CALL TO ORDER 7 8 The meeting was called to order at 3:10 p.m. by Chair Neil McCabe at the Klamath Conference 9 Room, 202 Mira Loma Drive, Oroville, California. 10 11 2. APPROVAL OF MEETING:MINUTES OF MARCH 10, 2004 27 28 A motion was made -by Dee `Hunter, seconded by Don Litton and unanimously carried to 29 approve the meefing minutes -of March -l0, 2004. 30 31 4. ABANDONED VEHICLE ABATEMENT (AVA) REPORT FROM "STAFF TO CODE 32 ENFORCEMENT ADVISORY BOARD 33 - 34 Yvonne Christopher provided a status report on AVA tow activity, private property towing, 35 AVA restitution, Butte County code revisions, and code enforcement officer training. 36 37 In summary, the tow activity has been concentrated on public roadways with over 300 vehicles 38 towed to date (approximately 100 in the quarter ending December 31 and approximately 200 39 during the January -March quarter) for Butte County with unanticipated issues related to towing 40 travel trailers. The towing of vehicles on private property has not yet begun but will follow at 41 a later time. The City of Chico has not towed any vehicles under the AVA program. The 42 Butte County code revisions were approved by the Board of Supervisors and are currently in 43 effect to allow Code Enforcement officers to be appraisal officers with their training to follow 44 as soon as possible. The other code change approved was the 7 -day parking limitation. The 45 County has just received a disbursement of $27,000 from the state for AVA funding,, and there 46 has been money received for AVA restitution by paid fines for the cost of abating vehicles. Butte County Department of Development Services ■ 7 County Center Drive ■ Oroville, CA ■ (530) 538-7604 Pagel of 4 I Michael Vieira estimated that of the vehicles towed by the County so far under the AVA 2 program, 60% were from the south county area, 20% from the unincorporated Chico area, and 3 20% from the Stirling City area. 4 5 Action: Chair McCabe requested staff to bring back a report with a breakdown on the types of 6 abated vehicles and a recommendation on whether any changes are required to, the Butte 7 County code to address travel trailer issues. 8 9 Action: Chair McCabe requested staff to add an ongoing agenda items to provide a status 10 report to the CEAB on the number of vehicles abated county -wide and on private property, 11 cost of vehicles towed, nuisance abatement update, and other pertinent information. 12 13 5. CODE ENFORCEMENT ADVISORY BOARD MEMBERS WISHING TO ADDRESS 14 ITEMS NOT LISTED ON THE AGENDA. (THE CODE ENFORCEMENT ADVISORY 15 BOARD IS PROHIBITED BY STATE LAW FROM TAKING ACTION ON ANY ITEM 16 PRESENTED IF IT IS NOT LISTED ON THE AGENDA:) 17 _ 18 There was a brief discussion regarding the-ifencing standards and Yvonne Christopher 19 responded that it has not been addressed as yet.: _ 20 _ 21 Steve Rodowick from Butte County Public Works „(PW) Department was asked to address 22 illegal dump sites. Mr. Rodowick explained that PubfcsWorks and the Solid Waste Advisory 23 Board is currently seeking approval to:�createa_code enforcement officer position to track 24 illegal dump sites. The department is -also--proposing a new ordinance to address illegal 25 dumping and pursue legal aofion:%y takings- administrative approach. MEMBERS OF THE PUBLIC WISHING TO ADDRESS THE CODE ENFORCEMENT 36 ADVISORY BOARD ON ITEMS NOT LISTED ON THE AGENDA. (PRESENTATION 37 WILL BE LIMITED TO FIVE MINUTES. THE CODE ENFORCEMENT ADVISORY 38 BOARD IS PROHIBITED BY STATE LAW FROM TAKING ACTION ON ANY ITEM 39 PRESENTED IF IT IS NOT LISTED ON THE AGENDA.) 40 41 Zane Libert handed out a letter from the Palermo Improvement Association that explained the 42 nuisance abatement concerns as it relates to certain properties located in the Palermo area. Staff present: Yvonne Christopher,`Michael Vieira�.-'and=%Dolores Horn from Butte County Department of Development Services; Rob MacKenzie from Butte County Counsel; Steve Rodowick from Butte County Public Works. - Others present: Madelyn Henry, Cathy Hodges; Howard Martz, Ada Martz, Don Steele, Sharon Townsend, Mary Weston, and Norie J, Wheeler: APPROVAL OF MEETING MINUTES OF DECEMBER 10, 2003 A motion was made by Dee Hunter, seconded by. Don Litton and unanimously carried to approve the meeting minufes of December�10, 2003. There was one abstention by. Ned Kirkham who was not in attendance -at the�ecember 101 2003 meeting. REPORT. ON WARD 'OF SUPERVISORS MEETING OF FEBRUARY, 24, 2004 CONCERNING :PRESENT STATUS OF ABANDONED VEHICLE ABATEMENT PROGRAM _ Yvonne Christopher summarized her report given