The purpose, of this Chapter is to -license enterprises geher.a
ting significant, ordinance enforcement requireme-h �s -in order. to -
promote improved enforcement of d.rdiriahces, at. lacier public cost^',
with a higher.level of protectiori of the public; and -with reduced
risk that well-intentioned operators are prejudiced• by the, unex-
•pected at

4.06.00:5 LICENSE REQUIRED. Except as provided by Sections'
'" 4.06.010 through 4.'06.055, .no person shall operate or conduct.:at '

a fixed location within the.unincorporated area of the County.any.
manufacturing, fabricating, processing, assembly or repair; whole-
saling or storage; lodging; entertainment; service; retailing;
educational; hospital or°other medical care; or business or'pro-
fessional office enterprise;. home occupation; or other .facility
to which members of the general public are invited; unless under
and .by authority of a valid, unexpired and unrevoked General
Business License authorizing the enterprise issued pursuant to
the provisions of this Chapter. It is intended .by this Chapter
to.license, unless expressly exempted; every enterprise operated
at a fixed location which is of a-.type.described by this sect.ion,-
whether the enterprise is operated for commercial, non-profit,
charitable or other. purposes, and whether the enterprise -is '
operated or conducted .independently or in association with or at
the same location as.an enterprise.or activity for which*.a
License i.s not .required.
A person shall be deemed to operate or conduct anenterprise
and violate this Section if the person, withouta re.quired'General
Business License in.effect, supervises, inspects, directs, organi-
zes, manages or controls oris in.any way responsible for or.in-
charge of the enterprise for which. the License is required. (SCC
578 § 3 (part), 1983).
4:.06.010 EXEMPTIONS. A General Business License shall not
be required for and the provisions.of this Chapter sha.11.not be'
otherwise applicable to those enterprises described.by Sections.
4.06.-015.through 4.06.050, unless such an.enterprise maintains
hazardous materials defined by and is subje.ct.to the disclosure
requirements prescribed by Chapter 6.9.6.
Unless the context dictates otherwise, the uses, activities
and facilities described.by Sections. 4.06.015 through 4..06.050
shall be ascribed -those definiti.ons.for like uses, activities and
facilities contained in the Zoning Code of the County of
Sacramento. (SCC 578 § 3 (part) , 1983) ..
4.06.015 ..SAME.- OFFICE USES.- Business offices are exempted,
if the office is not operated in conjunction with the on-site
storage of merchandise and the on-site.delivery of merchandise to
a customer does not occur at the office. The types of business
offices which are exempted include the following.:.
a. Offices utilized exclusively for the delivery of
medical, legal accounting, architectural, engineering and
other professional services; provided that medical clinics
shall be subject to the General Business Licensing Requirement;

b. Banks, savings and loans, credit unions, loan and
similar financial institutions.;.
C. Real estate, stock brokerage, and financial coun-
seling offices;
d.. Child and family guidance: clinics;. and
e. Telephone answering, stenographic, advertising, and
travel and ticket agencies, services and,offi.ces.. .(S.CC,578
3 (part), 1983)
4.06.020 SAME - SCHOOLS AND STUDIOS. The following types of
educational and studio.uses are exempted:
a. . Schools offering courses of instruction. to develop.
clerical,.barbering, beautician, data processing and com-
puter, dental technician and other business, semi-
professional and professional skills; provided that carpentry,
electrician, heavy equipment operation.and other.trade
schools shall be subject to the General Business Licensing
_.r.eq.uirements; and
b. Dance,,voice, culture, charm schools, studios or
facilities; provided that health spas and exercise schools
•-�sha.11.vbe subject to the General Business Licensing require-
ment. (SCC 578 § 3 (part),, 1983).
4.06....0:25 , SAME-- RETAIL,'SALES AND RENTALS. 'The following retail
sales and rental enterprises are exempted:
a. Athletic equipment and sporting goods stores;
b. Bicycle sales, rental or service;
C. Book or record stores;
d. Clothing and apparel stores;
e. Costume sales or rental shops;
f. Curio or novelty shops;
g. Electronic equipment or appliance. stores;
h. Florists;
i. Gift -card shops;.
j. Hearing aid sales or service;
k. Newspaper sales:or magazine stands;
1. Shoe stores;
M. Stamp or coin stores;
n. Stationery stores;
o. Toy stores; and
P_ Trophy or -emblem stores.
q. Drive-in food markets or stands, drive-in dairies,
candy stores, coffee shops, cold storage frozen food lockers,

delicatessens.,.. supermarket food:stores,'and 'restaurants and
cafes; provided that convenience stores shall be subject
to the.General Business Licensing Requirement. (SCC 578 S..3'
(part),j 1983).
4.0:6.030 '+SANIE SERVICES.-' The following service. enterprises
shall. be exempt:
a. Data processing service.;,
b. Dressmakers or tailors; and.
c. -Barber. shops and beauty -shops. (SCC 578
(Past), 1983).
4.06.035 SAME RESIDENTIAL FACILITIES'. The ,following types
of r , esidential facilities are exempti
a. ' Apartmen.ts,..r.00min'g houses, duplexes, and other.
residential facilities in which'. living units are tented
or leased--solely,on a term of thirty days- or longer;.and.
b.
Residential care, homes for adults or children.

