Box 942874 Sacramento, CA 94274-0001 Dear Jim, In response to our telephone conversation on September 24, 2002,1 am sending this letter to confirm that the Planning Division of the Butte County Department of Development Services has no objection to your Division issuing a Private Use Airport permit for the private airstrip commonly known as the "Hog Ranch Airport" located in, Butte County. This concurrence with your Division's action is predicated on the. permit being conditioned to limit the use of the air strip to a single party, the property owner of the parcel upon which the airstrip is located. In addition,.I would request that the permit also stipulate that no change or expansion of the use be granted unless approval is received from this Department. I hope this will close the book on any questions surrounding the use of this private air strip. Please contact me if you have any questions regarding this issue. Sincerely, Craig Sanders AICP Senior Planner Kukulica & Associates Communication Specialists October 7, 2002 Airport Commission #7 County Center Drive Oroville, CA 95628 D EC E 0 W E OCT 1 0 2002 BUTTE COUNTY AIRPORT LAND USE COMMISSION Re: Airport Commission Lighting Requirement for Verizon Cell Tower Dear Airport Commission Officers: I work for Kukulica & Associates, Inc. and we are in the process of establishing a Northeast Chico cell tower site for Verizon Wireless in a non -airport zone. As you know, the Airport Commission ("Commission") has requested that the cell tower have lighting for directional purposes. However, the lighting requested is not required by the Federal Aviation Administration (FAA). We would readily comply with the Commission's request to add lighting, however, the City of Chico has a local ordinance that prevents the use of lighting on cell towers in non -airport zones. The relevant section of the Chico Municipal Code states: "19.78.120 Development Standards 3. All telecommunications towers in non -airport zones shall be unlit unless lighting is required pursuant to FAA regulations. When lighting is required, it shall be *shielded or directed in such a manner as to minimize the amount of light that falls onto nearby properties." - - :, - OCT 10 2002 Airport Commission Airport Commission Page 2 We have discussed the matter -with the City of Chico and it will not allow the Northeast cell tower to be lit. Thus, I am writing to ask that the Commission to reconsider its lighting request or revise it to fit within the bounds of the Chico City Ordinance.
