Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below:. Norman Hornsby is hereby granted a Use Permit in
accordance with application filed: July 11, 1994 to allow a mobile home as a temporary.
second dwelling unit on property zoned "U" (Unclassified) located on the northwest corner,
of Power House Hill Road and Dad's Lane, at 5946 Power House Hill Road, Oroville, CA.;
I. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within months of the '
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the Permittee,
the permit shall become null and void and reapplication and a new permit
shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and,:
assigns of the Permittee.
SPECIAL CONDITIONS:
1.. Occupancy .of the mobile home is limited to Lori Pinagree and her daughter.
2. No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department for,
domestic water supply and sewage disposal. The applicant must install a sewage
disposal system under permit and inspection from Environmental Health office.

4. The mobile home is -to be a temporary use on the property pursuant to the
requirements of Section 24-303 of the Butte County Code.
5. The Use Permit shall expire two years from the date of issuance of the Use Permit.
Upon application, the Planning Commission may grant an extension of the Use
Permit not exceeding one year.
6. In the event that the applicant, for any reason, vacates the premises, the Use
Permit granted herein shall automatically expire and the mobile home shall be
removed within one hundred twenty (120) days. In the event the mobile home is
not removed within one hundred twenty (120) days pursuant to the terms of the
Use Permit, the County shall remove the mobile home and store it at the owner's
expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of removal in
the amount of $1,500 for a single -wide mobile or $2,000.00 for a double -wide
mobile.
8. Meet the requirements of the Building Division of the Butte County Department of
Public Works.
9. Meet the requirements of the Butte County Fire Department/California Department
of Forestry. The structure must meet the Fire Safe Regulations of Butte County
and PRC 4290 including the provision for an all weather access for a 40,000 pound
fire apparatus to all structures. In addition, the applicant is required to pay $200.00
into the Battalion 3 Water Tender Fund.
10. Building permit fees and any current, or new, impact fees are to be paid at the fee
level in place at the time of the application for the building permit. Applicant will
be responsible to meet additional requirements established by Pacific Bell for
telephone service.
11. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
Note: Minor changes may be approved administratively by the Director of Development
Services, or designee, upon receipt of a substantiated written request by the
applicant. Prior to such approval, verification shall be made by each Department
or Division that the modification is consistent with the application, fees paid, and
environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.

shown.
The hearing was opened to the public.
Norman Hornsby said he and his wife are disabled and they want to have their niece live
on the property to help them.
The hearing was closed.
Chairman Lambert asked if it was necessary to state the name of the niece's daughter!
and Mr. Hogan said no.
It was moved by Commissioner Seegert, seconded by Commissioner Lynch, and
unanimously carried for approval as follows:

Permit to allow a mobile home as a temporary second dwelling in an U zone. The project is
located at the northwest corner of Power House Hill Rd. and Dad's Lane, in the Oroville area.

ABSTRACT: This is an application for a Use Permit to allow a temporary mobile home on
AP# 025-310-018 located at 5946 Power House Hill Road, south of Oroville. The parcel is
zoned U with a General Plan designation of Agricultural Residential, which is consistent with this
request. Staff recommends approval of this request.
PROJECT CHARACTERISTICS: The project is located on a 2.7 acre parcel. The plot plan
indicates adequate parking on site. Access to the site is a driveway that comes directly off of
Power House Hill Road. Water will be provided by an on-site well.. Sewage disposal will be
provided by a septic system. The plot plan indicates the leach fields will be located well
beyond the 100 feet setback from the well. There are no features or unusual lot configuration
that would pose potential problems for this requested land use.

ANALYSIS: There are no major concerns with this Use Permit request for a temporary mobile
home as a second dwelling. The proposal is consistent with the zoning and General Plan Land