4.06.040 SAME -.PUBLIC ASSEMBLYBUILDINGS. 'The following
-types of fully .enclosed buildings-u-tilized
for purposes of .public
assembly are exempt:
a. Churches;
bLabor union halls and temples; and
c.' Fraternal halls and other. lodges. (SCC '578•§ 3*'
(part.) , 1983)..
.4.06.045 SAME ENTERTAINMENT. The following types of

entertainmententerprisesare exempt:
a.. Libraries, museums andartgalleries; and
b. Radio, television and recording studios andotherproduction facilities.. (SCC 57&§ 3 (part.), 1983).
4.06.050 SAME - AGRICULTURE. The following agricultural
activitiesareexempt:. agricultural pursuits consisting of the."
growing of crops, raising of livestock,- and dairying, I including..
auxiliary and ancillary uses incidental to the operation of a`
farm or ranch, consisting of the purchase and storage.of substan-
ces, materials, supplies, animal feeds and pr6duc'e, and the
marketing of farm products; provided, however, that a General
Business-License'shall ' be required in connection with any
wholesaling,*processing, storage or manuf-actu,ring,.use which

involves assembly of the products of.multiple farms.or ranches by
a .cooperative or: other business entexpr.is.e . for' marketing,. distri-
bution. (SCC 578 § 3 (part) , 1983)..
4.06.055 - HOME..000UPATIONS. Notwithstanding the provisions
of Sections 4.06'.010 through:4.06.050, a General Business License _.
shall be required for any business, enterprise..or activity
described by'sa-id Secti.ons.., which is operated or.condu.cted as a
Home Occupation. A General Bu.si.ness License.-shall.also be
required for a family contractor's business.
As used in this Chapter, a."Home Occupation" shall mean and
include any commercial use conducted in a dwelling unit which is.
also utilized for residential purposes. The.terms."Family
Contractor's Business shall mean a business operated at or from
a residence which employs only members of the resident's family,
and which may include -the storage of contractor's equipment.or
supplies at the residence of. -one of the family members engaged -in
the business. (SCC 578 § 3 (part), 1983).
4.06.060 REGULATIONS ENFORCED. ,, -The following County Ordi-
nances shall be enforced pursuant to the administration of the
General Bu.siness-License-under the provisions of th.is Chapter by
the authorities.indicated:
'The Planning Director -shall enforce the -provisions
of the Zoning Code of the County of Sacramento, as said pro
visions may hereafter be amended; and the terms, conditions
,andtrequir-ements of rezoning ordinances.and any and all .
contracts associated therewith, variances, conditional use •'
permits and other legislative and administrative approvals
issued pursuant to the: Zoning Code.
b. The.County. Director of Health shall enforce the
provisions of Chapter 6.96 contained in Title 6. of this Code
adopting, relating to and containing miscellaneous.regula-
tions pertaining to the Hazardous Materials Ordinance.
c.- The Planning Director shall enforce -the provisions
of the Trip Reduction Ordinance, as contained in Title
10, Chapter 10.64 of this Code and in the Zoning Code of
the County of Sacramento, adopting, relating to and con-
taining miscellaneous regulations pertaining to Trip
Reduction Programs. (SCC. 578 § 3 (part) ,. .1983) .
4.06.065 NUMBER OF LICENSES.

commercial use, each tenant of the premises o.perating.an enter-
prise required to be licensed hereunder shall apply for and.
obtain a General Business License.
When a particular enterprise has more than one fixed location
or branch within the unincorporated area,a. separate General
Business. License shall be required for.each•location or branch.
Certain types of persons required to .obtain General Business
Licenses hereunder are.also required to obtain.a Special Business
License or other license or permit under .this or other Titles.
The issuance -'of a Special Business License or -'other license or
permit -for an enterprise shall not be deemed. to excuse the.
requirement that a General Business License be obtained,and the
provisions of this Chapter.are declared to -be independently*
applicable to each enterprise to which the provisions of this
Chapter apply.
The provisions of this Chapter shall also be deemed.to be
independently applicable to any enterprise required to be
licensed hereunder which is also required by any State or other
_law to*_obtain.-a license, permit or certificate. (SCC.578 § 3
(Part), 1983)..
4.06.070 APP.L.ICATION FILING. All applications -.for General
Business Licenses shall be filedin the office of the Treasurer -
Tax Collector. (SCC .578 § 3 (part), 1983).
4.06:075 APPLICATIONS CONTENTS. The application for a General
Business License shall be filed on a form and.contain such infor-
mation as is prescribed by the Treasurer -Tax Collector; including
the following:
a. The name and address of the person.who.owns'the
enterprise for which application is made
b. A complete description.of the enterprise to be con-
ducted at the location for which the.license.is sought;
c'. The address of the location for which the license
is sought; and
d. Such other and further information as is deemed
necessary to enforce the laws described by -Sections 4..06..060,
and administer the provisions.of this Chapter,. (SCC 578'§ 3
(part) , 1983) ._
4.06.080 INVESTIGATION. The Treasurer -Tax Collector shall.
refer the application for review by:

