Lassen Avenue, Chico, was approved subject to the conditions as listed in the attached Use Permit. Both copies must be signed and returned to this department within 30 days from the expiration of the 10 day appeal period. Should you desire to appeal any of the conditions imposed by the Planning Commission, you must do so in writing with the appeal fee of $250.00, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 p.m., Monday, August 7, 1995. If you do not appeal and if there are no other appeal within the 10 -day appeal period, your use permit will be issued after August 7, 1995. Please be aware that failure to return the signed copies within the 30 days will result in the Use Permit becoming invalid. Re-application to this department would then be necessary to proceed with the project. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project' may have. The proposed use of the property will not impair the integrity and character of the zone in which the land lies in that it is an expansion of a currently permitted use allowed in this zone with a Use Permit. B. The proposed use of the property would not be unreasonably incompatible with, or injurious to, surrounding properties in that it would not alter the present use of the property, nor add a new land use that would conflict with surrounding properties. C. The proposed use of the property would not be detrimental to the health, welfare, and safety of the persons residing or working in the neighborhood or other general health, welfare, and safety of the County in that no new land uses are proposed that may result in safety or health issues, e.g., traffic impacts, hazardous waste impacts, etc., but rather, the proposed use will simply expand the current facilities allowing for the continued use of present activities. Section 3: Conditions: A. Subject to the findings indicated in Sections 1 and 2 of this Permit and the conditions below, a Negative Declaration is hereby adopted and Use Permit approved for the Church of Christ on AP#007-570-001 to allow expansion of current facilities on property zoned R-3 located on the southwest side of E. Lassen Avenue and Burnap Avenue, Chico. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. The project site is located approximately 4-5 miles west of the Tuscan Monocline. Construction of buildings to Uniform Building code standards will provide adequate protection to occupants incase of seismic activity. Some short term air quality impacts will probably result during the construction phases of the project. Increased vehicle and equipment emissions during site preparation and construction may occur. Mitigation: None required. b. The creation of objectionable odors? Yes No X Maybe Response: The proposal will not create any long term objectionable odors, smoke or fumes. Some fumes and smoke may occur during construction activities, but this occurrence would cease once construction is completed. Mitigation: None required. c. Alteration of air movement, moisture, temperature, or any change in climate, whether locally or regionally? Yes No X Maybe Response: The proposal will not affect local or regional climate. Only large projects such as the construction of a large high-rise buildings, the creation of a large water body (such as a lake or thousands or acres of rice fields), massive defoliation, or introduction of large tracts of vegetation where there was previously none, would have the climactic effects discussed in this question. A portion of the area proposed for building expansion is covered with impervious material. The interior area, approximately 1500 s.f., is covered with groundcover. This area will no longer allow infiltration for runoff once the project is complete. The effect is minimal in that this area represents approximately 6% of the entire parcel which is already completely covered. Runoff rates and volume will not be significantly changed from the site's current condition. (Site visit) Mitigation: None required. c. Need for off-site surface drainage improvements, including vegetation removal, channelization or culvert installation? Commissioner Lynch thought that it would be too restrictive to not be able to use the classrooms for any purpose on any other day, as stated in Condition 7. He asked about the legal language included in the new format of the Agenda Report. i W. Hogan explained the advantages of the new style of Agenda Reports. �. • t Commissioner Lambert asked for clarification of the comments about parking spaces on Page 1 of the Agenda Report? Mr. Hackney explained that the additional. building square footage-would.require more spaces, but -there .are sufficient existing parking spaces to meet the requirements. There was a discussion of requiring landscaping. Mr. Hogan said that in this case the parking spaces are already existing, and that is why landscaping 5% of the parking area was not required. There is an existing gas service to the existing building. Any new construction can not be built over this gas service. In addition, the'gas meter must remain on the outside of any new buildings and can not be enclosed. It will be necessary, for the applicant or his contractor to contact Underground Service Alert (USA) at 1-800-642-2444 to have existing underground utilities located prior to any digging or grading. USA requires a minimum of 48 hours advance notice. If the existing gas service line or meter are in conflict with the proposed new construction, they will have to be relocated at the expense of the owner/developer.
