32 ' ,-review foria proposed Use Permit to allow a substance abuse rehabilitation program
33 �-,that:will�evolve a residential living component. • In addition a portion of the site will .
34 - be used for warehousing -and - administrative offices associated with the Salvation
35. Ariny. The property is approximately 4.5 acres in size and is zoned M-1, Light
36 N Industrial. The site is located on the east side of Cohasset Road, approximately 5,800
. 37 feet north of Eaton Road, north of.Chico.

39 Mr. Joe Baker presented 'the staff report. He stated that the subject property has a
40 5300 square foot building that formerly housed the Mountain Impact surplus sporting
41 good store. He also` stated that the proposed plan would be to convert the structure to
42 house 'a warehouse, facility' for' the Salvation Army as well as an adult residential
43 rehabilitation program for substance abuse treatment of ambulatory adult individuals.
1 Mr. Baker reported that the .site is between compatibility zones "B2" and "Cl" and
2 compatibility uses are non=residential. He added that there would be a net number of
3 25 employees for the 4.57acre with a total of 50 clients.

5 Mr. Baker concluded his comments by recommending that the Commission find the
6 project consistent with the 2000,Airp6rt•Land Use Compatibility Plan, and based on
7 the following findings:

26 B. The clients'of.the rehabilitation facility will be adults that will not be have any
27 ambulatory or.physical�impairment. The use would�be'a quasi -institutional use
28but itis riot srinilar to Hospitals and care` homes 'and therefore it can be found
29 _ comp tible with the airport operations.

31 Chair Wallrich opened the hearing to public comments.

33 Mr ,Larry Wall, Chair of The Salvation Army 'Advisory Board, addressed the .
34 Commission and provided some additional information on the project. He explained
35 thathe 53,000 square`foot structure would house a warehouse and distribution center
36 that would occupy 75%, of the total square footage. Mr. Wall stated that the residential '
' 37 treatment center and- administrative offices would occupy the remainder of the space.
38 He added the residential treatment center would be located in the center of building..

9 40 Chair Wallrich asked,Mr: Wall -that there are two separate, buildings with a path in
41 between the two_.

43 Mr. Wall responded . that: The Salvation Army would occupy the southern most
44 building. He added that another party owns the'other building:

1 Mr. Wall, added that adults would occupy the warehouse as employees of the
2 warehouse and distribution center while enrolled in the 6 -month program for each
3- individual:

16 Mr. Kim Seidler explained that the City;of,Chi ons'continuing to work on a resolution
17 for the Webb property project located-north°of Eaton',Road.

20 Ispeeificallyy in regard to this property If appears the worst situation is the further east
21 yo Jproceed�on �tlus property. A t w'e'' would propose at this point is• to list this
22 4 property in our GeneralrPlan asrd special, development area. We would require special
23policygto .. and ensure uses are -consistent :with the ALUCP.

33 Commissioner Grierson -stated that from' this picture you can see the routing goes
34 .r including the traffic patterns for the larger., aircrafts as'well as lighter . You can see
35 where the Greg Webb property is and is pretty well crossed through a couple different
36 flight paths `As discussed previously; The, aircraft that are in a traffic pattern at this
37 time at 13 right ; they can easily can get into a, stall spin situation. it is a challenging
38 environment:

43 Chair Wallrich stated that'ALUC,still has�to.examine our purpose. 'It is still looked
44 upon as a safety issue. _

I . Commissioner Rosene added that he would, like to find a compromise that would
2 work. I can't vote for 500,units,of housing at 300 feet under aircraft; it's too close for
3 me. I wish we could make it work at a different way. It doesn't mean that I don't
4 think we can't make - something work against the east corner but taking half or it ' in
5 housing especially with the density of housing is just a problem I want Kim to know
6 that and he going to go back and work on what he needs to do and he need to know
7 what to expect from us..

9. Chair Wallrich reiterated his concern about safety;; and also understand the need to add
10 additional Housing that'this project proposes. :
12 Commissioner Rosene suggested that perhaps if'another -office design to a make a
13 more fire or impaci resistant structures. That .would

28 Mr. Seidler `'responded' that the idea, and would be open to ALUC comments,

30 development of the Webb property. '

32 Vice Chair Harp asked the Commissioner if wider streets could be a consideration for

35 Commissioner Rosene responded that Vice Chair Harp, ' su suggestion was a good one.

36 He also added ; from his' previous discussion. to -look into different construction
37 techniques of impact resistant roofs'for the homes.

39 Chair Walliich added that r the purpose is to bring the general plan in with the
40 conformanace with the CLUP. Using this PMU is one concept. This is a, 'what if '
41 concept. He added that isn't the question that

43 Mr. Seidler stated on residential use on the western end is acceptable and is something
44 ALUC would view as consistent as long as the other requirements are met.

-Mr.s Seidler stated that what is proposed today is the overall land use is residential on
the west side and offices on the east side and a commercial. center somewhere on
Eaton Road. The zoning would not allow, any development through the PMU•process
.without going the plan development or a specific plan. .

Chair Wallrich'a�ked�Mr. Seidler for an update on where the matter stands at this time
with the! City of Chico
Mr'. Seidler replied'.that it did not go' through to counsel but did et ' a favorably
-!esponse"from the internal, affairs committee. It going to forward from internal affairs
}'orirthe next' council meeting with a recommendation for initaitn it and we will have to

ake it through the process then. But I already have an ordinance drawn up. We'll
just introduce it and then adopt it the following council meeting after that going to
t effect 30 days afterwards. He added:that he wad 6onfrdent that it would be approved:

Mr. Baker stated that he -spoke to County -Counsel and that the lawsuit is currently in
the Appeals Court process.