a. The Planning Director
b. The Director.of Health; and
c. The Sheriff, if the enterprise requires a Special
Business. License.
The Planning Director.and Director of Health shall examine
the application for the purpose•of determining whether the enter-
prise complies with those laws identified by Section -4.06..060,
and whether any conditions should be attached .to issuance of the,
License. I"nspection of the•site shall be conducted.as necessary
to determine applicability, site
with, or the adequacy of
corrections to achieve compliance with said laws. .(SCC 578 § 3
(part) , 1983) .
4.06.085 ISSUANCE. The Tr.eas'urer-Tax Collector shall act
upon the application not later. than thirty days after the date it
is validly filed unless the applicant has filed with the
Treasurer -Tax Collector written notice of a request for extension
of ...the time. within which action is taken on grounds' 'that addi-
tional time is required to prepare land present planor other
information, obtain zoning variances or other permits, remodel
the_�prerr«.ses. o.r_.make other ,corrections' for the purpose of
remedying violations of the'laws described by Section 4.06.060 -or
for other similar reasons. The Treasurer -Tax Collector shall act
..upon the application by issuing the license unless either:
a. The Treasurer -Tax Collector, Planning Director'or
Director of Health find in wri.ti'ng that the applicant has
"failed- to ---provide- sufficient or adequaCe plans, information
or -other -data necessary to permit determinations respecting
compliance with the laws described by Section 4.06.060;.
b. The Planning Director or Director -of Health.find in
writing that the enterprise at -the location proposed would
violate any of the laws described by Section 40"6.060, and
that such violation or violations.must be corrected in advance
of"the conduct of the enterprise; or
. . c.. With respect to an enterprise required by Chap-
ter 4.10 to obtain a Special..Business License, the Special'
Business License has not been issued. (SCC 578 § 3 (part),
1983).
4.06.090. CONDITIONS. Upon recommendation by the Planning.
Director or Director of Health, the Treasurer -Tax Collector may
issue the General Business License upon such conditions as are
necessary to ensure safety and prevent the enterprise from
disturbing the peace and tranquility of.the neighborhood .in which
it is located. Such conditions may include the following:

a.. With respect -to -minor and correctable violations
of the laws prescribed -by Section 4.06:060*, that the holder
of the License correct the -violation within a prescribed..
period of., time;
b. Limitations. upon hours -.or days.of operation;
when required in order to prevent disturbance of the peace
a-nd quiet of a neighborhood caused by the.enterprise or the
patrons thereof at a particular location;
c. The provision. of adequate off-street parking to
prevent the enterprise from inconveniencing neighbors or
causing traffic disruptions at a particular location
d. The installation -of on-site improvements required
to.prevent operation of -the enterprise from disturbing its
neighbors at a particular location; or
e.Other conditions related to operations or improve-
ments demonstrated under the particular circumstances to be
necessary in order to prevent hazards,.disturbance of .the
peace, quiet or safety of the neighborhood or other nuisance..
Such conditions may be imposed at the time a General
Business License is initially issued, upon renewal of the License,.
or at any time during the.term of the'License. (SCC 578 § 3
,(part) , 1983) .
4.06.095 PROCEDURE FOR IMPOSITION. Any -condition imposed
pursuant to,the provisions of Section 4.06.090, whether
established at the time of issuance, at the time of renewal or
during the term of a General Business License, shall be embodied,
together with the -reasons therefor, in a written notice which is
served upon the applicant or holder.
The condition shall become effective fifteen days -following
the date of service of the notice thereof; provided that in the
event an appeal therefrom is filedwithin the time and in the
manner prescribed, the conditions shall not become effective until
the appeal is finally determined. '(SCC 578 § 3 (part), 1983.).

health, safety or welfare of the community, and require special
regulation in order to insure delivery of such services in'A.
volume, manner and quality sufficient to insure protection of the
community.
The purposes.of this Chapter. are to establish special regula-
tions applicable to the types'of enterprises. regulated hereunder,
and to regulate.such enterprises through•a Special Business
Licensinq procedure in order to protect and safeguard the health,
safety and welfare of.the-citizens within the unincorporated area.

