Dear Ms. Cangiano,
The above referenced parcel is zoned R-3 (High Density Residential). As such, most
commercial uses are not allowed, and those that are allowed require approval of a Use
Permit. The Children's Home Society of California office use on the property is a legal,
• pre-existing, non -conforming use. According to Butte County Code, any change or
expansion of a non -conforming use requires approval of a Use Permit.
I initially believed that your proposed use may be'a continuation of the existing use which
would not require a Use Permit. After 'discussing this matter with my supervisor, it was
determined that a Use Permitwould be required for your proposed use. In the R-3 zone,
medical and professional offices are allowed, but require a Use Permit. The County takes
the position that non -conforming uses should be phased out whenever possible and
replaced with an allowed uses. This is the situation with your proposed use.
The processing fee for a Use Permit is currently $1,018. The Use Permit application goes
before the Planning Commission at a public hearing. Unfortunately, there is no guarantee
that a Use Permit for your proposed use would be approved by the Planning Commission.
Enclosed please find an application for a Use Permit. It takes approximately three months
for a Use Permit project to be heard by the Planning Commission, although a shorter time
may be possible.
You may have a good chance of getting the Use Permit approved, through. There may be
a historical use of the property as commercial or professional use. If the building was
constructed as an office structure, or has been structurally altered to accommodate an
office use, this may point out to the Planning Commission that a professional office use
should be allowed.

• portion has recently vacated the premesis, however, the costume shop is still open for business.
Both had people coming to the location for business.

Your office at 1216 Sheridan Ave. is located in a R-3 (High Density Residential) zoning district. Any

use. Any expansion of that use would require a Use Permit. Operating the Little Papoose Costume
Shop out of your office at 1216 Sheridan Ave. would be considered an expansion, and as such a Use
Permit would be required.
The current cost of applying for a Use Permit is $1,288.00, and takes approximately two months to
process. Of the $1,288.00, $1,000.00 is a deposit that is used up on a time and material basis.. The
Butte County Board of Supervisors is the only body that can waive application fees, and I suggest
you contact Mary Anne Houx (891-2800), who is the Supervisor for your area, for further
information regarding the waiving of application fees. One other option that you may what to explore
is to find a retail store that will share or lease some of their space to you.

Little Papoose Costume Shop is a non-profit fundraising auxiliary of Children's Home
Society of California. The shop.has been housed in the downtown area since it first
opened in 1967. It is completely run and operated by a CHS auxiliary comprised of a
small group of volunteers, some who have been volunteering since the shop first opened.
Presently the shop is open three afternoons a week, ten months a year and five days a
week during the month of October.
Because costume rental is seasonal, the volunteers have found that the only month they
is make a profit is October. They remain open the other ten months, just making enough to
cover their rent and utilities. Finding enough volunteers to keep the shop open during the
slow months has become very difficult.
The Costume Shop volunteers have talked about closing but feel a great commitment, not
only to fundraising for Children's Home Society but to the service they provide for the
community. Many schools and community groups rent costumes for plays and events
from the Costume Shop because they offer a large selection of costumes at reasonable
prices.
Our CHS office is at 1216 Sheridan Avenue, where it has been located since 1962. Due to
considerable downsizing of our staff in recent years, we find ourselves with extra room in
our building. I would like to see the auxiliary move from its present location into a
portion of our CHS office building, occupying approximately 480 square feet. They
would be open only during the Halloween season, approximately 35 days. The rest of the
year they would be closed and rent costumes by appointment only, or perhaps be open
one afternoon a week. It would not be considered a retail shop; but a fundraiser for our
agency. I don't feel that having them at the Sheridan Avenue location would impact the
area in any way, it would just be an ancillary part of our current operation.

In light of our telephone conversation last week, the Butte County Planning Division has again
reviewed the proposed subdivision and has the following comments:
The proposed site is adjacent to agriculturally zoned land within the County on both the west and
• south side. The existing farming practices associated with kiwis are generally compatible with
residential uses, especially when buffered by a roadway. However, crops may change and other
issues such as noise, dust, as trespass are still concerns. It should be recognized that land use
conflicts between existing agricultural uses and the proposed low density residential subdivision,
can occur.
The site is designated Medium Density Residential and adjoins Low Density Residential to the
west and Agricultural Residential to the south. The site is also within the Gridley Urban Reserve
which require the extension of City services for development. Because the policies of the Butte
County Agricultural. Element to reduce urban/ag interface conflicts apply only to the Orchard and
Field Crop designation, this project is not bound to them. However, the City may wish to consider.
incorporating some type of project features or mitigations to address potential land use conflicts.
Other issues this Division has a concern with are providing adequate drainage retention and
collection of adequate impact fees to address impacts to public services.

The Butte County planning Division has reviewed the proposed subdivision and has the following
comments:
The proposed site is adjacent to agriculturally zoned land within the County on both the west and
south side. The existing farming practices associated with kiwis may be less offensive to
residential uses but crops may change and other issues such as noise, dust, as trespass are also
concerns. The Butte County Agricultural Element requires a buffer between urban and
agricultural uses. Policy 2.1 and 2.3 support this position.
Policy 2.1 "Agriculture shall not be made inviable by the economic impacts of urban
development."
Policy 2.3 "Require development to provide land use transitions, setbacks, and buffers
between urban development and agricultural interface to reduce interference and conflict."
Typically, the recommended buffer is 300' which is to be located on the development parcel. In
this instance, the buffer distance might be reduced because a road separates the properties. The
Butte County Agricultural Commissioner's office should be contacted for an appropriate buffer
recommendation.
Other issues this Division has a concern with are providing adequate drainage retention and
collection of adequate impact fees to address impacts to public services.

