Provide a deed notice for the sale of all resulting lots notifying purchasers of the proximity of the airport and the potential for possible noise related impacts in an ALUC-approved disclosure notice. 2. Prior to the recordation of the Final Map record as a separate instrument an Avigation Easement granting the right of continued use of the airspace above the proposed parcels by the Chico Municipal Airport and acknowledging any and all existing or potential airport operational impacts. 3. Place a note on a separate document which is to be recorded concurrently with the final map or on an additional map sheet that states: "Airspace review by the Airport Land Use Commission is required for all objects over 100 feet in height." 4. Mr. Michelena said it is for the whole C zone around the Chico Airport, anything that would allow the higher density uses. SUMMARY: Staff recommends that ALUC find the project consistent with "C" zone of the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. , BACKGROUND: • Project density calculations are predicated on City of Chico approval of a pending lot line adjustment (see EXHIBIT E) on the southernmost parcel (APN 016-020-049). This lot line adjustment results in a 16,909 square, foot parcel in the southeast corner that is not -a -part of the proposed tentative subdivision map that is the subject of this report. The project tentative ,subdivision map will thereby be comprised of only two parcels, one containing 4.61 acres and one containing 0.64 acres. The total gross project acreage is approximately 5.25 acres. • All parcels are fully within Zone C (Traffic Pattern) of the Plan. • The proposed subdivision map would create 29 single-family residential lots with a density of approximately 5.2 dwelling units per gross acre. • Parcel sizes range from 5,623 square feet to 22,050 square feet. The average parcel size is 7,885 square feet. • The project site is approximately 0.27 miles northeast of the extended centerline of Runway 31R/13L of the Chico Municipal Airport, at -a distance of 1.95 miles southeast this runway. Clustering of units is encouraged in Compatibility Zones 132 and C — see Policy 4.2.6 for limitations. 9. Hazards to flight include physical (e.g., tall objects), visual, and electronic forms of interference with the safety of aircraft operations. Land use development which may cause the attraction of birds to increase is also prohibited. See the supporting compatibility policies on airspace protection (Policies 4.3.2 and 4.3.6) for details. • The project residential density is 5.2 units per gross acre. The residential density of the project is therefore consistent with Airport Compatibility Zone C. • The ALUCP identifies the project site as outside the 55 dB CNEL level for the Future Average Fire Season Day (Exhibit 4E), the Expanded Forecast (Exhibit 4F), and on the edge of the Peak Fire Attack Day Noise Impacts (Exhibit 4G). A condition is included that requires an interior noise level of 45 decibel (dB) or less for all residences. • Open space requirements are based on the ALUCP are for an entire Compatibility Zone. The C Compatibility Zone requires 10% open space. There are approximately 5,560 acres in the C Compatibility Zone. Enclosed with the application are a check in the amount of $1,531.00, 24 copies of the subdivision map with a location map, and the compatibility zone map that identifies the project site as within the boundaries of Zone C. The application consists of a vesting tentative subdivision map to create 29 lots with -a total of 31 units on 5.52 acres located on the west side of Mariposa Avenue, north of Tierra Rosa Lane, Assessor's Parcel Nos. 016-020-050 and 051.