4.10.005 LICENSE REQUIRED. No person shall, unless under
and by authority of a valid unexpired. and unrevoked Special
Business License, conduct or operate within the unincorporated
area of the County, whether singularly or in connection with
another type of enterprise, the.following:
a. Any enterprise or activity for which a Special
Business. License is required by Chapters 4.14 through 4.50,
inclusive;

Article I.
Applicability and Issuance
4..10.000 PURPOSES.. There are certain types of enterprises.
which require special investigation, review and regulation in
order to ensure that the public health,.safety and welfare is'
adequately protected. The necessity to conduct.such investiga-
tion, review and regulation arises for reasons which include, but
are not necessarily limited, to,_the following:. (i) the tendency
of certain types of enterprises to engage, whether intentionally ,
or unintentionally, in the promotion of crime,.whether..through
the sale of stolen goods or otherwise; (ii) the tendency: of cer—
tain types of enterprises -to be placed where criminal-activity-
riminal activityoccurs
occurseither by virtue of.the type of clientele attracted or for
other reasons; (iii) the. fact that patrons of .particular types of
enterprises are vulnerable to fraudulent charging or other prat-.
tices either because of the nature of the business, the type of.
service or merchandise offered, the circumstances under which the
merchandise or service is purchased, or for other reasons; (iv)
the fact that.certain types of enterprises create'heal.th or.
safety risks which require special regulation; and (v) the.fact
that certain types of enterprises require access to pr.i.vate prop -

erty, particularly residential property, or frequent residential

neighborhoods, generating high risks to the safety of persons and
property.
Other types of enterprises provide services essential to the
health, safety or welfare of the community, and require special
regulation in order to insure delivery of such services in'A.
volume, manner and quality sufficient to insure protection of the
community.

4.10.005 LICENSE REQUIRED. No person shall, unless under
and by authority of a valid unexpired. and unrevoked Special
Business License, conduct or operate within the unincorporated
area of the County, whether singularly or in connection with
another type of enterprise, the.following:

Business. License is required by Chapters 4.14 through 4.50,

f.- .Sales of Concealable -Firearms including gun-
powder;
g. Home Repair. Services consisting of services
related.to the repair or maintenance of single family resi-
dential dwellings, mobilehomes, or.gar.dens*by.persons.who.-
are not licensed to perform such -services -by the,Stat.e.of
California, including businesses offering energy. -saving
appliances, equipment, or services, whether.,in connection
with solar, wind or other power;
h. Storage.or Sales'of Inflammables including -ex-
plosives, other.than by servicestationsand by electrical,,
gas, telephone, water and other similar public utilities
..which -are subject to Regulation by State Public -Utility -6k
other Commissions;
I. Locksmiths;
j. Purchase or Sale of Metals inclu.ding*.precious
and scrap metals;
k. Auto Towing consistingofpersons.who engage in
the business of towing.auto.mobiles,which require repair,,
are abandoned on public ri.ghts.of way, or -aro parked.
illegally;,
1. Repossession or Storage of Automobiles, or any
other thing of value;
M.- The Operator of Each Booth in a I -.bazaar, flea
market or other similar type of auction established for the
purpose of selling merchandise, including foodl.for private
gain;

o. Tree Trimmers;
p. Motorcycle Sales -- including.'the sale•.of new
and used parts;
q. Wrecking.Yards -- including automobile.dismantling
and.the.buying and selling of automobiles of scrap metal or
parts.
A person shall be deemed to operate or conduct'an enterprise
or activity and violate this Se.c.tion and corresponding prohibitions
in Chapters 4.14 through 4.50, inclusive, if theperson, without
an applicable Special.Business License in effect, supervises,
inspects, directs, organizes, manages or controls or is in any
way responsible for or in charge of the enterprise or activity
for_ which the License is required. (SCC 578 S.4 (part.), 1983) .
4.10.010 NUMBER OF LICENSES REQUIRED. If a person conducts
or operates more than one of the types of enterprises described
by Section 4.10.005,.a separate Special Business License shall be -
required for each type of enterprise which the person operates or.
conducts.
A person who operates or conductsmore than one store, office,
outlet or other branch of a particular type of enterprise described
by Section 4.10.005 shall not be required to. obtain more than one
Special Business License for that type of enterprise, regardless
of the number of.stores, offices, outlets or branches operated or
conducted. (SCC 578 §.4 (part)., 1983.)
.4.10.015 BUSINESS LOCATION. Except as otherwise expressly
provided,.a Special Business License shall be required for each'.
particular type of enterprise described by Section 4.10.005 which
is operated or.conducted within the unincorporated area of the
County, whether or not the enterprise is operated at a fixed.
location within the unincorporated area.
An enterprise shall be deemed to be operated or conducted
within the unincorporated area if representatives of the enter-
prise -offer or sell goods or services or provide -services within
the unincorporated area, whether the enterprise is operated from
a fixed location within another jurisdiction, and whether the
enterprise has a fixed location at all. (SCC 578 § 4 (part), 198.3).