CITY OF GRIDLEY RICHINS SUBDIVISION PROJECT

PROJECT DESCRIPTION
Subdivision of a 16 acre site into 60 to 70 new building lots. Community Development.
Block Grant funds have been awarded to _acquire the site, and to underground a very large,
deep, open drainage ditch on the north boundary of the site. No subdivision map has been
submitted yet; however environmental review of the project must be conducted prior to
expenditure of the grant funds for acquisition of the site.
Approvals required for the project are as follows:
1. Annexation of the site to the City of Gridley. The site is within the City's Sphere of Influence.
2. General Plan Amendment to modify, the City's current General Plan Land Use Designation
from Suburban -Residential (3 units/acre maximum density) to Low Density Residential (4
units/acre maximum density) or Medium Density Residential (8 units/acre maximum
density) if more than 64 units are proposed.
NOTE: the current Butte County General Plan Land Use Designation for the site is
Medium Density Residential (8 units/acre maximum density)..
3. Prezone Amendment to modify the City's current prezoning from Agricultural -Residential
("AR -5, 1 unit/5 acre maximum density) to Single Family Residential ("R-1," 4 units/acre,
which allows up to 64 units on the site) or Planned Development ("PD," with a stipulated
maximum of 70 units, which is 4.4 units/acre).
NOTE: Butte County's current zoning designation is "SR -1," which is' Suburban
Residential, 1 -acre minimum lot size.
4. Tentative Subdivision Map for the site,. with a design that provides for stormwater detention
facilities and perhaps a new well -site.
5. Use Permit, if PD zoning is requested to allow up to 70 new homes, instead of the 64 that
would be allowed with R-1 zoning.
Off-site public improvements associated with the project will be as follows:
• Drainage: the large, open drainage ditch on the north border of the site will have to be
undergrounded with 84 -inch pipe and a culvert for a road crossing at Georgia Street. The
smaller open ditch on the west border of the site must also be undergrounded.

NOTE: On site stormwater detention facilities will be constructed to maintain the present
stormwater discharge rate from the site during a 100 -year design storm, thus eliminating
the need for additional off-site drainage improvements. .
Sanitary Sewer: about 1200 feet of new gravity sanitary line must be constructed on Little
Avenue, from a lift station located at the intersection of Oregon Street and Little Avenue
westward to the approximate middle of the Richins site. - . .
Water: a new municipal well will be needed if the City of Gridley is to serve new development
west of the railroad tracks. The new well should have the capacity to serve about 400
homes; it could be located on the Richins site or virtually anywhere west of the railroad
tracks. Construction of a new well could precede the Richins project, or be constructed
concurrently with it.
Streets: the site has about 1150 feet of.frontage on.Little Avenue and-about:650 feet, of
i
frontage' on Randolph_Ayenue. Additional. right-of-way will be obtained along the
'frontage portion of the project site, and the frontage portions .will;be,reconstructed to
provide a full twenty -foot paved half -width adjacent to the site, and a I'Moot paved travel
.lane and 4 -foot shoulder on the opposite. half. Standard street improvements will be •
constructed;in the presently unimproved 110 -foot portion of Idaho and Georgia Streets
located north of the site, after which Bayberry Street and Little Avenue will be connect at
those two locations (note the location of the existing streets on the attached site map).
LOCATION:
The 16 -acre project site is in Butte'County, about one-half mile west of State Highway 99 in the
southwest Gridley area. It lies north of Little, Avenue and extends from Randolph Avenue to
Idaho Street. It is presently under the jurisdiction of Butte County, but it is within Gridley's
Sphere of Influence and it is adjacent to the southwest edge of Gridley City Limits (see attached
illustration).
ENVIRONMENTAL SETTING:
Existing use of project site:
The 16 -acre project site has been in agricultural.use for many. decades., Existing,structures include
three residences, at least one barn, and several smaller agricultural -related buildings. All of the
existing structures appear to.be.in substantial disrepair r

Existing developed use of surrounding properties:
North: Subdivided about 1977, with homes to a density of about 4 units/acre (in City)
East: Subdivided about 1988, with homes to a density of about.4 units/acre (in City)
South: east of Dewsnup Avenue, about 7 homes; five' of them on urban -size lots (in °County)
west of Dewsnup Avenue, a 16 -acre orchard (in County)
West: A 7.5 -acre orchard with one home (in County)
Agricultural uses:
Project site: Prune orchard, with walnuts along the boundaries of the site. An official at the local
agricultural servrceindicates-that rnany of the;trees have reverted `t'o root `stock; the top of
the trees are gone :and suckers have grown from the lower trunk `No a griculturalapray
permit has-b'eeii'issued-for several'years.; '
South oftittle "arid west of Dewsnup: peaches are planted on both sides of a 20046otwide strip
in the' center of th_ is .16 -acre site. A house islocated on the central strip. An official at the
local agricultural service indicates that the peaches have been actively harvested for years,
although restrictions have applied to aerial application of spray on the site for many years
because of the existing residential uses around it. Evidently there is relatively little need
for aerial spraying in peach orchards. A relatively small part of this site is adjacent to the
Richins site (about 300 out of 1300 feet roadway frontage of this orchard).
West of Ra7dolph: kiwis are'planted on'this'7:5 acre'site, which also includes one home. An
official at the local agricultural service indicates that kiwis require little aerial spraying or
disking, and therefore these types of orchards and residential uses are relatively compatible
with one another.
Soils and agricultural designations' Designations on the 1926 U.S. Department of Agricultural
Soil Survey Map and on the 1992 Butte County Interim Farmland Map, prepared by the
California Department of Conservation, are as follows:

Other areas: Gridley clay loam where mapped; designated urban or "X," which means land which
does not meet the criteria of any other category.
Flora and Fauna: The existing use of immediately adjacent properties is described under the
headings titled '.'existing developed use of surrounding properties" and "agricultural use," above.
A subdivision is located on the north edge of the larger open drainage ditch on the north boundary
of the project site, and the upstream portion of the ditch (east of the project site) lies between two
subdivisions and has already been undergrounded. Urban -sized lots already line the south side of
Little Avenue, and most of the remaining orchards have at least one house on them. The flora and
fauna in the area is typical of•the half -mile or more deep suburban residential / ranchette area that
rings most of the City of Gridley.
The -'open drainage ditches on the north and west boundaries of the site will be undergrounded
when the, site is develop ed -to -residential uses-, These ditches have been modified.periodically over
the years.. In _1996; the upstream portion of this ditch (east of the site) was finally' undergrounded.
In 198.7, the ditch on the north boundary of the Richins site was widened and regraded -when the
new subdivision was constructed east of the site. •
Drainage: The site is tributary to Reclamation District No. 833's Lateral E -1-A. - Stormwater
discharged from the site must travel through 12 or more miles of open, vegetated ditches
constructed and maintained by RD 833 before combining with flows from the Cherokee Canal
(these waters eventually enter Butte Creek about 5 miles south of the confluence of RD 833's
ditches and the Cherokee Canal). The trustees of RD 833 have advised the City that their ditches
have no capacity for increased flows, and that new development must not generate a peak
stormwater discharge -rate higher -than the historic rate during a one -hundred year design storm -
event. The City anticipates that LAFCo will condition annexation of the site upon meeting this
criteria, which will undoobtedly be accomplished by construction of an on-site stormwater
detention facility or facilities.
The open drainage ditches on the north and west boundaries of the site will be undergrounded
when the site is developed to residential uses. These ditches have been modified periodically over
the years. In 1996, the upstream portion of this ditch (east of the site) was finally undergrounded.
In 1987, the ditch on the north boundary of the Richins site was widened and regraded when the
new subdivision was constructed east of the site.

