(SL) (VIDEO) (95-124) r Mr. Lucas said that there is a high power transmission tower near the proposed site, and a railroad in the background. Staff felt that the tower would blend in with the surroundings at this ` location. Commissioner Lambert suggested that on Condition X46, the word "shall" should be changed to "may" as in "other cellular operations who mML be permitted to acquire space on the tower." Commissioner Lynch suggested adding, "without an additional Use Permit," since the tower would already be a permitted use. Mr. Lucas said that a Use Permit should not be required for additional facilities on the tower. t Mr. Hogan said that the requirement for a Use Permit cannot be waived by a condition. The Code should be amended if the Commission does not think a Use Permit should be required to place an additional facility on the tower, althought it could be interpreted as a Minor Modification. The purpose of the Use Permit is to notify residents of the area. That could be addressed when the Ordinance is revised. Commissioner Lynch said that multiple use of the towers should be encouraged without excessive red tape. The multiple use should be allowed on this Use Permit, and the Ordinance can be changed later. He suggested stating: "the tower shall be constructed to structually accommodate future antenna installations by other cellular operators who may be permitted to acquire space on the tower without an additional Use Permit." The Use Permit should be for the tower, not for the transmission units. Mr. Hagan said that since the item was advertised as "cellular telephone facility," the Commission could allow additional transmission units without a Use Permit. HEARING OPEN TO THE PUBLIC Karen Brainerd, with Cellular One, said that the site is close to the freeway, which the Commissioners have indicatedthey approve of. The proposed tower can handle co -location, and Cellular One has adopted a co -location policy. -She suggested that on Condition A, the word "paint" be changed to "finish." The Planning Manager would still have to approve the finish. She said that a steel matt finish requires less maintenance and tends to look better. Cellular One does not object to taking excess height off the tower, but that is contrary to the co -location capacity which has been requested. The Planning Manager should have the authority to decide if the extra height should be left on the tower for future co -location. The proposed tower will be 150 feet high. Chairman Nelson asked if the tower would have a strobe? f Ms. Brainerd said that -she does not believe that the FAA is requiring that this tower have a light on top. i Commissioner Lynch said that this tower will not be in an area of agricultural airplane flight Pte - Ms. Brainerd said the tower is located in the corner of the parcel in order to cause as little interference as possible. Commissioner Lambert noted that a gray finish might not always be acceptable, although it might + be fine in this location. Ms. Brainerd requested that the final decision could be left up to the Planning Manager. The material would be made of galvanized steel -- a dull matt gray. Commissioner Seegert said that the existing transmission towers appear to be about 150 ft tall. Mr. Lucas said that is correct. Commissioner Lynch felt it was unnecessary to paint a galvanized tower. Commissioner Lambert suggested eliminating the first part of Condition 41, "if hazardous materials are to be stored on-site," since it is already known that there will be propane fuel on site. In any case, the requirements of the Fhvironmental Health Dept must be met It was moved by Commissioner Seegert, seconded by Commissioner Lynch, and carried unanimously, for approval of the Use Permit for Chico MSA Cellular, Inc., on AP 041-220-044, subject to the findings and Conditions of the Staff Report, changing Condition A to change the word "paint!' to "finish and/or paint," and changing Condition A as follows: . "Meet the requirements of the Butte County Environmental Health Division for hazardous material storage, including the filing of a Business Plan," and changing Condition 45 to say that the "height shall not exceed 150 ft., and changing Condition 46 to eliminate the second "shall" and replacing it with "may", and adding, "without obtaining additional Use Permits." Section 3: Action 4 A Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Chico MSA Cellular on APN 041-220-044, subject to the following conditions indicated herein. B. Minor changes may be approved administratively by the Director of Development Services or designee upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. Finish and/or paint the cellular antenna tower with a natural color that is compatible with the landscape of Table Mountain. The color shall be approved by the Planning Division prior to installation. 