4.'1.0.020 SPECIAL REGULATIONS. Certain ofthe types of
enterprises described by'Section 4.10.005 are s:ubj:ec,ted to
special regulations governing -their operations. These regulations
are set forth in Chapters 4.14 through.4.50. Except as otherwise
provided-, the provisions of -this Chapter shall be fully applicable.
to the. enterprises identified. byChapters 4.14 throu.gh'4.50..
The provsions-of this Chapter shall be independently,appli_
cable to.any,e.nterprise described by Section 4.10.0.05 which are -
also regulated under the provisions of Chapter:4.06. The issuance
_ of a.General Business License to an enterprise described by Section
4.10..005 shall not excuse the.enterprise from the requirement that
a Special Business License be -obtained pursuant to the provisions
of this Chapter. The issuance of a Special Business License shall
not -be deemed to "relieve the holders.of a requirement, under
Chapter 4.06, that a General Business License be obtained. A
. Special Business License shall not be deemed to authorize opera -
.tion of .an enterprise business at a particular location, if a
General Business License is required and there is no such License
...in full force' and effect. .(SCC 578 § 4 (part) , 19'83).
.4.10.025 APPLICATION.FILING. All applications for Special
`
Business Licenses shall be filed in the Office of the Treasurer-
.. Tax Collector.. The Treasurer -Tax Collector shall receive any fee.

4.10.030. APPLICATION CONTENTS. The application for a Special
Business License shall be filed on a form -and contain such infor-
mation as is prescribed by the Sheriff, including.the following:
a. A complete description of the type, nature and
extent of the enterprise to be.conducted and for which appli-
ca.tion is made;
b.'.The address of each location.from which the enter-
prise for which application is made.will.be operated;
C., The name and address of the person who owns the
enterprise for which application is made;
d. Such information as is necesary to permit the
determinations prescribed by Section 4.10.0.50-c;
e. Identification of each type and location of enter-
prise conducted by the owner within the unincorporated area
of the County; and

4.10.035 INVESTIGATION.' The Sheriff shall conduct.such
investigationof the background'of the owner,or owners.and per
sons managing or. supervising the enterprise. as is deemed
appropriate. The Sheriff shall evaluate each application to
determine whether:the.operation of the enterprise would involve.*
an unreasonable risk to the health, safety or general welfare of
the public. Those persons described by Subdivisions "e"(1)
through "e"(8) of Section 4.10.040 shall be fingerprinted and
photographed; and consideration shall be given.to the criminal
record, if any, and character of the owner and other persons con-
nected with the enterprise, the busines's responsibility of the
firm which is the owner, and the.manner in which the owner
intends.to.conduct the enterprise. (SCC.578 § 4 (part),. 1983).
4.10.040 ISSUANCE. The Sheriff shall issue the Special
Business License within ninety days after the date of application
,.unless either:
a. The Sheriff finds in writing that the appli'
' cant fails to provide information in connection with the
application requested by. the Sheriffas a basis for''
enabling the Sheriff to make his or. her'determination;
b. The Sheriff finds in writing that any of the
statements made in the application of any information
submitted supplementary thereto is incorrect or -untrue;
C. The Sheriff finds in writing that.any.of the
following. persons has been convicted of a crime and the.
time for appeal has elapsed, or when an order granting pro-
'bation is made suspending the imposition of sentence, ir-
respective of the entry of a subsequent order under Cal.ifor-
nia Penal Code -Section 1203.4; or has done any.act involy
ing dishonest, fraud or deceit with intent to substantially
injure.another; and the Sheriff concludes that by reason of
the.crime or act the applicant would not.conduct the_enter-
prise in.a law abiding manner or in a.manner-which does not
subject patrons of the enterprise to risk of harm or.crimi
nal,.deceitful or:_otherwise unethical practices:
(1) A general or limited partner of a. -partnership
which possesses an ownership interest in the. enterprise;
(2) A joint venturer in a joint venture which
possesses an ownership interest in the enterprise and
if one or more of the joint venturers.is'a partnership

or corporation, those.partners, directors or stock-.