Traffic circulation: The site is bordered by two' narrow County roads, Randolph and Little
Avenues. The frontage portion of the roads will be improved as described under the heading
"project description: offsite improvements," above. Because of Gridley's lot frontage
requirements, no more than 10 lots will have direct access to Little Avenue, and no more than 5
lots will have direct access to Randolph Avenue. For both of these substandard roads,
dedications and improvement requirements will assure that it is possible to back out of the new
lots without entering the travel lanes. It is also possible to require that circular driveways be"
constructed on homes with access to these streets, as an additional safety measure.
A 24-hour traffic count was taken on Little Avenue on Wednesday, December 4, 1996. The total
count west of the Vermont Street intersection was 1810 vehicles. The total count east of the
French Avenue intersection was 1410 vehicles.
The site will also be accessible from Georgia and Idaho Streets (see "project description: offsite
improvements;'.': above)-:.. - Scarlet Oak and-Para"d'ox"Drives*will,be'extended from t$e=e'astthrough

Historic significance: The potential archaeological significance of the site and the area around it
has been diminished by years of farming operations.
SOURCE OF FUNDING:
The City has been awarded' State Community Development Block Grant funding to pay for the
cost of acquiring the site; and a portion of the cost to "underground the opet drainage difch:on the
north boundary of the site. `

• Due to the recent controversy surrounding the proposed relocation of your tire recycling
facility to 6250 Custer Lane, this Department. wants to ensure that you understand the
zoning and land use provisions applicable to your proposed site. The subject property is
zoned M-1. Applicable uses are presented in Section 24-175 of the Butte County Code.
The code section is attached to this letter. Pertinent sections in the attached code section
have been emphasized using bold text. The terms minor and major waste tire facility
reflects the definition utilized by the California Integrated Waste Management Board. The
M-1 zone permits a minor waste tire facility without a Use Permit unless a determination
has been made by the Director of Development Services pursuant to section C 4.
Minor waste tire facilities were included as a permitted use in this, zone because
regulations required by the State addressed minimum public safety concerns. Operating
under an exemption from the permitting requirements of the State, the County can not be
assured that safety concerns can be met or enforced. Based upon the operating
characteristics of your use and the existing surrounding residential uses, it is the
determination of this Department that a Use Permit is required to operate at this location.
This determination is based on the potential of the proposed use to negatively impact
adjoining residents. If you disagree with this finding, you may appeal the decision to the
Board of Supervisors.
Pursuant to the requirements of the Enterprise Zone agreement, the Use Permit
• application must be made to the City of Oroville. The City's Use Permit fee is the
applicable application fee.

SECTION 24-175 M-1 (LIGHT INDUSTRIAL) ZONE
A. Uses permitted:
1. Wholesale and storage warehouses, minor waste tire storage facility, reverse vending
machines, small and large collection recycling facilities.
2. The assembly and storage of goods, materials, liquids and equipment (except the storage of
inflammable matter or explosives or materials which create dust, odors or fumes).
3. Feed storehouses and warehouses and fuel yards.
4. Industrial uses including, but not limited to, the following: the manufacturing, processing,
fabricating, assembling, refining, repairing, packaging and treatment of goods, materials and
products by power (oil, gas or electric), including, by way of example and illustration, but not
limited to, the manufacturing, fabrication and assembling of bathroom shower and patio .
partitions, enclosures and doors, windows and store fronts of aluminum, plastic and fiberglass,
or other suitable material, and the processing, finishing, polishing and anodizing of aluminum
extrusions and castings, assaying, auto repair and auto body shops, boat repair, broom, brush,
and rug manufacturing, die casting, draying, freighting or trucking yards or terminals, heavy
equipment rental or sale, heating and ventilating service shops, jewelry manufacturing, lamp

B. Accessory uses:
Caretaker or night watchman residence accessory to a permitted use listed in A. above.
2. Retail sales in conjunction with and accessory to any of the permitted uses when no more than
25% of the floor space is devoted to sales.
3. Accessory uses and buildings pertinent to any permitted use.
C. Uses requiring Use Permits: The following uses are permitted subject to the securing of a Use Permit
in each case:
Any residential use not accessory to a permitted use listed in A. above.

3. Manufacturing of acids, explosives, fertilizer, glue, gypsum, lime, plaster of pans, pulp and
paper, beet sugar, crushed rock, sand and gravel, cement, concrete and/or asphalt batching

4. Any use listed in Section 24-175 A. above which, because of operational characteristics
specific to the particular business or proposed location, is found by the Director of
• Development Services, to have the potential to negatively impact adjoining properties,
businesses, or residents.. Generally speaking, any M-1 use will probably require a Use
Permit under this Section if the use or structure will be located less than 100' from the
boundary of a zone that allow residential uses.

Lot area and width: There is no lot area minimum :and no lot width minimum except as may
be, required'for the building and for off-street loading area and parking and that area required
to meet the sewage disposal requirements of Chapters 19 and 20 of the Butte County Code.

Minimum Side Yard Required: None, except when the side of a lot abuts upon the side of a
lot that is zoned to allow a residential use, in which case the abutting side yard shall not be
less than twenty-five (25) feet.
3.
Rear yard: None, except where the rear yard abuts a lot that is zoned for to allow a residential
use, in which case the rear yard shall be not less than twenty-five (25) feet.,

4.
Truck loading and unloading space: Private off-street loading space for the handling of all.
goods, materials and equipment shall be provided. Such space shall be of sufficient area and
of such design as to permit the parking and loading of vehicles without extending into any
existing street beyond the curb line.