Use designation for the area. There is adequate access to the site from Power House Hill Rd.
There is a well on-site that will provide water. The plot plan indicates a sufficient area for septic
purposes adequately located beyond the 100 foot septic setback from the well.
This Use Permit request is not only consistent with the zoning and General Plan designations,
but is consistent with the purposes of County Code Section 24-303 which states these
purposes are "for the care of persons who by reason of old age, disease, infirmity or other
cause .... would benefit from familial assistance ...." An affidavit notes the applicant and
his wife are both on State Disability Insurance and require the attention of a caretaker. The
applicant's cousin and her daughter will be living in the mobile home and assisting the applicant
and his wife.
Butte County Code Section 24-394 provides for removal of the mobile home within 120 days
of the time that it is no longer being occupied. The Code also makes provision for the County
requiring a bond or deposit at the time of issuance of permit of sufficient size to cover the
removal expense of the mobile home should the County be forced to remove the mobile home
voluntarily, then the bond or deposit would be returned. A bond for $1,500 per single -wide and
$2,000 for a double -wide mobile home would be required. The applicant proposes to place
a single wide mobile home on the property.
ENVIRONMENTAL DOCUMENTATION: The proposed project is categorically exempt from
the requirements of the California Environmental Quality Act in accordance with Section 15303
Class 3 (a) of the Public Resources Code. This Section finds exemptions for single-family
residences.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Prior to the public hearing, notices are mailed to all property owners
within a 300 foot radius of the subject property.
RECOMMENDATION: Staff recommends that the Commission approve the application for a
Use Permit on AP# 025-310-018, subject to the following findings and conditions.
Section 1: Environmental Findings.
A. The project is Categorically Exempt from environmental review under the
California Environmental Quality Act;
Section 2: Zoning Ordinance Findings.

The Board of Supervisors has found that for the health, safety, and welfare of the people
of the County that it has often become necessary for the care of persons who by reason
of old age, disease (either mental or physical), infirmity or other cause, are unable,
unassisted, properly to manage and take care of themselves, or would benefit from
familial assistance, to allow mobile homes to be placed on smaller parcels than present
County codes or ordinances permit so that such persons will not have to be
institutionalized, but rather can reside near their close relatives who can help care for
them. The ability to care for one's close relatives will not only result in better care for
citizens, but will also negate in many situations the necessity for public assistance which
many citizens find degrading and damaging to the pride of the persons concerned and
their immediate relatives. This will also provide privacy and dignity for the relative as
well as independence, of which these people are deserving.

Dear Mr. Hornsby:
The Butte County Planning Commission held a meeting on September 22, 1994, your
request for a Use Permit to allow a mobile home as a temporary second dwelling on
property zoned TO located at the northwest corner of Power House Hill Road and Dad's
Lane, Oroville, was approved subject to the following conditions:
1. Occupancy of the mobile home is limited to Lori Pinagree and her daughter.
2. No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department for
domestic water supply and sewage disposal. The applicant must install a sewage
disposal system under permit and inspection from Environmental Health office.
4. The mobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-303 of the Butte County Code.
5. The Use Permit shall expire two years from the date of issuance of the Use Permit.
Upon application, the Planning Commission may grant an extension of the Use
Permit not exceeding one year.
6. In the event that the applicant, for any reason, vacates the premises, the Use
Permit granted herein shall automatically expire and the mobile home shall be
removed within one hundred twenty (120) days. In the event the mobile home is
not removed within one hundred twenty (120) days pursuant to the terms of the
Use Permit, the County shall remove the mobile home and store it at the owner's
expense.

7. The applicant is to pay a deposit or post a bond to cover the cost of removal in
the amount of $1,500 for a single -wide mobile or $2,000.00 for a double -wide
mobile.
8. Meet the requirements of the Building Division of the Butte County Department of
Public Works.
9. Meet the requirements of the Butte County Fre Department/Califomia Department
of Forestry. The structure must meet the Fre Safe Regulations of Butte County
and PRC 4290 including the provision for an all weather access for a 40,000 pound
fore apparatus to all structures. In addition, the applicant is required to pay
$200.00 into the Battalion 3 Water Tender Fund.
10. Building permit fees and any current, or new, impact fees are to be paid at the fee
level in place at the time of the application for the building permit Applicant will
be responsible to meet additional requirements established by Pacific Bell for
telephone service.
11. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
NOTE CONCERNING ALL COUNTY CONDITIONS OF APPROVAL:
"Minor changes may be approved administratively by the Directors of Environmental
Health, Planning or Public Works upon receipt of a substantiated written request by the
applicant and only as to those conditions or requirements recommended by their
respective departments. Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid
and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment."
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing with the appeal fee of $250.00, to the Clerk of the Board of
Supervisors, 25 County Center Drive, Oroville, Califomia, prior to 5:00 p.m., Friday,
September 30, 1994. If you do not appeal and if there are no other appeal within the 8 -
day appeal period, your use permit will be issued after September 30, 1994.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be
filed. The fee for the filing of a Notice of Exemption is a $25.00 documentary handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00
should be submitted to the Planning Division by October 3, 1994.
