his agents to any or each of the Butte County Planning Commission, the Butte County
Department of Development Services, the California, Department of Conservation,
Office of Mine Reclamation, or such other governmental authority or court of competent
jurisdiction as determined by Ronald R. Logan or his agents, each in their sole discretion;

9. - At all times in which I have known Ronald R. Logan and/or his agents, -I
have understood that the New Era Mine was being operated pursuant to ' lawful
authorization;
10. At all times in which I have known Ronald R. Logan, I have understood
that the operations of the New Era Mine were open, obvious, and without concealment to
the public or any third party;
11. I understand upon information provided by Ronald R. Logan and/or his
agents that the Surface Mining and Reclamation Act of 1975 as codified at' California
Public Resources Code, Chapter 9, Article 2, Section 2735, states that "surface mining
operations" includes all, or any, part of, the process involved in the mining of minerals by
• (a) removing overburden and mining directly from the mineral deposits; (b) open -pit
mining of minerals naturally exposed; (c) mining by the auger method; (d) dredging and
quarrying; (e) surface work incident to an underground mine; (f) in place distillation,
. retorting, or leaching; (g) the production and disposal of mining waste; - and (h)
prospecting and exploratory activities;.
12. Based upon my statements and understandings contained herein, it is my
opinion that, during the period in which I have known Ronald R. Logan that he and/or his
agents have been engaged in the following activities, which demonstrate continuous

11. I understand upon information provided by Ronald. R. Logan and/or his