profit.corporation possesses an ownership in the enter-
prise;
(6) -A member of a management committee when a
partnership or joint venture.posse,sse's.an own*ership._..
interest in the enterprise;
(7) A member of.a governing body or other'board
or committee to which management is entrusted-, when an
unincorporated association-possess.es an ownership inter-
est.in the enterprise; or
(8) A president,, general manager, vice president,
chief-a'ssistant manager,Jsecretary, treasurer or any.
officer with equivalent or similar authority.employed '
or retained by the firm possessing an ownership interest
in the enterprise -
Notwithstanding the foregoing, an application s,hall not
be denied.solely on -the basisthat a person has been con-
victed of a felony if the person has obtained. -a certificate,
of rehabilitation under California Penal.Code Section 4852.01
et'seq.,.or that the person has been convicted of a mis-.
demeanor if -the person has met all applicable requirements of
the crite.r.ia.of rehabilitation developed to evaluate the
rehabilitation of a person when considering the denial of a
license under California Penal, Code Section 482(6).
d. The sheriff makes any finding.in writingauthorizedas a'basis for denial.of the License by Chapter 4.14 through
4.50, or finds in writing that the applicant does not
satisfy any requirement applicable to the enterprise for
which application is made established by Chapters 4-.14
through 4.50.

TITLE 12. BUSINESS LICENSES.
CHAPTER 1'. Business Licenses in General.
ARTICLE 1. TITLE, PURPOSE, AND AUTHORITY.
Section 12-1.101. Title.
This Chapter may be known and may be .cited and referred t
as the Business License Ordinance of the County of Yolo.
Section 12-1.102. Purpose.
The purpose of this Chapter, is to provide for the health
safety and general welfare of the people of the County of Yolo b
regulating businesses.for the purposes of:
(a) Assuring compliance with the minimum standards for saf
buildings;
(b) Assuring compliance with the Building Code provision
concerning alteration and modification of premises;'
(c) Assuring compliance with zoning regulations;
Ad). Encouraging compliance with fire regulations; E
(e) Monitoring the use and storage of hazardous materials(
and
(f) Assuring compliance with other regulations of the
County.
These purposes.shall be accomplished through this Chapter b,
licensing the occupancy of real property for business purposes.
Section 12-1.103. Authority. This Chapter is enactey
pursuant to the authority conferred by Section.? of Article 12 o!

.persons . required, by this' Chapter to have a license shall make
,application before the commencement of any activity for. which a
,license is required. The license shall authorize the person
obtaining it to conduct the license activities for the period -
named in the license.
Section 12-1.503. Different Locations.
If the same type of -' business js carried on--a*t more than one
,location, a separate license shall be required for each location.
Section 12-1.504. Business Confined to Locat I ion --Specified.
When a license specifies the location of the business
license, the licensee may conduct such business" only at the
location --specified in the license.
Section 12-1.505. Fictitious Name.
A license may be issued pursuantto this part to a
.Corporation duly authorized to transact business in this State or
to -a person operating under'a fictitious 'name, who has complied
with the 'Provisions of Chapter 5 of Part 3 of Division 7 of the
Business and Professions Code of this State, (commencing with
Section 17900) or any statutes superseding or taking the place of
such provisions; otherwise, all ( such licenses shall be issued in
the true nameof the person applying 'therefor. -Except as above
provided, -no busines s so licensed may operate under any false or
fictitious name.

sought to be enforced. Neither the issuance nor. receipt of
license shall constitute evidence of 'compliance with the lawli

recipient upon which reliance is authorized or intended by th
County that the enterprise for which the license is issued or -the
property or premises upon or in which it is located complies wit

such laws.
Section 12-1.508.. Transfer.
Unless otherwise specifically allowed herein, no licens
issued pursuant to this Chapter shall -be transferred from one,
person, to another person or from one location to anothe ,
location, or from one type of business to another.

in the 'amount established by the Board of Supervisors by
resolution. 1. . Any new partners must be fingerprinted if such is
required of the original applicants.
Section 12-1.510. Applications;'InvesticTations; Issuance;
Denial.
(a) The Business Licensing Officer shall refer the
application to the Building Inspector, the Fire
Marshal, the Health Officer, the Planning Director, and
the Sheriff, who shall cause such investigation as they
deem appropriate to be made of the facts stated in the
application and. of. the activity for which the
application is made, and who 'shall make a report
thereon to the'Business Licensing Officer.
If, based upon- the, application, the investigation
reports or supplements thereto- or. any further
investigation the Business Licensing Officer may cause
to be. made, he finds that the, applicant is in
compliance with the standards specified by this
Chapter,.th.e.Business Licensing.Officer shall order the
issuance of the license.
(c) If he finds thatcompliancewith those standards can be
obtainedby the applicant, the Business Licensing
Officer may issue a permit subject to reasonable