Off-street parking: The requirements. of Section 24-240 shall apply.

Your parcel is located in a M -R (Mountain or Recreational Subdivision - Residential) zoning district.
One single family dwelling or mobile home per parcel is allowed. Any other dwelling units would
require that a Minor Use Permit be obtained from the County. The Minor Use Permit must be
approved by the Butte County Planning Commission at a public hearing. _
There. -are several standards and conditions of a Minor Use Permit for a permanent second
dwelling unit. Section 24-280 of the Butte County Code lists these standards and conditions. One
of the conditions requires that the owner of the parcel live in one of the two dwelling units.
Another condition limits the size of the second dwelling unit to no more than 1,200 sq. ft.
The current application fee for a Minor Use Permit is $350.00. The application process takes
approximately three months. Please be advised that it is the Planning Commission that approves
a Minor Use Permit, and they could deny it if they determine that the second dwelling unit is not
an appropriate use on your parcel. Also be advised that the Planning Commission is considering
changing the second dwelling unit zoning ordinance and they could very well prohibit second
dwelling units in certain zoning districts. I do not know what changes they are planning on making,
or even when they intend to change it.

Re: Parcel Map on APN 028-100-033 for Michael McCollum
Dear Ms. Helton,
The microfilm was finally returned to us, so I was able to research the proposed parcel
map for the above reference parcel. Mr. McCollum requested four, 5 -acre parcels but the
Planning Department recommended denial of the map because it did not comply with two
provisions of the General Plan. The proposed parcel map was denied by the Butte County
•
-Advisory Agency on April 13, 1992. Mr. McCollum then appealed that decision to the
Board of Supervisors, which denied his appeal on June 23, 1992.
Based on Mr. McCollum's project, I believe that the Planning Department would
recommend denial of a parcel map to divide your 20 -acre. The report dated December 11,
1991 (enclosed) states that the area should be rezoned to a 20 -acre parcel size, though
there are no plans to do so at this time. However, the approving agency may not agree
with that recommendation and could approve the map.. In addition, any decision of
approving agency can be appealed to the Board of Supervisors, just as Mr. McCollum did.

Dear Tom,
Due to the move into our new offices the above referenced application was misplaced. It
wasn't until after our phone conservation today that I realized that I had not returned the
application to you and that it had been misplaced during the move. It is my mistake for
misplacing it and then forgetting about it, and I apologize for my error.
When the Senior Planner reviewed the application when it first came in, he said that.the
size of the parcel did not meet the zoning requirements, which is for a 40 -acre minimum
parcel size. However, he was in error because the parcel size is 60 acres. The .
application did state that the parcel size was 10 acres, but that referred to the size of the
proposed agricultural segregation parcel only.
The Zoning Ordinance, however, states that an agricultural segregation parcel can not be
more than five (5) acres, or the minimum lot area allowed by the County Environmental
Health. Division, whichever is greater (see enclosed copy of the Agricultural Segregation
Zoning, Ordinance). This application is for a ten (10) acre agricultural segregation parcel.
We would not be able to recommend approval to the Planning Commission because of
this, especially considering that • almost half of the proposed parcel is currently
undeveloped. The existing processing plant is very.close to 5 acres and we would most
likely recommend approval for just the existing plant.
Again, I apologize for misplacing the application. If the applicants so desire, I would be
• more than happy to personally apologize to them for my mistake. Please let me know what
the intentions of the applicants are. We still have not deposited the check submitted with
I the application.

I, apologize for taking so long to get back to you regarding this matter. I discussed the
matter with the Senior Planner (Craig Sanders) who stated that one dwelling unit per
parcel is normally acceptable on land zoned TPZ. However, we would require some sort
of documentation showing that the location of the dwelling unit would not significantly
interfere with the growing or harvesting of timber. Basically, the house should be located
in an area that does not have timber potential, such as an area that has been already
extensively logged or an open area. A second dwelling unit is also possible, but normally
it is to be lived in by someone who is working on the property or managing the property,
and should be located in an area that would not impact timber growing or harvesting'. We
would require documentation showing this.

services in the 1990 Census, but I hope the above figures can help you. If you need

have reviewed your letter of February 21, 1997 requesting an opinion on the
appropriateness of the Midway property for a warehouse. The property is zoned M1 (Light
Industrial) and such uses are permitted provided that there operational characteristics do
not negatively impact adjoining properties, businesses or residents. This property shares
a northern and western boundary with properties zoned for residential uses and under
some conditions may require a use permit. }
I am familiar with the operation of Big Valley Ag Services, and it is my understanding that
all materials will be packaged in Gridley and shipped to the Midway location. The
warehousing of materials for distribution in the Chico area is permitted pursuant to Section
24-175(A)(1). It should be clear that this approval only extends to the warehousing of
these products and does not include any manufacturing, mixing, or related processing of
fertilizer products. These uses would require additional review and may require a use
permit.

have attempted to answer you questions, although most of the information you
requested is not available, You requested that we provide you with a map of Butte
County indicating parcel subdivisions. I took this to mean'that you. would like a map
showing all the parcels in the County. Unfortunately, a map showing all the parcels in
the county can not be printed out on a letter -sized sheet of paper. The County can print
out map on a large sheet that shows all of the parcels in Butte County, but the cost of
• this map is approximately $25.00 plus postage. If you would like to purchase this map
please let me know. If you wanted a map showing the location of all the various
subdivisions that have been approved in the county, this information is not available.
Your next request was for the average size of parcel subdivision in Butte County. I took
this to mean you wanted the average size of parcels in the county. Unfortunately, this
information is not available and any information we had would be very misleading
because there are many large parcels and many small parcels. There really is no
"average" parcel size. If you wanted the average size of the various subdivisions that
have been approved in the county, again, this information is not available.
The next two questions request information on the average residence size and the
average family size per parcel. Unfortunately, this data per parcel is not available.
However, this information is available per housing unit.. These are the figures we use
when we estimate how many people will live on a given parcel (with one dwelling unit per
parcel). The figures are from the 1990 Census, which is the best data we have available
to us.

