Station 61) and nearby residences. The park compliments
public and residential land arses in the vicinity of the project.
C. The proposed use will not be detrimental to the public health, safety; and
welfare of the County.
The community building has been operational since approximately 2011 and has been
maintained by the BCCA, in conjunction with the FRRPD without any identified detriment to the
public health, safely, and welfare of'Bulte County.
D. The proposed use is properly located within the County and adequately
served by existing or planned services and infrastructure.
The single family home on site was legally established in 1988, Building Permil BI'1162-SS. Yf%ll,
septic. and electric are functional onsite and adequate to serve the project. .
E. The size, shape; and other physical characteristics of the subject property are
adequate to ensure compatibility of the proposed use with the existing and
future land uses in the vicinity of the subject property.

The 1=1+ acre parcel is an adequate size.for the existing community park, proposed restroom and
other park improvements. The riparian area crossing the eastern portion of the site will be
maintained in a natural form with the existing use. No tree removal or substantial grading is
proposed with planned improvements.
ENVIRONMENTAL REVIEW
The proposed project is consistent with the categorical exemption criteria for CEQA Guidelines
Section 15303, New Construction or Conversion of Small Structures, and does not meet the criteria
for any exceptions to categorical exemptions pursuant to CEQA Guidelines Section 15300.2. The
project will not affect or involve scenic highways, hazardous waste sites, historical resources, and
is not anticipated to result in any significant effect or cumulative impact.
Further environmental review under CEQA is therefore not required. Subject to approval of the
project by the Butte County Planning Commission, a Notice of. Exemption shall be filed with the
County Clerk.
COMMENTS RECEIVED
The proposed Berry Creek Community Park and associated improvements were reviewed and
recommended for approval without conditions or substantial comment by the Butte County
Building Division, Department of Public Works, Agricultural Commissioner's Office, Assessor's
Department, CDF/Butte County Fire Department and Butte LAFCO.
As discussed above, the Environmental Health Division has determined that the existing septic
capacity is adequate to serve reported uses. Therefore, approval of the project is linked to reported
uses; should those land uses intensify over time, septic capacity must be expanded to avoid system
failure to remain consistent with the approved CUP.
A notice regarding this hearing and project was published in the Oroville Mercury Register on
October 12, 2016, also sent to property owners in the project vicinity.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below, Kim Schwind /Berry Creek Community Park is hereby granted a Use
Permit for a restroom in the first phase, and bocce ball court, horseshoe pit, flagpole, hiking trail
around the perimeter of the property, and/or storage shed in future phases, consistent with the
attached site plan.
Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within two years of the date of approval.
Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4. if any use for which a Use Permit has been granted is not established within two years of
the receipt of the Permit by the Permittee consistent with conditions of approval herein, the
Permit shall become null and void and reapplication pursuant to Section 24-45 (of the
Zoning Code) shall be required to establish the use previously granted under the expired
Permit unless, 30 days prior to the expiration date; a request for a one year extension is
submitted to the Planning Commission together with sufficient evidence that the time limits
for processing development permits under federal or state regulations require time limits
which exceed one year. Upon application, and for good cause by the Permittee, at a public
hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any
time limitation previously made a part of any condition to a Use Permit.

5. The terms and conditions of this Permit shall run with the land and shall be binding upon
and to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development
Services to commence a revocation hearing, and, if proven to exist, shall constitute
sufficient grounds to revoke a Permit.
7. The Butte County.Planning Commission hereby reserves ongoing jurisdiction over this Use
Permit. The Commission may, at its own discretion, and following a noticed public
hearing, revoke this Use Permit, and/or add additional conditions of approval, or. modify
existing conditions of approval, upon receipt of written complaints or other evidence of
adverse impacts upon surrounding properties or the public health, safety or welfare.

History;
The land .(around 15 acres) was originally park of a bigger parcel and was used for cattle grazing.
The owner of the land donated some of the parcel to the Pioneer School District and to the
Berry Creek Volunteer Fire Dept. A K-8 school and a separate pre-school were built on part of
the parcel. Many years back the school district purchased the rest of the parcel.
The 15 acres that we are calling a park has a community building on it that was used as a -
residence and then as a classroom once the school took over the property. There is an existing
septic, well, and electric power.
About 5 years ago the Berry Creek Community Assoc. entered into an agreement with the
Pioneer School District to lease the land and community building to turn the area into a park.
We also entered into an agreement with Feather River Parks and Rec. to become a park under
their umbrella. They cover costs for insurance, utilities, and improvements, we as volunteers,
do the work. We have made improvements by clearing debris, thinning the woods for fire
safety, mowing down.the weeds, painting the building, fixing the well and sheltering it with a
metal shed, and fixing the septic.
Current;
The volunteers have developed a plan to build an outdoor bathroom for the park. We have the
permission from the school district and Feather River Parks and Rec. has offered to pay for the
Material. We already engaged an Architect, who drew up the plans and three of,our volunteers
have experience with building, electric, and plumbing. In an effort to get the permits for
building, we learned that the property was still zoned for residential use, not for the public.
Rather than try to get the area re -zoned, we were told that we might apply for a conditional use
permit.
The bathroom would only be open when the park is being used. We currently only use the
building for our monthly meetings. At our monthly meetings we usually have about 5 people
show up. We have volunteer work days (4-5 times a year) that might include up to 8 people. We
also do a 'Concert in the Park' once a year that is sponsored by Feather River Rec. and Park. The
sound system for this is a microphone and speakers. It is held outside near the building. We use
an extension cord from the building for power. People bring their own camp chairs and picnics.
The hours are 6-8pm. Our attendance for that is about 30 people over the course of two hours.
We hope to continue this yearly tradition. Because we are on school property we do not allow
alcohol. There is a sign posted at the gate.
The gate to the park would remain locked unless we were there for a meeting or a cleanup day
or for the concert in the park. The grounds are available to hike on and we do have concrete
picnic benches for picnics. There is access from the school parking lot. We will not havelregular
operating hours as there is no paid staff to open and lock the gate on a daily basis. The. park is
not used by.hikers or for picnics in the winter season, although we do continue to meet
monthly throughout the year.

We do not foresee any need for accessory structures at this time. No food preparation will be
done on the premises.
FUTURE;
Our future plans are to build a Bocce Ball Court and a horseshoe pit. Feather River Park and
Rec. has also donated a flag pole. We are. hoping to get funding (from FRRPD) for a metal shed
structure to house some of the historical farm implements that have been donated over�the
years. We hope to restore and display them around the park area. There is a hiking trail that
has been cut (by the Feather River Hot Shots) around the perimeter of the property, and 'we are
hoping to improve that with educational signage showing native plants and trees. i

Dear Ms. Schwind,
This department has completed our pre -application review to determine if it is possible use an existing
wastewater system to accommodate a community park restroom. We have a letter from Haling and
Associates indicating that the system is adequate for your proposal for a monthly meeting of the Berry
Creek Community Park Board, volunteer work days for up to eight people, three days a month, and a
yearly concert attended by 30 people. Based on this information we are prepared to approve this Minor
Use Permit.
You should be aware that other agencies will review this proposal when it is submitted to Development
Services. These other agencies may have conditions that would significantly alter your project to the
extent that we may need to change our conditions. Our tentative approval of this pre -application must
not be interpreted as approval by the County for this proposal. The entire formal review procedure
must still be completed through the Development Services Department.