Section 12-1.513. Applications: Fees. Each application and
each appeal shall be accompanied by the fees prescribed by
resolution of the Board -of Supervisors. Such fees shall in no
event exceed the _actual cost -to'the County to conduct the
services required to satisfy the requirements of this Chapter.
The submission of an application or an appeal shall not be deemed
to be complete until such fees are paid to the Business Licensing
Officer..
Section 12-1.514. Applications: Appeals. Any order of the
Business -Licensing Officer issuing or denying *a license may be
appealed by the applicant to the Business .License Appeals Board.
Section 12-1..515. Applications: Orders: ,'Finality..
The Business Licensing Officer shall make his order
granting, granting with conditions, or denying the application in
writing' and shall mail .a copy thereof to the applicant. The
order shall become final on the fifteenth (15th) day following
that mailing unless applicant shall file an appeal.
Section 12-1.516. Applications: Orders: Appeals:
Procedures.
Appeals from orders of the Business Licensing' Officer shall
be made in writing, and shall, specify and set forth the grounds
.for the appeal, and shall be filed by the appellant with the

(b) The licensee has violated a condition of the business

(c) Due to a change in circumstances 'and conditions, the
continuance of the establishment,'business or activity
is hazardous to the public health, welfare or. safety;

(d) The applicant for the _permit made -'a material
misrepresentation of facts in the. application or
supportingstatements; or
(e) The establishment, business or activity is maintained
in violation of the standards prescribed by this title.
Section 12-1..519. Revocation: Petitions.
A petition to suspend or revoke'a business license'shall be
filed with the Business License Appeals Board by the Business
Licensing Officer accompanied by a statement of the grounds or
reasons. for such action. At the time 'of filing, the Business
Licensing Officer shall set the matter for public hearing before
the Business License Appeals Board and shall serve the licensee
with a notice of hearing and a copy of.such petition by -certified
mail no less than fifteen (15) days prior to'the hearing.
Section 12-1.520. Suspension or Revocation: Hearinas:

At the hearing, the burden of proof shall lie with the

Section 12-1,523, Order on Termination: Effective Date.
An order of the Business Licensing Officer granting or
denying an application shall not become effective until the
expiration of the time :for an appeal; and if the appeal's filed;
such an order shall not become effective until the appeal is
dismissed or an order of the Business License Appeals Board
thereon becomes final.
ARTICLE 6. STANDARDS.
Section 12-1.601. Scope..
Applications for the issuance, of business licenses and
petitions for the revocation or suspension of business licenses
shell be determined in accordance with the standards prescribed
by this -article.
Section 12-1.602, Standards..
The standards shall consist of any enactments, statute,
order, quarantine, rule or regulation lying within the
enforcement authority of the County or any officer or employee
thereof, including the provisions of the Yolo County Code and
this title thereof.

I ARTICLE 1. TITLE, AUTHORITY,'AND PURPOSE.
Section 12-2.101. Title.
This Chapter may be known and may be cited and referred to
as the -"Hazardous Materials Ordinance of the County of Yolo
Section 12-2.102. Authority.
This -Chapter is enacted pursuant to the authority conferred
by Section 7 of Article XI of the California Constitution.
Section 12-2.103. Findings and Purpose.

The Board of Supervisors of this County makes. the following
declarations of findings and purpose:
(a) Hazardous substances which are present in the community
may pose acute and chronic health hazards to
individuals who live in Yolo County -and -who are exposed
to such substances as result of 'fires, spills,
industrial accidents, improper storage or handling, and
other.types.of releases or emissions.
(b) Emergency response organizations., health and planning
officials and residents of Yolo"County need to -know the.
location,' type, method of storage, and health risks of
hazardous materials in the community in order to plan
_..for. and respond to potential exposure to such
materials.
(c) Basic information on the locations, type, method of
storage, and. the health risks of hazardous materials

that a public request for information would involve the

shall have the meaning given to it by Section 6254.7 of

the Government Code and Section 1060 of. the Evidence

Code. ..

disclosure any trade secret coming into his or her

(f) Notwithstanding Subsection (c) of this section, upon
receipt of a request for the release of information to
the public which includes information which the user
j
has designated as, a trade secret pursuant to
subdivision (a) of this section, the Emergency Services
Coordinator shall notify the user in writing within
five (5) working days of said request by certified
mail, the Emergency Services Coordinator shall release
the requested information thirty (30) days after the
mailing of said notice, unless, prior .to the expiration
of.said thirty (30) days, the user institutes an action
in an appropriate court to seek an injunction
prohibiting disclosure of said information to the
application. . The user and the applicant shall be
considered the real parties in interest in any such
action and the County of Yolo, if named, will be a
disinterested party.
(g) The provisions -of this section shall not permit a user
to refuse to disclose information to the Emergency
Services -Coordinator pursuant to the filing procedures
as defined in Section 12-2.3x1.
(h) The Emergency Services Coordinator shall, at the time
of request for disclosure of information designated by
the user as a trade secret, inform the person
requesting the disclosure of any legal liability he or
she will incur from filing for disclosure of said