operations on a temporary basis as covered in our letter to you on January 9, 1997. Regarding the
expansion of hours your letter addresses, county staff supports you in providing to the Corps of Engineers
necessary rock materials with the following conditions:
1. The operator may load and weigh trucks on a 24 hour basis for two weeks with the possibility of
extending it another two weeks at a later date;
2. The operator shall notify Public Works of blasting — by fax if necessary;
3. The operator shall stop traffic on La Porte Road during blasting as per conditions of the Use
Permit/Mining Permit; '
4. The operator shall only blast material between the hours of 10 a.m. and, 3 p.m.. `

It has come to our attention that you have begun operating a group home with religious affiliations on property
located at 1180 Palmetto Ave., Chico. This letter is to inform you that, pursuant to Butte County Code section
24-120 (R-1 zoning district -regulations), the establishment of said use requires a conditional use permit.
Enclosed is a copy of section 24-120 for your reference. The relevant sections are highlighted. The House
of Mercy appears to in some ways fit category 2, in that it is of a religious nature. It also appears to fit into
category 4 as a group home serving 7 or more individuals, even though a license is not required by the State.
The determination that House of Mercy requires a Use Permit is based upon the intent of the zone and similar
uses requiring a Use Permit.
This Department will initiate a code enforcement action against you and/or the owner of the property unless
an application for a Use Permit is submitted within 14 days from the receipt of this letter. The application must
be accompanied with the required application fee of $988.00. A Use Permit application form and instructions
are included with this letter. Please note, the application requires a signature from the property owner or their
agent.

The Planning Commission reviewed and approved a Use Permit at its November 14, 1996 meeting
allowing a child care center to be located at 2626 West Sacramento Avenue. During the discussion
of this project the Commission heard public testimony, concerning traffic safety along West
Sacramento Avenue, specifically the excessive speeds and lack of stop signs at certain intersections.
The Commission recognizes that this road is traveled extensively by students going to and coming
from the Sacramento River often after consuming alcoholic. beverages. This scenario appears to
present a significant traffic safety concern especially when high speeds are involved.
Citizens in the area claimed that they have often solicited the County to install stop signs at the
intersection of West Sacramento Avenue and Glenwood Avenue to no avail. The Commission
accepted this testimony and acknowledged the problem to be of importance to the safety of persons
living along and using this road. The Commission formally requested the Planning Division to notify
you of their concern and further requested that the Public Works Department study the issue and
• recommend to the Board of Supervisors that a stop sign be considered at the identified intersection
and at any other intersection your Department feels is warranted. .

Dear LeAnn,
The above referenced parcel, and several adjacent parcels (APN 072-330-078 and APN 072-
330-080) were created by deed. in 1992, which was recorded with the Butte County
• Recorder's Office under Serial Number 92-16027/28. APNs 072-330-079 & 072-330-080,
which are both 39.59 acres in size, were attempted to be sold, but the lending bank required
that either a Certificate of Compliance or a Subdivision Map be accomplished on these two
parcels in order to ensure that the parcels were created legally and met all the requirements
of the Zoning Ordinance and the Butte County General Plan. The owner then submitted a
Waiver Map application to the County. A Waiver Map is similar to a parcel map, however
a final map is not recorded. Instead, a deed is recorded. The Waiver Map application was
determined to be complete and the proper fees were paid. The project was determined by
the County to be exempt from the provisions of the California Environmental Quality Act
(CEQA) under. a General Rule exemption because there would be no impact to the
environment because the parcels were already created. The Waiver Map was approved by
Butte County at a noticed public hearing which was held on October 7, 1993. The Waiver
Map deed was recorded with the Butte County Recorder's Office on February 3, 1.994 under
Serial Number 94-005512.
APN 072-330-079 is zoned M -R (Mountain or Recreation Subdivision - Residential), and is
designated by the Land Use Element of the Butte County General Plan as Agricultural
Residential (AR). The M -R zone requires a minimum parcel size of five (5) acres. A five acre
parcel size conforms to the General Plan. However, this parcel is also located in an area
that the California Department of Fish and Game has identified as Deer Herd Critical Winter
Habitat. Fish- & Game has recommended that parcels located in critical winter habitat have
• a minimum parcel size of 40 acres. This parcel is also outside of a Designated Development
Zone (DDZ), where smaller parcel sizes are allowed. Please refer to the enclosed map
which shows the parcel, -the zoning and General,Plan designation, and the Designated
Development Zones in the area. - •
Due to the Fish & Game 40 acre minimum parcel size recommendation, a parcel map to
subdivide APN 072-330-079 would most likely be denied by the County. However, if. the
owner and/or applicant and the Fish & Game can come to some agreement regarding the
size- of the parcels, the County would most likely go along with any new fish &• Game
recommendations. APN 072-330-079 could most likely be split into one parcel of 20 acres
and one parcel of 19.59 acres, provided that Fish & Game approved of parcels that size.

A matter has come up concerning the subdivision of an Eighty acre parcel, into two Forty acre parcels. Because the
information which is required, to clear up the matter, is maintained and approved by your office, I would appreciate your
providing me with the answers to the following questions. The in helping with obtaining the information needed; my .
questions pertains to Parcel Number 072-330-079, currently registered in Joseph and/or Doris Brazil located at 90
Dickerson Lane, in Butte County. At the time of the subdivision Exhibit A was used, and you will find it enclosed.
Was the Eighty Acre Parcel completely subdivided into two Forty Acre Parcels?
Could the Eighty Acre Parcel have been subdivided into One Forty Acre Parcel, and two Twenty Acre Parcels, had Exhibit
B been used instead of Exhibit A?
Where the following conditions met in the subdivision? And if they where met, would any other conditions, fees and/or
forms have been needed to have subdivided One Forty Acre Parcel, and two Twenty Acre -Parcels.
• 1. Was a completed Uniform Application and. Environmental Information form submitted and approved by your
office?

° Vicinity Map indicating the location of the land in relation to the nearest major roads, significant
topographic features, surrounding area or region.
° Dimensioned locations of existing and proposed, public and private, improvements on the property
(including, but not limited to, building, driveways, parking areas, wells, septic tanks, sewer lines,
leach fields, utilities, and street lights).
° Wells which"are to be abandoned shall be shown and identified as "well to be abandoned". The
wells shall be properly abandoned under permit issued by the Butte County Division of Environmental
Health.