to the Board of Supervisors. She informed them that the AVA Program was underway, the number of vehicle towed to date, and a. discussion about the nuisance abatement . program. Neil McCabe, presented two code enforcement ordinance changes, and Lieutenant Gillingwater from California Highway Patrol (CHP) spoke in support' of the recommended amendments. She added that Steve Rodowick discussed some of the Public Works current and proposed community clean-up programs Action: Staff was requested to place "AVA Report from Staff' on the next CEAB meeting agenda. Chair McCabe also requested that a representative from the Chico CHP be invited to attend the Code Enforcement Advisory Board meetings. 5. DISCUSSION OF PROPOSED REVISION TO BUTTE COUNTY CODE PROVISION CONCERNING ALLOWABLE SQUARE FEET OF . CONSIDERATION OF IMPOSING FENCING STANDARDS FOR THE STORAGE OF JUNK BEHIND A FENCE Action: Staff was directed to draft, a set of fencing standards for the Code Enforcement . Advisory Board to review at a future meeting. The -standards may include such things as fence height, fence materials, whether the fence is sight -obscuring, whether the fence design should be approved'by the Director of Development Services, and whether the Director's design decision would be subject to appeal. He added there will be advertising-* the Enterprise Record and Gridley Herald newspapers for this community clean-up program.-µ Rob MacKenzie stated the Board of Snp6iVisoxs.,had formed a solid waste. subcommittee to address illegal dumping in the county. AVA Board on AVA tow activity, private 35 property towing, AVA restitution, Butte County code revisions, and CEAB officer training. 36 37 In summary, the tow activity has been concentrated on public roadways with over 300 vehicles 38 towed to date for Butte County with unanticipated issues related to towing travel trailers. The 39 towing of vehicles on private property will follow at a later time. The City of Chico has not 40 towed any vehicles under the AVA program. The Butte County code revisions were approved 41 by the Board of Supervisors and are currently in effect to allow Code Enforcement officers to 42 be appraisal officers with their training to follow as soon as possible. The other code change 43 approved was the 7 -day parking limitation. Box 685, Palermo, CA 95968 June 1, 2004 him 7 Abatement committee/ representatives of Butte County: REF# Nuisance Abatement Process Concerns The Palermo Improvement Association has followed the process for a long time. We have sat through the County Supervisors meetings, discussing the abatement process and a few years ago, we were able to get the Board of Supervisors to designate funds for the Nuisance abatement program in the sum of $50,000 for five years. We have discussed this process and feel that the need to move forward with the nuisance abatement process is critical. The reason why we need this process is because for several years, nuisance .abatement complaints have been issued to propery owners in the Palermo area. Very little has been done by these gross violators to clean their property. One such property owner lives right next to Palermo School. Any given day, one can drive by. and see cars sitting on jacks, transmissions laying on the ground, engines missing and cars sitting on their rims with the hoods missing. Although this property has a large fence, cars are parked in front of the school. Behind the fence of this property, a rather large wrecking yard is visible with well over. forty cars existing in a highly cluttered property full of various car parts. Clearly this property owner has no concern for anyone living near his, property, nor any regard for children who walk past this property to go to school. We would like this committee to move forward with the nuisance abatement process to get these gross violators to clean their property. The safety and health of our citizens and children depend on the process being moved upon. These conditions must not be allowed to exist, gross violators need to correct their problems without any fiirther delays and this committee needs to make sure this happens. The current meeting schedule of every three months would be fine if it goals of moving forward on the nuisance abatement process were being met. They are not being met! In the best interest moving forward with the nuisance abatement process, we suggest your committee meet once a month until the process is well established and nuisance abatement in our community is a reality and not a simple discussion in a committee that lacks action.
