Dear Mr. and Ms. LaFever: . r Thank you for submitting the 1991, 1992, and 1993 Mining Operation Reports, required by Public Resources Code (PRC) Section 2207, for the above -referenced mining operation. Since June, 1993, you have received -notice from this office of the requirements.of reporting under the Surface Mining and Reclamation Act (SMARA). Our letters stated that failure to submit the required reports and fees within 30 days of your receipt of the letters may result in late fees and interest. PRC Section 2207(d) states that any fees and reports received after July 1 shall be subject to a late fee of $100 or 10 percent of the reporting fee, whichever is greater, and an interest charge of 11-� percent per month of the amount due. Below is a breakdown of the fees now due: Year Reporting Fees Late Fees Interest 1991 700.00 100.00 408.00 1992 800.00 100.00 297.00 1993 800.00 10.0.00 135.00 " TOTAL 2,300.00 300.00 .$840.00 GRAND TOTAL $3,440.00 As stated in your May 17, 1995, letter, you are having financial difficulties and would like a payment schedule for the next 12 months. In order to avoid administrative penalties and as a measure of your continued good faith, we will need a $300.00 pavment from you by September 1, 1995. The unpaid balance will then be placed on a payment schedule to be paid in full by September 30, 1996. This office will waive the interest penalties if the. reporting fees and late fees for a total of $2,600.00 is paid in full to this office by September 30, 1996. If the unpaid balance is not paid to this office by September 30, 1996, the interest will.not be waived and interest in the amount of $840.00 -plus 11,� percent per month interest increase will be due and payable in ,addition to the remaining balance. Payment Schedule for the 1991, 1992, and 19'93 reporting years: Pay by September 1, 1995 $300.00, Pay by December 31; 1995 .$575.00 Pay by March 31, 1996 $575.00 Pay by June 31, 1996 $575.00 Pay by September 30, 1996 $575.00 Additionally, PRC Section 2207 requires specific information - to be submitted to this office. A.review of your submitted report and the associated mine files indicates the following information is missing: A copy of a "lead agency approved" reclamation plan. Proof of lead agency approval of the reclamation plan. • A copy of the financial assurance mechanism approved by the lead agency. • Proof of•SMARA lead agency approval of the financial assurance. Please be aware that the Department of Conservation's mission is to assist you in your compliance efforts. At the same time, please bear in mind the ramifications of noncompliance.` - Not filing the required -information and fees can result in administrative penalties up to $5,000 per day.
