Enclosed pursuant to our telephone conversation.yesterday is
a copy of a -certification from the County Recorder -pertaining to
Notices of Location of mining claims filed by Little Chico Group
and Little Chico Group Extension.
Your records and the notices of location which have been
recorded contain different versions of the spelling of -the names of
.the persons involved. Therefore, as you will note, these
different spellings of the names have all been checked.
As we -have discussed, it would appear that the Notices of
Location were not timely filed. It would be appreciated if you
would seek an official determination by the appropriate person
within your agency and notify the purported claimants if in fact
their claims are invalid due to the lack of timely recording of the
Notices of.Location.

Thank you for meeting again with my staff 'on October 17, 1991 at the site of your
proposed mining activities, 43 CFR 3809 Notice # CA -059-91-22-N. At that time
they followed .your proposed road alignment down from the ridge top, into Little
Chico Creek canyon. The road alignment, as it has been modified during this
field visit, now appears to be satisfactory. The discussed and .agreed -upon
changes to your original proposal are as follows:
1. Water bars and berm cutouts on your existingridge top road will be installed
as we discussed and where they were marked on the ground.
2. Keep the ridge top road on top of the ridge or to the east of the ridge top.
3. From the switchback off of the ridge top, drop the road faster than you had
flagged, it, to a gentle grade immediately before the first drainage crossing.
The average grade for this segment should be approximately 12%.
4. This first drainage crossing requires at least an 18" diameter culvert.
5. From this first drainage, stay below the original,flag line down to the open
spur ridge.
6. Zigzag,down the spur ridge as we -had flagged, doing minimal blade work.
7. Follow the realigned flag line from here down.
8. The second drainage will require at least a 24" culvert.
9. The third and fourth drainage crossings will require at least 18" diameter
culverts.
10. The end of the road will be above the cabin at the discussed location, -and
will consist of an adequate turnaround.
11. Loose soil slopes will be seeded, fertilized, and mulched, as needed, to
prevent erosion and soil loss.

Please review the "Minimum Standards For a Single Lane Road", and "Standards For
Mining, Construction, and Reclamation in the Redding Resource Area", which we
sent.to you with our September 13, 1991 letter. All specifications, other than
road width and slough widening, must be followed in order to'avoid unnecessary
or undue degradation.
Side cast material may not enter Little Chico Creek, as this would be a violation
of Federal and State Regulations.
We have recently been contacted by Mr. Pat Gantt, the landowner adjoining the
public land where your proposed mining operation is located. Mr. Gantt informs
me that he is rescinding your right to access across his private property.
Private landowner, Mike Westlake has also rescinded your right to cross his land.
If this is the case, the construction of your proposed mining road would serve
no purpose as you would have no legal way on to the public land. Construction
of the road without access across private land would therefore be considered
unnecessary or undue degradation, as defined in the 43 CFR.3809 Regulations, and
is prohibited by those regulations. You may not continue construction of this
road without proof of legal access across the effected private property. You are
still responsible for the maintenance and eventual reclamation of the road you
have already constructed.

problem we and our neighbors are facing.
' `It appears that due to an archaic federal mining law which dates back
'to 1872, the Bureau of Land Management may be forced to grant access

mining claim. Once he has settled in (squatted) on this federal

Dear Mr. Morse:
We live in a planned unit development called Humboldt Highlands.
.'This development is located on Highway 32 approximately 2 miles below
":,Forest Ranch and runs along the western rim of Little Chico Creek
'Canyon. I n addition -to developed building sites and common areas,
' ``'Humboldt Highlands undeveloped property extends down the canyon to
Little Chico Creek and
}_•��,,� �,: , in some places, up the east side of the
canyon for a short distance.
Because of the fire hazard presented by the canyon's thick, often
very dry underbrush, the project's developer and each homeowner have
been required to implement and maintain fuel reduction programs to
minimize fire hazard. Our C.C.& R.'s require that all building
construction utilize fire resistant building materials and
landscaping to minimize fire hazard. Our homeowners association has
also established water storage tanks with fire department connections
which may be used to preserve life and property in case of fire. We
are taking the time to explain all of this to you because a -situation
has come to our attention which could easily undermine all of the
positive steps we have taken to protect our property.
We have been told that an individual has obtained rights to an
existing mining claim that is situated on Little Chico Creek below
our development. This individual has secured permission to cross
private property which allows him access to Bureau of Land Management
(BLM) land on the eastern canyon opposite our development. He is
currently in the process of securing permission to build an access
road through the BLM property mentioned above.
It Is our understanding that if this permission is granted the
individual may build a road down the side of the canyon to the mining
claim and establish "squatters rights" to an abandoned cabin located
at the mining site. We also understand that this Individual would
not be held accountable by the BLM to meet either local county or
state fire codes.

