Commissioner Davis said he wanted to help staff. 'He discussed the use of BCAG funds. The discussion was continued to February 13, 1991. 2. Review - Tentative Subdivision Map, Cameron AP 042-160-060, conformance with Ranchaero Airport Land Use Plan. Staff submitted the report for the record. Staff said this proposal will create one additional lot. Chairman Walter said the property is zoned A -SR and this will permit a lot split if approved. He said it would also allow a larger parcel to be split into three parcels at a later date. Commissioner Davis asked if this TPM would require an avigation easement? Staff said there is nothing in the law to require an easement. Staff said the requirement for an avigation easement will, however, be a mitigation measure of the parcel map. Staff said with a private airport, the Commission can not require an easement, but can point out the dangers if'one is not granted. Chairman Walter said this property abuts the Greenline. He said he took a look at this property as it relates to planes, taking off from the airport. He said the property is still in the approach area. He discussed the orchards and other small parcels in the area. The hearing was opened to the public. Ray Rolls, from Rolls, Anderson & Rolls, was there to answer questions. 4 M ti. BUTTE COUNTY AIRPORT LAND USE COMMISSION MINUTES - January 9, 1991 Commissioner Davis asked if there will be an agreement to annex to the City and hook up to sewer? Mr. Rolls said yes. Commissioner Davis asked if the applicant would object to granting an avigation easement? Mr. Rolls said this would be acceptable with the applicant. Staff explained that an avigation easement is a disclosure to let people know there is an airport in the area. The hearing was closed. Commissioner Stevens said she would have to vote against this proposal because ,of where it sits in relation to the airport and because it is within the approach zone. ' Commissioner Lambert noted the larger parcels to the north that are not developed. She did not want to seta precedent with this map. ; Commissioner Stevens said if this is approved, other development will encroach on the airport. Chairman Walter said this will continue to cause a domino effect. He asked where does the Commission draw the line?, Be said the Commission should adhere to the Airport Land Use Plan. He said he could not support this request. He briefly discussed the effects of development on airports. Commissioner Rossas said what bothers him is that the size of the lots proposed are too small for the density the Commission wants to have in this area. He said there are two homes on two parcels now whether the property is. split or not. Commissioner Lambert said the Commission should discuss what zone is appropriate for the entire area. She said if the Commission wants 1/2 acre parcels, the area should be zoned for 1/2 acre parcels. Commissioner Davis asked what happens with a motion to deny? Staff said the project will go to the Advisory Agency and continue through the process. Staff said the Advisory. Agency will have to make the finding that 2 additional homes will not increase the density. Commissioner Stevens did not want development in the area at all. Commissioner Lambert said she would support a motion for denial. She said she wants to look at this whole area for rezoning. It was moved 'by Commissioner Stevens, seconded by Commissioner Crotts, and unanimously carried for denial finding that AP 042-160-060 does not conform with the policies of the Ranchaero Airport Land Use Plan because it would further increase the population density under the northern approach and departure zone and further increase the noise and safety hazards in that zone. Chairman Walter explained to the applicant the rest of the procedures and the appeal process. Commissioner Lambert asked that the consideration of rezoning be put on the next ALUC agenda. Staff said they would have the maps together at the next meeting. Commissioner Lambert said her map shows the recently approved SR -1/2 zoning, but it also needs to show the recently approved A-5 zoning.. Inter -Departmental Memorandum TO: Airport Land Use Commission FROM: Planni SUBJECT: Review of Tentative .Subdivision Map for Reuel Cameron, AP 042-160-060 for Conformance with Ranchaero Airport Land Use Plan. DATE: January 2, 1991 The above referenced project is located on the northeast corner of Glenwood Avenue and Cameron Lane, approximately 330 feet north, of West Sacramento Avenue and 0.83 miles north of Ranchaero Airport runway. The project site is located within the approach zone designated within the Ranchaero Airport Land Use Plan. Review of this Tentative Subdivision Map is necessary because the policies of the Ranchaero Airport Land Use Plan indicate that single-family dwellings, as permitted by the zone, are appropriate in the approach zone only when the population density is not more than one single-family residence per five acres within one mile of the runway end. Higher densities may be found in conformity when the Airport Land Use Commission makes a finding of conformity with the Plan. The Commission has the ability to approve residential densities in excess of one dwelling unit per five acres. The Airport Land Use Commission has approved similar densities as those proposed by this current project on several occasions. Existing parcels of approximately the size being proposed are located between the project site and the airport runway. A finding that this tentative subdivision map and its resulting densities is in conformity with the Airport Land Use Plan for Ranchaero Airport would be consistent with previous restrictions taken for the Silver Tree Subdivision and the Park Place Subdivision. Recommendation: Find that the proposed division for Reuel Cameron conforms to the policies of the Ranchaero Airport Land Use Plan, finding that approval of .the project would not be detrimental to the policies of the Ranchaero Airport Land Use Plan, and that the property is surrounded by similar development.
