Tentative Subdivision Map APN 007-260-081 & 082:
Mr. Sanders presented the staff report. He stated that this item is a consistency review
of an application to divide 11.1 acres into 11 parcels of (1+ acres each) for single
family dwellings. The property is located at the southwest corner of Eaton Road and
Godman Avenue, Chico, south of the Chico Municipal Airport. Staff recommendation
was that ALUC find the project consistent with the 1978 Chico Municipal Airport
CLUP as amended on October 21, 1998, and December 29, 1999.
Chair Rosene opened the hearing to the public. .
Mr. Fred Gerst asked whether this project, in compliance with the proposed CLUP,
would fulfill the open space criteria set forth. Mr. Sanders responded affirmatively,
stating that 10% would equal roughly one acre.
Chair Rosene then closed the hearing.
It" was moved by Commissioner Harp, seconded by Commissioner Wallrich, and
unanimously carried to find ALUC File No. A00-09 Consistency Finding for John and

The proposed development could be considered as infill creating 11
parcels of one acre in size. This would:
a. Reduce the overall number of dwellings;
b. Be more consistent with surrounding parcel sizes;
C. Not significantly impair the operations at the Chico Municipal
Airport; and
d. Not subject any people to unreasonable noise or safety risks
Associated with aircraft operations.
2. The Draft CLUP currently being considered would allow, as infill
Development, the proposed lot configuration and density.
B. Approval of the project without implementation of the requirements below
would necessitate the adoption of Overriding Findings by a 2/3 vote of the
governing body. Overriding Findings by the governing body can only be made
based on substantiated facts and must be supported by new, substantial, factual
evidence introduced into the public record that the proposed action is
consistent with the. State Aeronautics Act as stated in Section 2167.0.
Overriding Findings cannot be adopted as matters of opinion,, heresay, or on
the unsubstantiated fears and desires of the governing body.
1. A condition shall be required as part of the subdivision, map stating that
prior to the issuance of a Building Permit, the property owner shall sign
an avigation easement granting to the City of Chico the right of
continued use of the Chico Municipal Airport in the airspace above the
proposed parcels and acknowledging any and all existing or potential
airport operational impacts.

Godman Avenue, Chico, south of the Chico Municipal Airport.
FOR: Airport Land Use Commission Meeting of November 15, 2000
SUMMARY: Staff recommends ALUC find the project consistent with the 1978 Chico Municipal
Airport CL UP as amended on October 21, 1998, and December 29, 1999.
ANALYSIS: The site is located approximately 1 mile south of the Chico Municipal Airport at the
southwest corner of Eaton Road and Godman Avenue. It is in the unincorporated area and is under
the County jurisdiction. The current General Plan land use designation is Low Density Residential
(LDR) and zoning is Suburban Residential (SR). The property can potentially be developed at 6
dwelling units per acre if community sewerage service is available. Without sewerage, the density
is restricted to 1 dwelling unit per acre because of the Chico Area Nitrate Action Plan.
According to the 1999 Chico Airport Land Use Plan amendment, Safety Zone Map "6-1," the
property is located at the farthest point from the runway at the very edge of zone 6. The east third
of the project site is in Safety Zone 6 - Traffic Pattern Zone and the westerly two-thirds is in a Safety
Zone 7 - Airport Area of Influence (refer to Exhibit D). The allowed density and development
limitations for both Safety Zones are listed below:

According to the above table, residential development in zones 6 and 7 is subject to a number of
conditions and criteria as follows:
Criterion."E": Residential development shall not occur in a noise level greater than 55 dB
CNEL-.
Criterion "K": Density bonuses are prohibited.
Criterion "M": - Second dwelling units are prohibited.
The proposed project will develop at a density of approximately one dwelling unit per acre. This
density is consistent for the portion of the project in Safety Zone 7, but is inconsistent for the easterly
portion f the project area which is within Safety Zone 6.
The easterly portion of the project site is also within an over -flight protection zone `B" which
permits multiple family dwellings but no new single family structures. The proposed project is,
therefore, inconsistent with the over -flight protection zone provisions.
This project is a good example of the difficulties that could arise when a relatively small parcel is
split by two different compatibility zones, particularly in and urban area. The surrounding parcels
are primarily one-half acre in size. The 1999 Airport Environs Plan dictates that approximately 4.5
acres of this 11 -acre parcel cannot be developed to a density greater than one dwelling unit per 2.5
acres while the remaining 6.5 acres of the site can be developed at 4 dwelling units per acre, a 10-
fold difference. Staff views this as an infill project. As such, the proposed layout appears to be a
good compromise. Retaining two 2.5 -acre parcels in this location is not critical to -the safety or
continuing operation of the Chico Municipal Airport. The proposed parcels sizes will be more
consistent with the surrounding lots than having a group of 8,000 square foot lots and a couple of
2.5 acre parcels.
Consistency with the draft 2000 CLUP: New Comprehensive Land Use Plans (CLUPs) have been
prepared for.all public use airports in the county. They are currently in draft form and have not yet
been adopted. However, a series of public hearings have taken place on the plans and amendments
made to address local concerns. Though not final, the CLUPs are close to being adopted. For this
reason, an analysis of the project consistency with the proposed CLUP, is warranted.
The Draft CLUP shows this parcel in Compatibility Zone "C-2." The property immediately north
of this site is in a C-1 compatibility zone and includes the 83 -acre parcel owned by Greg Webb. The
"C-2" zone has a density recommendation of 4 dwelling units per acre or more. As proposed, the
project does not meet the minimum. density requirement. However, this property appears to be
eligible for consideration under the infill policies contained in the plan. For residential development,
if a parcel is between 10 and 20 acres, the infill density can not be greater than double the density
allowed by the primary compatibility criteria. For the "C-2" zone, this means that infill development
cannot be greater than 8 dwelling units per acre. In this case, the proposed development is less than
8 dwelling units per acre and meets the infill policy.