'.Buildings which are to be removed will be identified as "building to be removed". The buildings shall
be properly removed or demolished under permit issued by the Butte County Building Division.
° The existing and proposed location, name, width, approximate grades and radii of curves of all roads,
streets, highways for the subdivision and within 100 feet of the exterior boundaries thereof. All streets
shall be labeled as to whether itis public or private.
° Topographic contours and water features, at a minimum, to be as shown on the current USGS 7.5
minute quad map.
° For subdivisions that have a density of 4 dwellings/ac or greater in the Urban Area or 1 acre lots or
smaller in the Rural Area and which also have an average slope of 20% or greater, a conceptual or
.preliminary grading plan.shall be submitted showing.the approximate finished -pad relevations for each
lot and all cut -and fill slopes proposed which are 5 feet or greater in height. This requirement may be
waived by the Director of Development Services if it is found not to;be needed.
° Approximate location of all FEMA identified 100 year flood plain areas, if any, and the location, width
and direction of flow of all ephemeral water courses,,if any.
° Sufficient information on the map to determine adequacy of the proposed drainage and flood control
measures, including by not limited to, proposed easements, and facilities.
° The approximate widths, location and purpose of all known existing or proposed easements.
• North arrow and scale of drawing. All maps shall be drawn to an engineering scale of a size sufficient
to reasonably show all required features. A North arrow preferably oriented to the top of sheet.

° Where all maps clear and legible?
5. Did you receive a preliminary title report showing current ownership and dated within 6 months of the
application submittal?
6. Was a proposed method of domestic water and proposed method of sewage disposal including
soils/percolation/ground water data with enough detailed information all the Division of Environmental Health
to complete their'review of the project provide?
7. Where any written request for any exceptions pursuant to Section 20-4 of the Butte County Code provided in
the subdivision? And if there where, what where they?
8. Was any addition information as deemed necessary by the Department of Development Services, Public
Works, Environmental Health Division, Butte County Fire Department, or Agriculture Commissioner required?
And if there was, what was it?
B. WHERE ALL PUBLIC HEARING REQUIREMENTS MET?
9. If the current Forty acre parcel where to be subdivided at this time, would all of the above requirements have
to be re -completed in order to obtain the subdivision?

Dear Ken,
looked up the zoning for your parcel and it is located in an A-10 zone (Agricultural, 10 -acre .
minimum parcel size). The side yard and rear yard building setbacks are 10 feet. Please
refer to the enclosed copy of the A-10 zoning ordinance.
Per our conversation, it appears that the existing garage is a pre-existing, non -conforming
structure because it is located within the front and. side yard setbacks. If you wish to
'demolish the existing garage and rebuild it in the same location as the original you will need
to apply for and obtain a use permit for that structure. I originally told'you that a variance
would be required in order to rebuild the garage in the setback, but when I looked into this
matter further I discovered that a use permit would be required. Please see the enclosed
copy of the zoning ordinance that deals with non -conforming structures.
Enclosed please find an application fora use permit. The cost for the use permit is $988.00,
but $700.00 of that amount is a deposit which we use on a time and material basis. Any of
that deposit that is not used will be refunded to you.

with the requirements of the Brown Act, including, but not
limited to, the requirements of Government Code sections 54954.2
and 54954.3. Each "legislative body" (as defined in the Brown Act)
of the County of Butte shall comply with the Brown Act even if
future California State Budget Acts or related budget enactments

Sec. 2-18. Organization; chairman.
The board shall, at its first meeting in January of each year,
elect a chairman who shall preside at all meetings; in case of the
absence of the chairman at a meeting, the members present must

Sec. 2-19. Committees.
• The board may by resolution establish and define the duties of
any committee it may deem desirable for the more efficient
conduct of the duties of the board.
Upon the establishment and appointing of any committee by
the board, a majority of its members will constitute a quorum for
the transaction of business.

Sec. 2-19.1. Review of appealable actions.
(a) Review by board. The board of supervisors may review any
action which is appealable to the board. If the action is timely
appealed, the appeal shall" be heard as specified in the applicable
section of this Code or other provision of law. If the action is
appealable but no timely appeal is filed, or a timely appeal is filed
but withdrawn pursuant to section 2-19.2, the action may be
reviewed by the board as set forth in subsection (b) below.
(b) Review procedure and effect. At the request of any board
member, the appealable action may be placed on the "board's
agenda for the next regular meeting following expiration of the
applicable appeal period or withdrawal of a timely appeal pursu-

ant to section 2-19.2. If a majority of all the members of the board
makes the following finding, review of the action may be set for

other county policy, ordinance, or resolution. The review hearing
shall be commenced within thirty (30) days after the expiration of
the time for an appeal to be filed or withdrawal of an appeal
pursuant to section 2-19.2. The review hearing shall be regarded
as an appeal hearing, and notice of the hearing shall be given, the
hearing shall be held, and action shall be taken at the conclusion
of the hearing, in the same manner as on an appeal of the matter
by an interested person other -than the applicant. While board
review is possible or is pending, pursuant to this section, the
action in question shall not be given final effect.

Sec. 2-192. Withdrawal of appeal.
• Any appeal to the board of supervisors may be withdrawn by
the appellant prior to the commencement of the appeal hearing. If
an appeal is withdrawn prior to publication of the hearing notice,
that portion of the appeal fee allocated for the expense of
publication shall be refunded to the- appellant. Upon withdrawal
of an appeal, the action which had been appealed shall be given
full force and effect, unless board review of the action is possible
or is pending, pursuant to section 2-19.1.

Sec. 2-19.5. Funds allocated for training of supervisor -
elect.
(a) Upon request of a supervisor -elect, county general fund
moneys may be used prior to the assumption of office by that

expenses, course materials and consultant fees.
(b) Such training and orientation programs; and expenses
therefor, shall be those the board deems proper and beneficial to
the exercise of supervisorial duties by newly elected supervisors.

