Hogan, Planning Manager BY: Stephen Betts, Assistant Planner DATE: August 7, 1995 0 AGENDA ITEM REQUEST: Use Permit - Laurel McCartney, APN 035-200-036, File 95-189: A request for a Use Permit to allow an additional dwelling unit located at 1935 Jefferson Street, south Oroville. The property is zoned M-1 (Light Industrial). This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of August 24, 1995 ABSTRACT: Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a use permit, pursuant to Butte County Code Section 24-175.C.1, to allow the placement of an additional dwelling in a M-1 zone. The property is a 5,104 sq. ft. (12 acre) parcel, and is located on the comer of Jefferson Street and Lincoln Blvd., south Oroville The property is zoned M-1 (Light Industrial). The Land Use Element of the Butte County General Plan designates the property as Industrial. The property is currently developed with a 720 sq. ft. single-family house, a 876 sq. ft. structure that is being used as a residence, and a 160 sq. ft. carport. No industrial or manufacturing activities occur on the property. This application will legally permit the 876 square foot structure to be a residential unit. Domestic water for the property is supplied by California Water Company. Sewage disposal is handled by LOAPUD. Surrounding zoning is M-1 and R-1. The Butte County General Plan designation for the surrounding properties is Industrial. The surrounding existing land use to the west and north of the subject property is residential. Land use to the south is industrial, which is an auto wrecldng yard. ANALYSIS: This project will allow the existing 876 sq. ft. structure to be used as an additional dwelling unit. This structure, originally built for storage purposes, was converted to residential use and has been functioning illegally as a residence for many years. This application will legally permit this structure to be used as an additional dwelling unit. The land use of the property will not change as the structure has been used as a residence for many years. The M-1 zoning requires a Use Permit for all residential uses that are not accessory to an industrial use on-site. The 720 sq. ft. residence is a pre-existing nonconforming use that was established prior to the M-1 zone and, therefore, legal as per Butte. County Code Section 24-35.15. ■ Butte County Department of Development Services - Planning Division 0 AGENDA ITEM The rear of the proposed second unit is located very close to the rear property line. An auto wrecking yard is on the other side of the rear property line. A chainlink fence with wood slats separates the two properties. As per the requirements of the M-1 zone there is no required rear yard setback for the additional dwelling. However, there may, be some special building code requirements due to the structure's -proximity to the property line. The additional dwelling unit does not currently meet the standards of the Butte County Building Department. This structure must be approved by the Building Department prior to a use permit being issued to the applicant for the additional dwelling unit. The additional dwelling unit is already connected to a domestic water supply and to sewer service. Will serve letters from California Water Company for domestic water, and LOAPUD for sewage disposal have been received. There is sufficient space on the property to accommodate two off-street parking spaces per dwelling unit. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will be published in a local paper and public notices Will be mailed to all property owners within a 300 foot radius of the subject property. RECOMMENDATION: Staff recommends that the Planning Commission approve the Use Permit for an additional dwelling unit for Laurel McCartney on APN 035-200-036, subject to the findings and conditions listed in Exhibit A. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte county Zoning Ordinance, including Butte County Code Sec. 24-62. 2. -Unless otherwise provided for in a special condition to this use permit, all conditions must:be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding property or detrimental to the health, safety and general welfare of the persons residing or worldng in the neighborhood or to the general health, welfare and safety of the County; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Fxhibit A, Use Permit for Laurel McCartney to allow an additional dwelling unit is approved subject to' the following Conditions indicated herein. B. Minor changes may be approved administratively by the Director of Development Services, or designee, upon receipt of a substantiated written request by the applicant Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment C. Conditions of Approval: 1. • Prior to the issuance of the Use Permit a building permit for the additional dwelling unit must be issued. If the building permit is not finalized within one year, the Use Permit may be considered in violation and revocation procedures instituted. I hereby declare under penalty of perjury that I have read the foregoing. conditions and that they are, in fact, the conditions which were imposed upon the granting of this permit. Since the property is zoned M-1, which allows only one (1) living unit per parcel, a use permit must be obtained from the Butte County Planning Department. Since permits and inspections are required for the above work, please submit three (3) complete sets of plans, apply for the required permits, and pay the appropriate fees. All work must stop until these permits are issued and you are authorized by our field inspector to proceed. The field authorization cannot be made until the existing work is inspected and approved. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means of enforcement if voluntary compliance is not obtained. Enforcement may be pursued through the issuance of citations, fines and the recording of a Notice of Violation including a description of the action necessary to abate the violation. You have thirty (30) days to voluntarily comply with the above directions or to present an acceptable plan for abatement or corrective actions to be taken by you. The property is zoned M-1 (Light Industrial). This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of August 24, 1995 ABSTRACT: Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a use permit, pursuant to Butte County Code Section 24-175.C.1, to allow the placement of an additional dwelling in a M71 zone. The property is a 5,104 sq. ft (.12 acre) parcel, and is located on the corner of Jefferson Street and Lincoln Blvd., south Oroville The property is zoned M-1 (Light Industrial). The Land Use Element of the Butte County General Plan designates the property as Industrial. The property is currently developed with a 720 sq. ft single-family house, a 876 sq. ft. structure that is being used'as a residence, and a 160 sq. ft. carport. No industrial or manufacturing activities occur on the property. This application will legally permit the 876 square foot structure to be a residential unit. Domestic water for .the property is supplied by California Water Company. Sewage disposal is handled by LOAPUD. Surrounding zoning is M-1 and R-1. The Butte County General Plan designation for the surrounding properties is Industrial. The surrounding existing land use to the west and north of the subject property is residential. Land use to the south is industrial, which is an auto wrecldng yard. ANALYSIS: This project will allow the existing 876 sq. ft. structure to be used as an additional dwelling unit This structure, originally built for storage purposes, was converted to residential use and has been functioning illegally as a residence for many years. This application will legally permit this structure to be used as an additional dwelling unit The land use of the property will not change as the structure has been used as a residence for many years. The M-1 zoning requires a Use Permit for all residential uses that are not accessory to an industrial use on-site. The 720 sq. ft residence is a pre-existing nonconforming use that was established prior to the M-1 zone and, therefore, legal as per Butte County Code Section 24-35.15. ■ Bune County Department of Development: Services - Placating Division ■. s AGENDA ITEM • i The rear of the proposed second unit is located very close to the rear property line. An auto wrecking yard is on the other side of the rear property line. A chainlink fence with wood slats separates the two properties. As per the requirements of the M-1 zone there is no required rear yard setback for the additional dwelling. However, there may be some special building code requirements due to the structure's proximity to the property line. The additional dwelling unit does not currently meet the standards of the Butte County Building Department. This structure must be approved by the Building Department prior to a use permit being issued to the applicant for the additional dwelling unit. The additional dwelling unit is already connected to a domestic water supply and to sewer service. Will serve letters from California Water Company for domestic water, and LOAPUD for sewage disposal have been received. There is sufficient space on the property to accommodate two off-street parking spaces per dwelling unit. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will be published in a local paper and public notices will be mailed to all property owners within a 300 foot radius of the subject property. RECOMMENDATION: Staff recommends that the Planning Commission approve the Use Permit for an additional dwelling unit for Laurel McCartney on APN 035-200-036, subject to the findings and conditions listed in Exhibit A.