The project site is not in an area that has significant safety or noise issues. The primary issue in
compatibility zone "C" is annoyance from aircraft overflight. From a noise perspective, The C-2
zone calls for higher residential densities so that the resultant ambient noise levels will be higher
than the background noise from aircraft over -flight. However, this particular site already has small
lot subdivision surrounding it on three sides and is adjacent to Eaton Road. Eaton is planned to be
a 4 -lane arterial in the future. Once this road is widened, traffic noise will fa'r'surpass aircraft noise
for this area. The ambient noise for the proposed parcels will be higher than that of a 1 -acre lot
subdivision in amore rural residential environment such as the North Chico Specific Plan.
Airspace Protection and Safety: The topography of the site is generally level. The site elevation is
approximately 178 feet above sea level. The project site is located under the horizontal surface
which has an elevation of 388 feet above sea level. With approximately 210 feet between the ground
and horizontal surface, there shouldn't be an airspace conflict for single family residences. The
execution of an avigation easement is recommended to protect future airport operations.
The 1978 CLUP for the Chico Municipal Airport, as amended on October 21, 1998, contains
diagrams which depict the locations of potential aircraft -related accidents for the facility based on
general accident scatter information presented in the 1993 Airport Land Use Planning Handbook
(refer to Exhibit D - CIC -17). The highest concentration of both departure- and arrival -related
aircraft accidents takes place within the Runway Protection Zone and Approach Surface. Due to the
project site's location at the edge of the airport area of influence, off to the side and approximately
6,000 feet away from the southerly end of runway 31 R, the risk of aircraft -related accidents is not
considered significant for the residential density proposed in the CLUP.
Environmental Documentation: No environmental documentation has been prepared for this project.
RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission
find ALUC File No., A00-09 (John and Sharon Byrne Tentative Subdivision Map) consistent with
the 1978 Comprehensive Land Use Plan (CLUP) for the Chico Municipal Airport, as amended on
October 21, 1998, and December 29, 1999.

The Airport Land Use Commission has prepared the following findings based on data contained in
the 1978 Comprehensive Land Use Plan (CLUP) for the Chico Municipal Airport, as amended on
October 21, 1998, and December 29, 1999, the 1993 Airport Land Use Planning Handbook, and the
Butte County Airport Facilities Manual. These data are based on the findings of a number of studies,
documents, and reports generated by individuals, firms, and agencies recognized as having expertise
in the field of Airport Land Use Planning and land use compatibility (refer to Exhibit B, List of
References). '
The following findings have been prepared at the direction of the ALUC and are .for the
consideration of the Lead Agency (County of Butte) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted ' at the time of project
review.
SECTION 2: CONSISTENCY FINDINGS FOR PROPOSED PROJECT
A. Although the project is not completely consistent with the 1978
Comprehensive Land Use Plan (CLUP) for the Chico Municipal Airport, as
amended on October 21, 1998, and December 29, 1999, the project can be
found consistent with the operations of the Chico Municipal Airport based on
the following findings:
1. The current CLUP would permit 27 dwelling units. Twenty six units
would be allowed on the 6.5 acres of the site located in Safety Zone
7 and 1 dwelling unit on the 4.5 acres located in the Traffic Pattern
Zone. The surrounding parcel sizes are predominately less than 1
acre in size. The proposed development could be considered as ill
creating 11 parcels of one acre in size. This would:
a. Reduce the overall number of dwellings;
b. Be more consistent with surrounding parcel sizes;
C. Not significantly impair the operations at the Chico Municipal
Airport; and

d. Not subject any people to unreasonable noise or safety risks
associated with aircraft operations.