Dear. Carole, -
I looked into the possibility of you splitting a five -acre portion off of your parcel.. Your parcel.,
as we already discussed, is zoned Unclassified, which requires a minimum parcel size of 20 -
acres. The Land Use Element Map of the Butte County General Plan designates your parcel
• as Agricultural -Residential, and as Commercial. See the enclosed map which shows the
zoning, the General Plan designation, and the deer herd area. It is a very confusing map,
however, but I hope that it can help you seethe zoning and general plan designations, and
the deer herd winter habitat area.
In order for you to split a five -acre portion off of your parcel, it would have to be rezoned to
zone that allows a minimum parcel size of five acres. Unfortunately, your parcel is located
in an area that has been designated by the California Department of Fish and Game as Deer
Herd Winter Habitat. The Department of Fish and Game recommends a minimum parcel
size of 20 acres for parcels located in this habitat. However, your parcel is located next to
an Identified Transportation Corridor (ITC), which is LaPorte Road. Parcels located along
an ITC are usually permitted to have a parcel size less than 20. acres. If you were to submit,
an application for a rezone, we will in turn request comments from the Department of Fish
and Game concerning the rezone. The Department of Fish and Game will.determine if a
parcel size of less than 20 acres would be allowed.
The northern portion of your parcel is designated by the Land Use Element of the Butte
County General Plan as Commercial. Because of this designation, a rezone of that section,
or a portion of that section, to Commercial could be possible, but again it will be up to the
Department of Fish and Game to determine if a parcel less than 20 acres would be allowed.

Dear Mr Jenkins,
The second dwelling unit located 1625 Laburnum Ave., Chico, APN 003-402-007, is a pre-
existing, legal, non -conforming use. Because it was in place prior to the current R-1 zoning
a use permit is not required.
According to_Butte County Code Section 24-35.30, maintenance and repairs for safety
purposes is allowed on a non -conforming structure provided that the maintenance or
repairs do not expand, enlarge or extend the non -conforming structure. The repairs that.
Mr Jenkins made to the second dwelling unit fall within the provisions of this section.
According to Butte County Code Section 24-35.45, the pre-existing non -conforming second
dwelling unit may be continued to be used as a dwelling unit provided that the use is not
discontinued for a period of twelve (12) consecutive months.

I found the file foryour Administrative Use Permit for a senior citizen dwelling unit and made a
copy of the conditions that were placed on the dwelling unit. -As you can see in item 2, the - .
dwelling unit can only be lived in by one person 62 -years of age or older, or two people, one of
whom is 62 years of age or older. The current A-10 zoning of your parcel does not allow a
• permanent second dwelling, therefore; your senior citizen dwelling unit cannot be converted -
into a permanent second dwelling unit which.could be rented to anyone of any age.

About two weeks ago, in an informal telephone call, the Butte County. Environmental
Health Division indicated you would be able to locate an adequate leach field site. To
date, however, no evidence has been` submitted to the Department of Development
Services verifying leach field adequacy.
• In the absence of evidence verifying your ability to comply with sewage disposal
requirements, we are required by law to require an environmental impact report (EIR)
be prepared for your proposal.
You will be responsible for the entire cost of EIR preparation. Once payment is
received, the county will arrange for the EIR to be written. -
We estimate that a focussed EIR, investigating only those issues necessary, would
cost between $6,000 and $8,000. Precise cost will not be known until after we receive
responses to the EIR request for proposals.

Over the past few days, we have been going through a process of establishing a work breakdown
structure.

Bill Farrel drafted an initial concept for me to work from. Bill hopes to have the general
plan ready for review by September 26.
Attachment B
Bill had Brian Larsen draft .a schedule, and asked me to fill in the names and dates. I don't
feel we are far enough into the process to accurately estimate the time line.
Attachment C
I used Bill's initial concepts to create a simple work breakdown. I want each person to be
responsible for very specific tasks, rather than working as a collective. I've never seen
good collective work.
I didn't set any dates for completion, because I think we will find many shortcomings that
will require a great deal of time to repair.
Attachment D
I believe it would be easier to write the general plan if we spread the material over 16
short chapters rather than lumping everything into 10 long chapters. The attached tables
of contents shove Barry Hogan's proposed chapters and my proposed chapters.
My biggest change is to break the land use element into three parts. I found it just about
impossible to deal with rural and urban issues in a single element. However, I'm not
against combining if it can be done without forcing incompatible material into a single
element just to reduce the number of chapters.
In reviewing the draft general plan, I found my writing style and planning philosophy to be at odds
with the document. Consequently, to avoid getting involved in a style war, I have decided to
distance myself from the writing and editing. That is why I suggested to Bill that my participation
be limited to doing research to fill in the gaps. .

1. Agree on table of contents. Done - 8/28/96
2. Prepare matrix of work tasks, and assign time deadlines and individual responsibilities.
- general time frame to complete 4th draft of all text will be Sept. 26th
- Bill will be project manager until the above draft done. He also writes draft of econ
element using Brian's data. He helps Connor edit other portions of text.
- Connor takes lead in making ist and second level editing, and directs work of Bill, Pam
and other staff in this area.
- Pam participates in level 1 and 2 editing, giving comments and markup to Connor. She
is lead person on level 3 editing.
- Other planning staff provide another round of review of the shortened document at the
level two editing (putting in missing policies etc.)
3. Prepare list of remaining graphics and GIS tasks and go over with Dave to establish timeline
and review roles
4. Connor and Bill to revise together the introductory material for at least one element in order to
establish the desired style and length of the material. This will serve as a guide to Connor in
further editing and revisions.
5. Determine how and when the proposed Land Use Plan map will be prepared. Craig, Dave,
' Connor, and Bill to meet Tues. Sept. 3rd to agree on this. Craig could take lead with plan staff
on drafting map. Dave should critically review. Staff should develop land use alternative for .
Skyway to Neal road growth area, and for Central Butte. .
6. Assemble all General Plan materials where they can be found. Connor -to look over to
establish familiarity. Review contracts briefly. with Brian. .
7. Contact Pam 8/29 to go over all of above and see where she is at. We'll need to adjust her
role to fit above.