We feel this is an alarming situation, and we are asking the Bureau
of Land Management to deny this individual's request for the
following reasons:
1. The potential for a significantly devastating fire to rage
through Little Chico Creek Canyon will be magnified if an individual
is allowed to settle in the canyon and is not required to meet any
minimal fire safety codes.
2. Considering the current attitude of our society regarding the
preservation of federal land, it would go against public sentiment to
allow an individual to scar the eastern side of Little Chico Creek
Canyon with a road which would have to zigzag across the canyon wall
on its descent to Little Chico Creek.
3. Once such a road is established on federal land, it will be
accessible to the public. This means that currently protected
property would be subjected to public misuse.
4. Little Chico Creek is, as its name implies, little. It is a
fragile creek that is usually dry during the summer months. We doubt
that the creek and its surrounding habitat can handle the impact of a
serious mining operation and/or extensive use by the general public.
6. Although we do not know the individual who is asking for
permission to access BLM property, we are concerned about some of his
actions which have been observed by'us and our neighbors. First, we
have been informed that he built an Illegal fire while working on his
access road after all fire permits were lifted earlier this summer.
Second, we observed him bulldozing on BLM property the day after he
was cited by one of your rangers and told to desist work until he had
secured permission to access your land. On that same day, one of our
neighbors observed him bulldoze a large boulder over the side of the
canyon. These actions show a lack of proper respect for fire safety
and a disregard for authority. We do not feel that such an
Individual should be allowed unrestricted access to public land.
G. The portion of Little Chico Creek under discussion is a popular
location for marijuana growers. In fact, we have witnessed two drug
raids in this area in the last two years. It would be foolish to
make it easier for unsavory drug growers/dealers to access this
remote area by providing them with a road through BLM property.
Please consider our following requests:
1) Do not grant this Individual the right to build a road through
this BLM property.

2) If you plan to honor this Individual's request, please have the
courtesy to provide a public hearing before doing so. All Forest
Ranch residents should be informed of this situation and given a
chance to voice their questions and/or concerns.
3) Please provide us with documentation which shows that the Bureau
of Land Management does, in fact, own all of the land in question.
When we bought our property, the developer told us that the Humboldt
Highlands development went down the western canyon wall, across
Little Chico Creek, and half way up the eastern canyon wall. You can
imagine our disbelief when we were recently told that the lower
eastern canyon is BLM property. You certainly cannot be held
accountable for a developer who either knowingly or unknowlingly gave
us misinformation, but we do feel that you should be able to provide
us with maps that properly define the property lines in question.
Please share our concerns and comments with the powers -that -be before
the Bureau takes action on the request to grant this individual
access to BLM property in Little Chico Creek Canyon.

Dear Sir,
This letter is to express our deep concern over the cutting of a - road
on B.L.M. property down to Little Chico Creek, for the purpose of
using and working a mining claim.
T : Environmental Impact: Saturday, we watched the road being cut
with huge boulders bouncing down the canyon.
Fire Threat: When our home was constructed at Humboldt
very :Hig hland it was done with strict fire codes - from materials
fused to build, to cleaning the area of brush around our home, and
maintaining water storage for the fire hydrants. We now are faced
with someone living in an old mining cabin, surrounded by trees
without adequate water to put out a fire. This same someone last
month came onto the B.L.M. property with a. chain saw and cleared
area where he is now cutting the road. At this time a campfire was
built in this dry tinderbox area, when all permits had been
suspended. This was a complete disregard of the law by a totally
irresponsible someone.
Sanitation: To an already fragile stream, the impact of lack of
proper sanitation to the wildlife and people in homes down stream is
uncountable.
Mining the Claim: Again to this fragile stream, can we really
afford to disrupt natures way?
Use of this Road: Can we be assured, once this road is completed
that this does ' not open this area to all kinds of distruction.
It ' is beyond, our comprehension that in this day and age, someone
-could be grnted permission which would result in such danger to -
the total area. ;
Thank you for your , concern and prompt attention to this matter.
Please take whatever action is necessary- to stop this travesty.
