Lando, PhD' City Manager PO Box 3420 Chico, CA 9527-3420 Re: Verizon Wireless Cell Tower Dear Tom, The Butte County Airport Land Use Commission (ALUC) would like to request that you and your staff review. City Municipal Code regarding the proposed lighting on the Verizon Wireless Cell Tower Extension located at State Highway 99 and the Cohasset interchange. Verizon Wireless has agreed to place lighting atop their proposed extension of the existing cell tower. The site of the tower lies within the Traffic Pattern Compatibility Zone D of the current Comprehensive Land Use Plan 2000 (CLUP). The Butte County ALUC reviewed the application (ALUC File No.A01-05) on October 17,2001 and found it consistent with the CLUP provided a flashing red light was -placed atop the tower. While the light in not required by the FAA (whose guidelines do not take into account any local considerations), it is required by ALUC. The existence of state -mandated (Cal -Trans) ALUC guidelines is precisely meant to consider'local variances in the airport area of influence, and to provide protection for aviators; and the public in those areas. As you know, Cal -Trans Division of Aeronautics .licenses all California public -use airports, not the -FAA.. The Commission would like to ask that the City reinterpret its Cell Tower lighting ordinance. The Chico Municipal Code 19.78.120 paragraph 3 states; 3) All telecommunications towers in non -airport zones shall be unlit unless lighting is required pursuant to FAA regulations. When lighting is required, it shall be shielded, or directed in such a manner as to minimize the amount of light that falls onto nearby properties." The Commission believes that Cal -Trans Aeronautics Law would define this location as within'an Airport Zone (Zone D as depicted in the 2000 CLUP). Therefore the City Code only refers to non -airport zones and would . not apply in this case. Furthermore, the introduction to the City Municipal Code 19.78.010 states: "The regulations contained herein are intended to protect and promote public health, safety, community, welfare and the aesthetic quality of the city while at the same time providing reasonable opportunities for providers of wireless communication services to provide such services in a safe effective and efficient manner. These regulations are further intended to: D). Protect the public's interest in the safe operation' of public safety, emergency and medical services.'.' The Commission feels the reasons that a light should be atop this proposed addition to the tower are as follows; 1) The existing tower is located immediately adjacent to State Highway 99, a main thoroughfare to Low -Level Emergency Aircraft operating as public protection agencies such as; Enloe Flight Care, Mercy Air Ambulance, CHP, CDF, Sheriffs Department, BLM, USES, National Guard, and the Department of Defense. 2) The location is within a'highly populated commercial/retail zone. 3) There is no residential development within the location. 4) The applicant is .willing to comply with the lighting requirements. 5) The proposal conforms to City of Chico Municipal Code as written. The Commission hopes the City Staff will reconsider this application (APN 007-270-022) and grant the use permit to the applicant. Nonetheless, we have been complying with the Plan's criteria for ALU_ C review of land use actions, and will continue to do so as long -as necessary. I do not wish to leave the impression that the City is not currently moving forward on this issue, - or,that the long-term protection of our airport is in any way unimportant to us. We are in fact making progress. The BIR for our Airport Master Platin has been circulated for continent, with certification possible as early as January; we expect that the plan will be adopted next spring. We have prepared administrative drafts of some of the necessary General Plan and coning code amendments, and are now in the process of refining these. I anticipate taking these forward through our process by next spring as well. We are still struggling with several of the same issues I have raised with your Commission in the past, in particular the ALUCP's C(1) compatibility zoning of the Webb property north of Eaton Road. I do expect to return to the ALUC with some alternative proposals -for your consideration early in the new year, and hope that we will ultimately be able. to achieve a mutually acceptable resolution of this matter. We believe that this ordinance represents . the first effort by any local government in California, if not the entire country, to address a gap in the response by the federal government to the events of September 11, 2001. While the federal government has adopted regulations that require identification checks for flight schools for larger -commercial aircraft, these regulations do not reach general aviation airports serving aircraft weighing 12,500 pounds or less. The County's ordinance seeks to fill the gap by instituting a straightforwardidentity check which balances the County's interest in ensuring the safety and well-being of its citizens with the desire of the flight schools to efficiently provide flight training. We are proud of the ordinance and what it accomplishes, and offer it as a model to any other County which owns and operates general aviation airport facilities. We have enclosed a copy of the ordinance, and a copy of a document we prepared to address many of the questions that arose during our consideration of the ordinance. The Board of Supervisors of the County of San Mateo, State of California, ORDAINS as follows: SECTION 1. Chapter 2.140 of the San Mateo County, Ordinance Code is hereby amended by adding Section 2.140.100 thereto'to read as follows:' Section 2.140.100 Application Requirements for Flight School Attendees. (a) No Flight School Operator operating a flight school on the premises of any airport owned by the County of San Mateo shall admit any prospective -student,' or allow any prospective -student to commence flight training at such airport, until the prospective student has completed an application and received clearance from the San`Mateo County Sheriff as provided in this section. (b) Prior to enrolling a prospective student in flight school, or allowing any ' prospective student to commence training, such prospective student shall be required by the Flight School Operator .to' fully complete an application in a form provided by the San Mateo County. Sheriff. Such application form shall -be executed by the prospective student under penalty of perjury. The information to be included in the application will include, but not be limited to: It execute the application under penalty of perjury, shall result in the rej ection of the application. r (c) Upon receipt of a completed and fully executed application, the Flight School , Operator shall forward; the application to the San Mateo County Sheriff. 