I would like to introduce myself and my Company to
you along with a brief . explanation of our
intentions for that 46 acre parcel located on Cana
Rd. between Hamilton Nord Cana and HWY 99.
Presently, we have an offer in on this property
which is subJect to the Counties approval of our

My wife, Judy and -I have been partners and
owner/managers -of Green Tree Nursery for over
thirty years. Starting out with twenty thousand
walnut seedling in 1966, we now grow approximately.
one million deciduous fruit and nut trees annually.
Our growing grounds are located near the city of La
Grange, in Stanislaus County.
Over the past five .years we have increased our
sales staff and divided the state into three
divisions; Northern, Central, and Southern
California. Our Northern Division Field
Representative is my daughter Shana Otten.
Shana's territory encompasses all counties
including and north of Marin, Solano, Sacramento,
and E1 Dorado and reaches to the Oregon Border.
It is the expansion in sales volume in the Northern
territory that has prompted us to make an offer on
the aforementioned property.
I would like to address four of our proposed uses
for this property:

First of all we would like to build a small
satellite sales office which would allow for growth
of up to a staff of approximately five employees.
The building would, be approximately 800 square
feet.
Secondly, we wish to develop a small healing in
-grounds with an approximate size of one half acre.
This would allow us to heal in trees coming from
our Stanislaus County location, but that are sold
in the Northern Territory closer to the customers.
This will allow for easier customer pick up and
delivery.
We also intend to build a 8,000 to 10,000 square
foot cold storage facility. During Shana's tenure
in this territory she has discovered that there is.
a genuine need for.a cold storage facility in the
Butte County area that .focuses on nurserystock
storage-. Although there are some cold storage
facilities in the area that store trees, they do
not allow for the trees to be stored in bins. In
my thirty years as a nurserymen, I have found bin
storage to be the optimum way to store trees to
help prevent the spread of disease .
Finally, on the balance of the 46 acres, I would
like to develop a Research Orchard, used to study
and develop new varieties of deciduous fruit and
nut trees.

SUBJECT: Petition Nominating the Cohasset Ridge Region as a Sensitive Watershed
DATE: August 1, 1996
SUMMARY: The scheduled meeting of the Nomination Review Committee for the Board Of Forestry was
canceled for Wednesday, 7:00 pm, at the City of Chico Council Chambers. . This was announced at the time
of the expected meeting. Apparently the State Attorney General's Office had determined insufficient time had
been given to the public in the Notice. Nevertheless, a group of approximately 20 people attended and an
informal meeting/discussion took place.
DISCUSSION: I attended this meeting with the purpose of delivering the letter from Supervisor Houx. I was
introduced at the meeting by a Mr. Lorenzo Thatcher, of the Cohasset Ridge petitioners group. I gave a brief
synopsis of the letter — reading the opening and closing paragraphs. I gave the copy of the letter to Jim Steele
of the Department of Fish & Game. He is a member of the Nominating Review Committee for the Board Of
Forestry.
Although the official meeting was canceled, there were three or four members of the Nominating Review
Committee present, as well as members of the Cohasset Ridge petitioners' group. Jeanne Crist, from the
Paradise "Protect Our Watershed" group, was present. She presented a brief background of the movement
for obtaining Sensitive Watershed status. The Paradise group is watching to see how the Cohasset group.
manage with the State. Jim Steele spoke for awhile, covering the history and intent of the Sensitive Watershed
designation.
The petitioners were pleased that the County, through Supervisor Houx's letter, has expressed its support of
their efforts to obtain the Sensitive Watershed designation for their area. I presume that another meeting will
• be properly Noticed and scheduled in the near future. I do not expect that it will be necessary for us to attend
any future meeting. With the letter presented to Jim Steele, the State Board Of Forestry will be informed of the
County's support for this designation.

Re: Mining and Reclamation Plan Application for Ronald Harmon
Dear Lisa:
Thank you for the opportunity to review and comment on the above project. This is a follow-up to the earlier
response letter, of July 23, 1996.
After reviewing this application, many of the concerns outlined in the earlier letter are yet applicable. Specific
questions on specific items include:
Item 11: Soils - type, characteristics, Class I or II ?
Item 12: No general geologic setting or detailed geologic description given.
Item 13: No groundwater elevation, average annual rainfall, or other factors pertaining to environmental
• impacts given.
Item 19: What does the County AQCO say? Source? Method? Disposal?
Item 20: It remains unclear what/when reclamation is to take place during the 1 year between the
completion of Phase 1 and beginning of Phase 2.
Item 29: Very unclear of what is meant in 2nd sentence starting with "... and further" to "...within one (1)
year..."
More generalize environmental concerns remain unanswered. Item 29 makes mention of."the natural water
courses which the site is tributary to," so one is left with questions why they are not shown, what about DF&G
permits; are there going to be measures employed in the course of mining and in reclaiming to protect these
tributaries? and so forth. Questions relating to the transport of the material, to where, how many vehicles per day;
what sizes/tonnages of trucks; impacts to City/County roads; mitigation measures to address any impacts to these
roads; geometric design for road improvements to facilitate mining operations and protect public safety; financial
responsibility for such improvements, and so forth.
Information on Reclamation is very minimal. Questions still exist regarding financial assurances.
The City's requirement for a Landscape Plan — that could be encompassed within a Reclamation Plan — sounds
very positive.
I hope these follow-up comments will be of some help to the City in processing Ronald Harmon's permit. If you

Re: Use Permit/Mining Permit/Reclamation Plan for missile site north of Chico Airport
Dear Keith:
Enclosed is Butte County's Standard Application Form, Environmental Information Form, Submittal
Requirements for a mining permit, Mining Permit Application Form, and Reclamation Form. What is
proposed to be done constitutes a mining operation. As such, it does not require a grading permit.
The amount of material and the elevation are moot factors. However, it is good that those questions
•- triggered a review of the site and the establishing the type of project proposed. The applicant may
now proceed in the proscribed manner to most quickly move forward and obtain the proper and
required permits -- without the County code enforcement officers or the State compliance officers
getting involved at some point in the future.
The forms are fairly self-explanatory. The costs when submitting the applications:
Use Permit: $988 ($700 is a deposit which time & materials in processing is billed against)
Mining Permit: $1685 ($1500 is a deposit processing is billed against)
Several names of engineering firms include: Vector Engineering, Northstar Engineering and Rolls -
Anderson & Rolls. Vector specializes in mining matters, but I think the other two firms would be able
to do a competent job also.
