If applicant is not the owner, written authorization by the owner or other proof of agency must be submitted in order for the applicant to legally sign the application. Application shall be considered void if not signed by the owner or legal agent. 2. All items on application shall be filled in as completely as possible. If an item is not appli- cable, please indicate by the term "NA". 3. It is important that the applicant supply an accurate description of the location of the proposed project, including the following: a. Assessor's parcel number(s) (from the tax bills or Assessor's maps). b. Street addresses (if available). c. Distances and directions to named streets, bodies of water or railroads. 4. 7'wer�� copies of a detailed plot plan of adequate scale to clearly show proposed build- ings and improvements, folded to 8'/z x 11 inches, shall accompany and be made part of the "Application for Use Permit". If the use permit is approved, .the plot plan becomes the ap- proved development plan for the property.The plot plan shall include the following information: a. A scaled drawing of the parcel(s) boundaries. b. Location and dimensions of all existing and proposed improvements on the property, including buildings, driveways, parking areas, wells, septic tanks and leach fields. c. Location and name of bordering streets, access roads, nearby crossroads, streams, bodies of water and railroads. d. North arrow and scale of drawing. 5. The "Application for Use Permit" is subject to public hearings and approval by the Planning Commission. Any special conditions of approval shall be made a part of the approved "Use Permit" and shall be binding on the applicant. The procedures for County action on use per- mit applications are stated in Chapter 24 of the Butte County Code. 6. The Planning Commission, on the basis of the evidence submitted at thepublic hearing,may grant use permits when it finds that the proposed uses of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be un- reasonably incompatible with or injurious to surrounding properties nor detrimental to the health and general welfare of the persons residing or working in the neighborhood nor to the general health, safety and welfare of the county. 7. In approving a use permit, the Planning Commission may include such conditions as are deemed reasonable and necessary under the circumstances to preserve the integrity and character of the zone and to secure the general purposes of the Butte County General Plan and Chapter 24, of the Butte County Code. Such conditions may include, but are not limited to: time limitations, development plan approval, hours of operation, fencing, dedication of right-of-way, and street and drainage improvements. Conditions imposed upon issuance of a use permit must be reasonably related to the use for which the permit is requested. 8. AGENDA ITEM REQUEST: Use Permit for Clarence & Kay Slagle on AP#036-220-180: A request for a Use Permit to allow a permanent second dwelling, on property in the A -R zone. Located on the southeast side of Foothill Boulevard at the intersection with Windfall Way, in the southeast Oroville area., RELATED ITEMS: None FOR: Planning Commission Meeting ABSTRACT: This request is consistent with both the current zoning and General Plan. An issue of this project is the Oroville Urban Reserve designation.. Staff recommends approval of the project subject to the findings and conditions listed in this report. PROJECT CHARACTERISTICS: This project is a request for a Use Permit to allow a permanent second dwelling on a 16.25 acre parcel. The parcel is developed with one 1800 square foot single family dwelling and a 1000 square foot outbuilding (shop). The property contains an_OWID irrigation ditch, which diagonally bisects the parcel northwest to southeast. The existing home is located on the southwest side of the ditch and the proposed home will be located in the northeast side and take access from Foothill Boulevard, or an existing easement off of Foothill Boulevard. Butte County Department of Development Services - Planning Division ■ 11 r L AGENDA ITEM ANALYSIS: The proposal is consistent with the zoning, which allows for residential uses but requires a use permit for duplexes and multiple family dwellings. The AR zoning is consistent with the General Plan Land Use designation of Low Density Residential. The Land Use, designation allows for residential densities of up to 4 units per acre, utilizing septic systems. The policies of the urban reserve state plans for sewer, water and circulation are necessary prior to development of parcels less than 10 acres. As this parcel is well over 10 acres, the policies do not apply. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15303(a). PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Prior to the public hearing, notices are mailed to all property owners within a 300 foot radius of the subject property, but not less than 10 parcels. RECOMMENDATION: Staff recommends that the Commission approve the application for Clarence & Kay Slagle on AP#036-220-180, subject to the following findings and conditions. Section 1: Environmental Findings. A. The proposed project is exempt from the requirements of CEQA; and B. The design of the proposed project improvements will not cause environmental damage to fish or wildlife or their habitat; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and Section 3: Actions. A. Subject to the findings indicated in Sections 1 and 2 of this report, approve the Use Permit for Clarence & Kay Slagle on AP#036-220-180 to allow a permanent second dwelling. (LPW) (VIDEO) The Commission waived the presentation of the Staff Report. A video of the site was shown. Lisa Purvis Wilson gave a brief summary of the project, and said staff is recommending approval. The hearing was opened to the public. Clarence Slagle said he has had Environmental Health out to inspect the septic system and Public Works on the access. He said he had no objections to the conditions. �o,eeJ Wsww Lewis, 3876 Foothill Blvd., Oroville, submitted a statement of objections signed by 4 other neighbors which he read for the record. He said the septic and leachfield will contaminate the canal. He said the proposed driveway will go into the easement which is his driveway and will exit out at a blind corner. He said there is a better location at the other end of the property near Windfall Way. He said Mr. Slagle has not been a friendly neighbor. He said he was concerned with increasing the density in the area. He requested the Use Permit be denied. He said he objects to sharing the easement and is concerned with dangerous access. He said the other end of the property has access onto Windfall Way. He said he did not want to see sewage flow into the canal. Commissioner Nelson noted that this. is a 16 acre parcel, zoned A-5, with an Agricultural Residential designation. He asked if it could be divided into three 5 acre lots? Mr. Hogan said this is correct. Mr. Lewis said the proposed development is on three acres. He said 12 years ago he had a chance to purchase this property, but was told by Mr. Overhouse of the Environmental Health Department that the parcel was not large enough to build on. He said he did not see how there is room for a septic system now. Commissioner Seegert said the County would not approve a leachfield system that would damage the canal. Mr. Lewis said he was representing 4 out of 6 neighbors against this project. Mr. Slagle said the septic will be pumped and has been approved by the Environmental Health Department. Chairman Lambert said she understands the concerns of the neighbors. She noted that the parcel could be subdivided and a house built without a Use Permit. Ms. Purvis Wilson stated that OWID and Public Works had no concerns. Mr. Hogan said if the Commission is concerned with the driveway location, they could condition the permit for the driveway to come off of Foothill. Chairman Lambert asked a direct question of Mr. Lewis, "is the current access off of Foothill is a blind corner?" Mr. Lewis said yes. Mr. Hogan said the Commission could add a condition that access off Foothill be to the satisfaction of Public Works. Commissioner Nelson said Mr. Slagle has as much right to use the easement as Mr. Lewis. Ms. Purvis Wilson said the safety of the access will be handled in the encroachment permit process. It was moved by Commissioner Seegert, seconded by Commissioner Nelson, and unanimously carried for approval as follows: Section 1: Environmental Findings. A.