Section 12-3.102. Purpose.
1 The purpose of this Chapter is to provide -for the regulation
of itinerant businesses by licensing persons conducting business
without a fixed place of business,who occupy private property or
a public easement or right of way adjoining private property.
Section 12-3.103.
This Chapter is enacted pursuant to the authority conferred
by Section 7 of Article . 12 `.of the California Constitution and
Chapter 2 of Part 1 of Division 7,o,f the Business and Professions
Code (commencing with S6ction'16100)..
Section 12-3.104., Application of Other Provisions-.
Exce . pt as provided in this Chapter, the provisions of
Article 2, Article 3, Article '5 and 'Article 7 of Chapter 1 of
this title shall apply to persons regulated,by this. Chapter and
to proceedings for. the. application,. review, grant or denial,
appeal therefrom and suspension or revocation of a license issued
under thi's Chapter.
Section 12 -3.105 -Applications.
An .application -for an itinerant business license shall set
forth such facts as to enable the Sheriff and Business Licensing
Officer to determine whether or not the - applicant meets the
standards...of this Chapter and shall be accompanied by the written
consent ofthe-property owner or adjoining property owner.
Section 12-3.106, Other Licenses.

deemed to excuse the requirement for any other. permit or licensee.
The issuance of any.other license or permit shall not excuse t

this Chapter are declared to be independently applicable to ea

ARTICLE 2. PROHIBITIONS. -
Section 12-3.201. Itinerants without a License.

Persons conducting business without a fixed place of
business who occupy private real property shall do so only with
the written consent of the person entitled .to possession of the

Business.License Ordinance and the
Hazardous Materials Ordinance of the
j County of Yolo)
WHEREAS, this Board of Supervisors has enacted the Business
License Ordinance of the County of Yolo, Chapter l of Title 12 of
the Yolo County Code; and
WHEREAS, that ordinance includes §12-1.513; which provides
that this Board of Supervisors shall prescribe by.resolution the
fees to accompany each application for a business license and
each appeal from an order of•the Business Licensing Officer; and .
WHEREAS, §12-1.51.3 also provides that such fees shall in no
event exceed the actual ,cost to the County to conduct the
services required to satisfy the requirements of that ordinance;
and
WHEREAS, this Board of Supervisors has enacted the Hazardous
Materials Ordinance of the County of Yolo, Chapter 2 of Title 12
of the Yolo County Code; and
WHEREAS, that ordinance includes 512-2.301 which provides
that this' Board shall prescribe by resolution the fees to
accompany each completed disclosure form; and
WHEREAS, that section also provides that such fees :hall in
no. event exceed the actual cost to - the County to conduct the
services required to satisfy the requirements of the ordinance;
and.
WHEREAS, that ordinance: in §12-2.403 directs the Board of
/. Supervisors to prescribe the amount of a filing fee to accompany
2 an application for disclosure, and §6257 of the Government Code
3 permits a request for ,a copy of records to be conditioned upon
4 payment of fees covering direct costs of duplication; and
5. WHEREAS, this .Board of Supervisors before adopting this
6 resolution, has -held at least one public meeting hereon at which
7 oral or written presentations could be made as a part of a
8 regularly scheduled meeting and has given. notice of the time and
9 lace of the. meet g, including a general explanation of the
10 matter to be considered; and '
11 WHEREAS, in the judgment of this Board, it appears to be in
. 12 the best interest of the County of Yolo to do so;
13. NOW, THEREFORE, BE IT RESOLVED, ORDERED AND FOUND by the
14 Board of Supervisors of the.County of Yolo as follows:

whether or not carried on for profit or for charitable, philanthropic, or other purposes, including
the arrangement of business transactions, holding of sales or training meetings and administrative
conferences, the receipt of customer or client payments and the keeping of records and accounts
pertaining to a business.
Activities that are not businesses and not subject to licensing are: Apartments, Rooming Houses,
Duplexes, -or other Residential Facilities in which living units are rented or leased solely for
a term of 30 days or longer; Churches to the extent of use for Worship, Religious Education, or
Social Affairs of the religious group (however, this exception does.not extend to other activities
not undertaken primarily for memebers of the religious group, including but not limited to day
schools and social services programs); and Office, Stores, or other Facilities maintained without
paid employees by a non-profit public benefit corporation.
One Licensing Exemption Exists - No license shall be required for any business consisting of
producing or the sale by the producer of products of cultivation of the soil and it's fruits and
raising and harvesting crops, or products of, the rearing, feeding and management of livestock.
This Agricultural Exemption is extended ONLY to the growing/raising and sale of the harvest of
the agricultural products. Other agricultural operations are required to be licensed.
