MINE (CA MINE #91-04- 0031), COUNTY OF BUTTE The Department of Conservation (Department), Office of Mine Reclamation:(OMR).received a financial assurance cost estimate (cost estimate) in the amount of $24,801 for the New Era mine on January 14, 2008. This mine is operated by North Continent Land and Timber Inc. The County of Butte is the Surface Mining and Reclamation Act of 1975.(SMARA) lead * • agency for this surface mining operation. Public Resources Code (PRC) Section 2774(c) provides that, prior to .approval of a"cost estimate, a lead agency must submit the. cost estimate and all related documentation to the Department at one time. This requirement is clarified in California Code of Regulations, Title 14 (CCR), Section 3805. OMR has determined that the documentation accompanying the recent cost estimate submission for the New Era Mine is incomplete. Specifically, it contains no indication from Butte County, as required by CCR Section 3805, that the cost estimate amount is adequate. For this reason, we are returning the cost estimate to you at this time. Please submit a copy of the -proposed cost estimate, and all related documentation to OMR at onetime. Please also include a cover letter indicating that your agency considers the financial assurance amount to be adequate to conduct and complete reclamation on the mined lands in accordance with the approved reclamation plan. Box 5362 Chico, CA 95927 RE: Review of Financial Assurance'"Cost Estimates New Era Mine (CA MINE ID# 91-04-0031)/4095 Dry Creek Rd., Oroville, CA Dear Mr. Noland: This office is in receipt of your Financial Assurance Cost Estimates* dated January 25; 2008, prepared by • Holdredge and Kull forthe New:Era Mine 'Public Resources Code Section § 2773.T(a)(3) states "The amount of financial assurances required of a surface:mining,operation for anyone year shall be adjusted annually to account for new lands disturbed by. surfaceMning operations;inflation, andTeciarnation-of lands accomplished in accordance with the approved reclamation plan." Califomia Code of.Regulations (CCR) Section § 3805 requires -that prior to submitting the -Financial Assurance Cost Estimates to the Office of Mine Reclamation, the County of Butte must frrst:determine that the estimates are adequate. Staff has conducted a preliminary review of your cost estimates, which is required prior to the County forwarding them to the Office of Mine Redarnation for final review. In reviewing the cost estimates, staff found several deficiencies in the cost estimates. These deficiencies are noted as follows: • The Cost Estimates will need to include the source and methodology utilized in determining equipment costs (i.e. Labor Surcharge & Equipment Rental Rates/Caltrans, Caterpillar, etc.); • The Cost estimates will need to include the source and methodology utilized in determining all labor costs (i.e. prevailing union labor rates, Dept. of Labor, etc.); • Page 2. of 6, Under Item II. Revegetation costs, the task description indicates "Fertilize and sow native grasses and plant native trees. Native seed mix applied by hydroseed subcontractor and trees planted by hand method.0- Under this task, there should be a more precise description as to the specific tasks to be performed. This may take the form of a narrative description. Please include the number of trees to be planted, the species of trees, the size of trees, etc. Relative to the seed mixture, please include a description of the seed mixture (species/blend). Please provide the basis for the cost utilized in calculating the seed mbdure and trees to be planted. Please note that this may be achieved through the inclusion of a detailed seed supplier/nursery bid attached to the cost estimates. • • Page 3 of 6, Under Item 111. Plant Structures and Equipment Removal, the description and costs associated with any "bone -yard' or scrap metals should also be included in this section if applicable. 218 Mr. Noland February 21,2008 Page Two • Page 4 of 6, Under Item IV., Miscellaneous Costs, the Aescription of the task indicates that there will be permit acquisition. This section will need to indicate the total cost of permits, as well as the labor costs. Please breakdown into two line items. Specific permits shall be detailed (i.e. demolition permit, grading permit, building permit, transportation permit, etc.). Under this task, a cost for engineering the six (6) sediment ponds above Dry Creek, including the necessary permits should also be included. Page 5 of 6, Under Item V. Monitoring Costs, it states for the description of the task as °Engineering construction quality assurance observation and testing services. Onsite observation and -compaction testing." Please provide a narrative description as to the specific tasks that are to be performed under this task. Additionally, all equipment to be utilized in performing this task shall be included in the estimate. Also, identify the personnel to complete this task (i.e. engineering geologist, civil engineer, engineering technician, etc.) and the hourly rate for the individual(s) to complete this task. Since there are to be four visits per year, please indicate when these visits are to take place (wet weather, summer conditions, etc.). • The Financial Assurance Cost Estimates should also include a site plan depicting the areas that have been disturbed at present and including. those areas that are to be disturbed this coming year,. areas to be reclaimed and any, phasing should also be identified on the site plan. The site plan should clearly identify the 18-6cees.in question; location of overburden on the site, and including the -location of the topsoil.. The site plan should also include the location of sediment ponds and Dry Creek for reference. je • The Cost Estimates shall also include a cost breakdown for the mobilization of.equipment. This shall include all transportation costs, including cost of transporting equipment and all labor associated with the task. • . The required cost estimates shall also include the name and address.of the authors of the cost estimates. Page 6 of B, included a signature, however, the name shall also be printed so that it can be easily determined who the author is. Please note that based on the deficiencies noted above, this office is unable to determine the adequacy of the cost estimates for submittal to the Office of Mine Reclamation pursuant to CCR Section. §3805 at this time. Therefore, the revised estimates will need to be resubmitted to this office within 30 days of the date of this letter. Upon receipt of your revised estimates, this office will conduct a preliminary review and if determined to be adequate per CCR Section § 3805, this office will forward your estimates to the Office of Mine Reclamation for review and concurrence.
