Thanks you for your' letter regarding the status of the County's review of the above
referenced plan
Our Department has contracted with Environmental Science Associates, Inc. (ESA) to
conduct the review required by state law. We will be advising the Airport Land Use
Commission of our progress in the near future.
'Thanks you :also for your invitation'to'comment on potential amendments to the current
plan. We will, as you note, direct our'suggestions to your office.

This letter will respond to your 12/5/01 letter to Tony Baptiste, in which you requested an update on
progress made by the City in achieving General Plan and zoning consistency with the Airport Land
Use Compatibility Plan (ALUCP).
The City is. currently drafting a General Plan amendment and anew zoning overlay district that will
incorporate the great majority of the provisions of the ALUCP. I anticipate that we will be bringing
several issues, including the ALUCP's infill policy, back to the ALUC for further discussion and
• possible resolution that will eliminate any need for the adoption of overruling findings by the City,
and I truly hope that this will be the outcome.
In the meantime, until the City adopts the General Plan and zoning amendments and, achieves
consistency with the ALUCP (or overrules if necessary), we are forwarding for ALUC review those
major land use actions listed in the ALUCP, including rezonings and tentative subdivision maps
(except for those maps that involve property lying within the D compatibity zone, if the maps are
otherwise consistent with the ALUCP). We are not sending for ALUC review those minor projects
that are clearly consistent with the ALUCP. If any adjustment in this practice is necessary at this
point to satisfy the requirements of ALUC, please let me know.
In a month or so, I expect to be in a position to provide you with a significantly greater level of
detail, both concerning the work City staff is currently engaged in regarding the ALUCP, and also
with regard to the Commission's offer to review the ALUCP for potential modifications. I will
certainly keep you informed, and anticipate formally involving ALUC in a discussion of the City's
proposals before we initiate our own City adoption process.

to Section 1.5.2 Other Land Use Actions.Subject to ALUC Review. The following text shows the
new wording for the section, the new language is shown in bold italics, deleted portions are
shown in s*kRt:
In addition to the above types of land use actions for which ALUC review is mandatory, other
types of land use actions are subject to review under the following circumstances:
(a) Until such time as (1) the Commission finds that a local agency's general plan or specific
plan is consistent with the Airport Land Use Compatibility Plan (ALUCP), or (2) the local
agency has overruled the Commission's determination of inconsistency, state law requires
the local agency to refer all actions, regulations, and permits involving land within an airport
influence area to the Commission for review;
(Public Utilities Code 21676 (b)). Only those actions which the ALUC elects not to review
are exempt from this requirement. Commission. policy is that only the major land use
actions listed in Policy 1.5.3 shall be submitted for review in an ALUC public hearing. A
non -major land use action shall initially be reviewed by the ALUC Secretary/staff. If
such action is found to be consistent with the AL UCP, the ALUC Secretary/staff shall
inform the referring agency. If such action is found to be inconsistent, the action shall be
submitted by the ALUC Secretary for review in' an ALUC public hearing. All actions
referred by a local agency must be submitted with the Butte County ALUC Referral Form
and any applicable review fee as established by the ALUC. If a non -major land use

conformity with the ALUCP or adopted an override, all discretionary projects within an airport
area of influence must be submitted for review along with an application and fee. The application
fee will be refunded if the project is found to be consistent and does not need to go to an ALUC