'The Sheriff shall review the information contained in -the application, and conduct an investigation to determine the truthfulness of such information: ' (d) Within.three (3) working days of receipt of a completed application, the Sheriff , shall advise the Flight School Operator; by telephone, that (1) the applicant's identity has been verified, (2) the information in the application has been found to be untruthful as to the applicant'. s identity, or (3) that additional time is;needed to conduct the investigation.. If the applicant's identity has been verified, or any information provided in the application has been found to be untruthful as' -to the applicant's identity, the Sheriff shall confirm that determination in writing. In the event that the Sheriff determines that - the applicant has been untruthful with respect to any information as to the,,applicant's identity provided in the application, or advises that additional time is necessary to conduct the investigation, the Flight School Operator shall not admit the applicant'to flight training. (e) Within forty-five (45) days of the receipt by the Sheriff of a completed application, the Sheriff shall notify the Flight School Operator in writing of the results of the investigation. In the event that the Sheriff determines that the applicant has been untruthful with . r respect to any information as to the applicant's identity provided in the application, the Flight w K School Operator shall not admit the applicant to flight training. {f) . If the Flight School_ Operator is not advised by the Sheriff of the results of the investigation within forty-five (45) days of the date of receipt of the application by the Sheriff, the Flight School Operator may provisionally admit the applicant to flight school. If the Flight Administration. "Flight training" shall not include .biennial flight review or additional training for persons already holding a,valid pilot's certification, other than a student pilot's certification, issued by the Federal Aviation Administration. "Flight training" shall not include "demonstration flights", consisting of a single flight undertaken by a prospective student to determine whether the prospective student has an interest in undertaking flight training. 3. "Prospective student", "student", or "applicant" shall not include any person holding a valid pilot's certificate as defined in regulations issued. by the Federal Aviation Administration at the time of commencing any flight training activities on the premises of any airport owned by the County of San Mateo, ,except that "prospective student", "student", or 'Applicant" shall include any,person holding only a student pilot's certificate as defined by such regulations: SECTION 2. Any person or entity which violates any provision of Section 2.140.100 or fails to comply with any of the mandatory requirements of this section, shall be guilty of,a misdemeanor. SECTION 3. This ordinance shall be effective thirty (30) days from the date of passage thereof. What is the purpose and intent of the ordinance? A.1. The purpose and intent of the ordinance is to ensure that persons proposing to take flight instruction. at the airports owned by San Mateo County do not use false identities to enroll. Evidence developed after the events of September 11, 2001, indicate that some of the highjackers involved had obtained false identification documents in the past. Federal regulations -are focused on flight instruction for aircraft exceeding 12,500 pounds, and do not adequately address the threat posed bypersons using false identities to obtain flight training on smaller aircraft at the County's airports. The ordinance will provide both a deterrent to anyone contemplating the use of a false identity, and a means of early detection of anyone Who attempts to use a false identity. Q.2. How is that purpose accomplished? A.2. The ordinance requires each applicant for flight training, unless exempted, to submit information, under penalty of perjury, which relates to the applicant's identity. The information: provided will allow the Sheriff's office to conduct an investigation to verify that the applicant is using his or her true identity. Q.3. To whom does the ordinance apply? A.3. The ordinance applies to any person seeking flight instruction at a County -owned airport, who.does not have any pilot's certificate issued by the Federal Aviation Administration. The ordinance also applies to any person holding only a student pilot's certificate issued under Federal Aviation Administration regulations. The ordinance does not apply to any person holding a. pilot's certificate issued under Federal Aviation Administration regulations other than a student's pilot's certificate. Q.4. Does the ordinance apply to an individual holding a valid pilot's certificate? A.4. As noted above, persons holding'a valid pilot's certificate other than'a student pilot's certificate are not subject to the ordinance. Q.S. How is "flight training" defined in the ordinance? A.S. "Flight training" includes any flight instruction, based on the premises of an airport owned by the County of San Mateo, and undertaken for the purpose of obtaining a pilot's certification from the Federal Aviation Administration. "Flight. training" does not include biennial flight review or additional training for persons already holding a valid pilot's certification, other than a student pilot's certification, issued by the Federal Aviation Administration. "Flight training" does not include "demonstration flights", consisting of a single flight undertaken by a prospective student to determine whether the prospective student has an interest in undertaking flight. training. Q.12. What information will be revealed about the applicant from the computer databases utilized byte Sheriff? A.12. Utilizing public data base search engines, the Sheriff will verify only the following information submitted by the student pilotapplicant: name, date of birth, home address, work address, driver's license, professional licenses, social security number and telephone numbers. No inquiry will be made regarding the applicant's ethnic origin, religion or credit history. Further, no file, intelligence or data base will be created as a result of the verification process. However, any discrepancy.or contradictory information may prompt a further review of the individual, in conjunction with airport management and/or the originating flight school. Q.13. ;'ill + e student or Flight School Operator be responsible for paying the cost of verifying the identity of a flight school applicant? A.13. No. There will be no charge for the cost of verifying the identity of a flight school applicant, under the ordinance. Q.14. How long will it take the Sheriff to complete his investigation? A.14. The Sheriff's office will complete its investigation as quickly as possible. In most cases, it is, expected that the investigation will be completed, and the flight school notified; within the three -working -day initial review deadline provided for in the ordinance. The Sheriff believes that in most cases notification will occur even sooner. If the Sheriffs office has not, completed its investigation within forty-five days, the applicant may be admitted to flight school. Q.15. What will the economic impacts be on Flight Training Schools located on San Mateo County Airports? A.15. It is not expected that the process provided for in the ordinance.will have a noticeable economic impact on flight schools since the majority of applicants should be cleared within the initial three working day investigation period or sooner. Q.16. Isn't the threat posed by someone utilizing a truck for wrongful purposes equal or greater to that of someone utilizing general aviation aircraft? Why not impose similar requirements on all individuals who wish to rent trucks, enroll in classes to learn to drive, or apply for a driver's license? A.16.
