County Airport'
Land Use Commission found that the Heliport
is outside the
Airport. area of influence, that there is no
conflict, and
recommended that the City of Oroville approve the operation
of the Heliport.

Commissioner Feiler felt he should have something by the next meeting.
Commissioner Lando stated that it might take longer to get the noise
contours done.
This item was put on the April agenda for a draft to be brought
forward for review.

Staff requested April 15, 1985 instead of April 8, 1985 for the next
ALUC meeting due to a conflict with the Planning staff.
This met with the approval of the commission.
********
Discussion on time line for Environs Plan on Paradise Airport Land Use
Plan. Staff stated that there would be a 30 day review period for
comments on the EIR, time was needed tb write the EIR and this would
probably have to be sent out to a consultant to write due to work load
on the staff.
Chairman Behunin wanted staff to brief the committee on April 15 as to
the status of funds and dispense date.

Staff stated that this item is at the final stages of its hearings, it
has had the use permit approved by the City of Oroville and at this
point all ALUC needs to do is to find it in conformity with the '
Airport plans that they have and the areas outside the area of
influence of the proposed Oroville Plan. Staff felt that they could
find this in conformity. They also need to make a finding that it is
not within 1000 ft. of any school with grades Kindergarten through 12
and it is not.
Chairman Behunin asked if staff was saying that they had to find it in
conformity with the General Plan.
Staff stated no with the Oroville Airport Land Use Plan as proposed
because this is outside the area of influence and should be no
problem.
It was moved by Commissioner Lando, seconded by Commissioner
Montgomery, and unanimously carried to find that the Heliport is
{]outside the Airport area of influence and that there is no conflict
and recommend that the City of Oroville approve the operation of the
Heliport.

grant.-a.variance to Thurman C. Clark to utilized the building a 1724 Robinson
Street for an auto repair/smog inspection shop finding that:
1. There are exceptional and extraordinary circumstances or conditions applying
to the building and the fo:-mer uses of the building that do not generally apply to
other buildings and uses in the same district.
2. Granting of such variance will not adversely affect the General Plan of the City
of -Oroville.
3. Such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone denied to
the property in question.
4. The 372nr.ing of ouch variance will nor be materially detrimental to the nublic.

The varian-ce was conditioned as follows:
1. All work shall be conducted within the building. Any Darts (new, used Or junked)
shall be stored within an enclosed structure.
2:' No vehicles in a state of disrepair shall be stored, outside the building. Other
vehicles in for repair shall not be stored outdoors in excess of 72 hou-s.
(NOTE: The Butte County Superintendent of Schools will retain the use of the
parking spaces on the west side of the building for school vehicles.)
3. Weed the landscaped areas and maintain routinely.
4. Remove weeds from the parking areas and maintain routinely.

are met and the following conditions implemented:
1. Construction, operation, and maintenance of the heliport shall be in
strict compliance with all requirements of the California State Depart-
ment of Transportation Division of Aeronautics and the Federal Aviation
Administration.
2. 'hen issued, the City of Oroville Public Works Department shall be provided
with copies of the Department of Transportation site approval per -mit and
heliport permit.

other law enforcement agencies has determined the need to establish an official

finding that the proposed heliport will not adversely affect the General Plan
of the City of Oroville if applicable federal, state and local requirements
are met and the following conditions implemented:
1. Construction, operation, and maintenance of the heliport shall be in
strict compliance with all requirements of the California State Depart -
went of Transportation Division of Aeronautics and the Federal Aviation
Administration.
2, When issued, the City of Oroville Public Works Department shall be provided
with copies of the Department of Transportation site approval permit and
heliport permit.
3. Construction plans shall be submitted to the City of Oroville Development
Review Board for approval prior.to construction.
4. When development occurs within the landing and departure zone, a new zone
shall be designated. The new zone, when needed, will provide a landing
and departure path northwesterly from the site over the Thermalito Power
Canal and State Highway 70.

The attached application and exhibits explains in detail the rea-
sons for the.proposed heliport. Staff has no further comments.
RECOMiENDATIONS:
A. Finding that the proposed heliport will not have a significant
effect on the environment if applicable federal, state and
local requirements pertaining to heliports and heliport oper-
ations are met, approve a Negative Declaration of Environmental
Impact subject to implementation of these requirements.
B. Finding that the proposed heliport will not adversely affect
the General Plan of the City of Oroville if applicable federal,
state and local requirements are met, approve a use permit
for the Butte County Sheriff's Department subject to the
following conditions:
1. Construction, operation, and maintenance of the heliport

at the Butte County Sheriff's Office is necessary to insure a fast
reaction time in emergency situations and search and rescue operations.
The heliport is additionally necessary for the transportation of
eo,,:ipment and personnel during ongoing investigations as well as
emergencies.
The proposed heliport under consideration is for private use only,
meaning that helicopters other than law enforcement operated heli-
copters must have prior permission from the Sheriff of Butte County or
his designee to land.
All heliports in California are required to have a heliport permit

As defined by the F.A.A., a heliport is an area of land, water, or
structure used or intended to be used for the landing and takeoff of
helicopters.
Prior to any agency submitting an application to the Department of
Transoortation to operate a new heliport, the provisions of Section
21661.5 of -the Public Utilities Code (P.U.C.) m.:st be complied with.
Section 21661.5 of the P.U.C. states that in order to apply for a
permit to operate a heliport, the following information must be
submitted to the Department of Transportation, Division o_7 Aerona.UZics;
1. Documented approval, by the Board of Supervisors and/or
the City Council, the plan to construct a heliport per
Section 21661.5 of the P.U.C.
2. vocal land use approval.
3. Confirmation of action by the Airport Land Use
Commission.
4. Compliance with the California Environmental Quality
Act. (1970) .
5. Documents establishing ownership or control of property.
6. Airspace utilization clearance by the F.A.A.
7. Topographical map showing proposed heliport site, out-
wardsfor a radius of two (2) miles depicting public
utilities, schools, churches, railroads, highways, etc.
8. Scaled layout plans of the facility.
I..hen all the above requirements have been complied with and submitted
to the Department of Transportation, a sit- approval permit is issued.
Loon completion of the facility, an inspection is made and if appro,,•ed,
a heliport permit is issued.

In proposing to establish a heliport at the Butte Co-;:nty Sheriff's
Office, it is recognized that the arrival and departure of helicopters
will create some noise, however, it is believed that the low level of
activity planned along the proposed -landing and depart•.�re path will
render this impact negligible.

RESOLUTION OF INTENTION TO APPLY FOR APPLICATION TO
ESTABLISH HELIPORT AT THE BUTTE COUNTY GOVERI4MENT CENTER,
OROVILLE, CALIFORNIA
WHEREAS, the Butte County Sheriff's Department in cooperation with
other law enforcement agencies has determined the need to establish an official
heliport; and
WHEREAS, the Department of Transportation Division of Aeronautics, -
Sacramento requires the Board's expression of intention to•apply; and
WHEREAS, the Butte County Board of Supervisors designates the Butte
County 1!heriff or his designee to proceed with the requirements set forth by
the -Department of Transportation.
Klv!, THEREFORE, BE IT RESOLVED that the Butte County Sheriff, on
behalf of the Butte County,Board of Supervisors, will proceed with application
for establishment of a Butte County Heliport located at the Butte County
Government Center, Oroville, California.