2. At such time the permitted tower is no longer needed at this location, or no longer needed to be the permitted height, the applicant shall either remove the tower or shorten the tower in response to future service needs. The facility will be unmanned, but visited approximately once per month for routine maintenance purposes. Metro PCS will obtain all required building permits prior to the start of construction. Since the Use Permit for this tower was approved, Butte County has adopted a wireless communication facilities ordinance (Butte County Code section 24-262) which is very restrictive. According to section 24-262, the Unclassified (U) zoning of this parcel requires that a Use Permit be obtained for the collocation of antennas. The new Wireless Communication Facilities Ordinance supersedes conditions of any previously approved Use Permit. In order to install the additional antennas, a Use Permit must be approved by the Planning Commission. Upon your request, I will mail you a Use Permit application and submittal requirements. We have normally been exempting collocations from the requirements of the California Environmental Quality Act, which greatly speeds up the processing of the project. Depending on our workload, a hearing before the Planning Commission would take place approximately six to eight weeks after submittal of the application (assuming the application is determined to be complete). RELATED ITEMS: None FOR: Planning Commission Meeting of June 22, 1995 ABSTRACT: This application is for a Use Permit to allow the installation of a cellular telephone antenna and equipment building. The public use facility is conditionally consistent with the U zoning and General Plan designation of Grazing &Open Lands. Staff recommends approval with conditions and findings of this application. PROJECT CHARACTERISTICS: The applicant proposes to construct a 150 ft. self supporting lattice tower for the installation of up to 12 cellular antennas and 6 microwave dishes. A 336 sq. ft. equipment building will also be located on the site. The facility will include an emergency generator and propane fuel supply. The entire 3000 sq. ft. site will be enclosed by a six foot high chain link fence and will be serviced approximately twice a month by • MSA personnel. The facility will have access from Table Mountain Ranch Drive near its intersection with Table Mountain Blvd. The vacant grazing area will be leased from Fletcher Brown, owner of the property. The site is currently a part of a large cattle ranch that covers the area between Table Mountain Blvd. and Table Mountain. The ranch has a single family home and a variety of out buildings. The site will require no alteration to the topography. ANALYSIS: The proposed cellular communications facility is considered a conditional use under the U zoning which requires a Use Permit. The General Plan designation of Grazing & Open Lands indicates that quasi -public uses are considered Secondary Uses. The project will establish a cellular telephone facility in the north Oroville area that will serve as a link between the Oroville market and antennas located in the Chico market. The proposed antenna tower is not near an airport and is under the 200 ft. height restrictions established by the Federal Aviation Administration. The tower will utilize a small, unused grazing area that represents no significant plant or wildlife habitat. The site will generate no traffic increases, require no new infrastructure, nor will it impact any surrounding land uses. The one issue of concern is the potential for the facility to cause a visual impact in relation to the Table Mountain viewshed. As proposed, the facility will be located approximately 5000 ft. from the base of Table Mountain and is an area of various other visual disturbances. The proposed tower location is approximately 200 ft. west of the existing 150 ft. tall electric utility transmission towers/lines, 150 ft. east of the Table Mountain Ranch Drive/SR 70 overpass, and 700 ft west of the ranch house and accessory buildings. The view directly to the east of this site also includes the Union Pacific railroad tracks that run along the base of Table Mountain. All of the above visual distractions are extremely noticeable and have contributed to a degree, to the disturbance of the Table Mountain viewshed at this specific location. For this reason the proposed cellular antenna tower will not create a new or substantial visual impact to the viewshed. To further alleviate viewshed concerns, it is suggested that the project be conditioned to paint the tower a natural color that would allow it to more effectively blend with the Table Mountain backdrop. It is also recommended that a condition be placed on the Use Permit that requires the tower to be • ■ Butte County Department of Development Services - Planning Division ■ 1 AGENDA ITEM removed or shortened when and if the facility is not needed to be at the proposed height or no longer needed at ie this location. Comments were received from the Butte County Fire Department indicating that the facility must meet the Fire Safe Regulations of Butte County and PRC 4290 except for the water requirements. The Department of Public Works responded with no infrastructure concerns. The Environmental Health Division recommended no conditions at this time, but would require the applicant to file a Hazardous Materials Plan when and if any hazardous materials are stored on-site. ENVIRONMENTAL DOCUMENTATION: This project is covered by the general rule that the California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing significant effects on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Upon the careful review of the project, it has been determined that this application meets the criteria for a general rule exemption under Section 15061(b) (3) of the California Environmental Quality Act guidelines. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Oroville Mercury Register. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a Use Permit for Chico MSA Cellular on APN 041-220-044, subject to the following findings and conditions. Section 1: Environmental Findings. • A. This project will have no significant environmental effects and meets the criteria for a general rule exemption under Section 15061(b) (3) of the California Environmental Quality Act guidelines; and B. The design of the project and improvements will not cause environmental damage to fish or wildlife or their habitat; and Section 2: Zoning Ordinance Findings. A. RELATED ITEMS: None FOR: Planning Commission Meeting of June 22, 1995 ABSTRACT: This application is for a Use Permit to allow the installation of a cellular telephone antenna and equipment building. The public use facility is conditionally consistent with the U zoning and General Plan designation of Grazing & Open Lands. Staff recommends approval with conditions and findings of this application. PROJECT CHARACTERISTICS: The applicant proposes to construct a 150 ft. self supporting lattice tower for the installation of up to 12 cellular antennas and 6 microwave dishes. A 336 sq. ft. equipment building will also be located on the site. The facility will include an emergency generator and propane fuel supply. The entire 3000 sq. ft. site will be enclosed by a six foot high chain link fence and will be serviced approximately twice a month by MSA personnel. The facility will have access from Table Mountain Ranch Drive near its intersection with Table Mountain Blvd. The vacant grazing area will be leased from Fletcher Brown, owner of the property. The site is currently a part of a large cattle ranch that covers the area between Table Mountain Blvd. and Table Mountain. The ranch has a single family home and a variety of out buildings. The site will require no alteration to the topography. ANALYSIS: The proposed cellular communications facility is considered a conditional use under the U zoning which requires a Use Permit. The General Plan designation of Grazing & Open Lands indicates that quasi -public uses are considered Secondary Uses. The project will establish a cellular telephone facility in the north Oroville area that will serve as a link between the Oroville market and antennas located in the Chico market. The proposed antenna tower is not near an airport and is under the 200 ft. height restrictions established by the Federal Aviation Administration. The tower will utilize a small, unused grazing area that represents no significant plant or wildlife habitat. The site will generate no traffic increases, require no new infrastructure, nor will it impact any surrounding land uses. The one issue of concern is the potential for the facility to cause a visual impact in relation to the Table Mountain viewshed. As proposed, the facility will be located approximately 5000 ft. from the base of Table Mountain and is an area of various other visual disturbances. The proposed tower location is approximately 200 ft. west of the existing 150 ft. tall electric utility transmission towers/lines, 150 ft. east of the Table Mountain Ranch Drive/SR 70 overpass, and 700 ft. west of the ranch house and accessory buildings. The view directly to the east of this site also includes the Union Pacific railroad tracks that run along the base of Table Mountain. All of the above visual distractions are extremely noticeable and have contributed to a degree, to the disturbance of the Table Mountain viewshed at this specific location. For this reason the proposed cellular antenna tower will not create a new or substantial visual impact to the viewshed. To further alleviate viewshed concerns, it is suggested that the project be conditioned to paint the tower a natural color that would allow it to more effectively blend with the Table Mountain backdrop. It is also recommended that a condition be placed on the Use Permit that requires the tower to be ■ Butte County Department of Development Services - Planning Division ■ . 1 AGENDA REM removed or shortened when and if the facility is not needed to be at the proposed height or no longer needed at this location. Comments were received from the Butte County Fire Department indicating that the facility must meet the Fire Safe Regulations of Butte County and PRC 4290 except for the water requirements. The Department of Public Works responded with no infrastructure concerns. The Environmental Health Division recommended no conditions at this time, but would require the applicant to file a Hazardous Materials Plan when and if any hazardous materials are stored on-site. ENVIRONMENTAL DOCUMENTATION: This project is covered by the general rule that the California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing significant effects on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Upon the careful review of the project, it has been determined that this application meets the criteria for a general rule exemption under Section 15061(b)(3) of the California Environmental Quality Act guidelines. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in the Oroville Mercury Register. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for a Use Permit for Chico MSA Cellular on APN 041-220-044, subject to the following findings and conditions. Section 1: Environmental Findings. A. This project will have no significant environmental effects and meets the criteria for a general rule exemption under Section 15061(b) (3) of the California Environmental Quality Act guidelines; and B. The design of the project and improvements will not cause environmental damage to fish or wildlife or their habitat; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land . lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare, and safety of the residents of the County; and B. The proposed project is conditionally consistent with the Unclassified zone and is a Secondary Use under the Grazing & Open Lands General Plan designation. Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Chico MSA Cellular on APN 041-220-044, subject to the following conditions indicated herein. B. Minor changes may be approved administratively by the Director of Development Services or designee upon receipt of a substantiated written request by the applicant.
