I The Honorable Dennis Diver Mayor of Oroville 1735 Montgomery Oroville, CA 95965 Dear Mayor Diver: The Butte County Airport Land Use Commission (ALUC) invites your Council's input for developing land use policy around the Oroville Airport. The ALUC is pursuing its legal mandate to protect public health, safety and welfare by ensuring the orderly expansion of airports and the adoption of land use measures that minimize public exposure to excessive noise and safety hazards with areas around public -use airports. The Commission is required to produce a Comprehensive Land Use Plan (CLUP) for each public -use airport in the County and to document the adoption of relevant rules and regulations. These are daunting tasks in the face of many competing public and private interests. On behalf of the Commission, Butte County has retained a consultant who is in the process of developing CLUP's which ALUC anticipates adopting this spring or early summer. Since the departure of Alan Campbell, Oroville's airport manager, the Commission has had no contact with anyone authorized to speak for the airport. We have been operating on the assumption (derived completely from the media) that Oroville was vigorously courting new industry, and as a result, ALUC has attempted to protect the approaches that are essential for corporate aircraft and business jets. For example, jets require a 3 degree slope, which means that at a point 5,000 feet from the threshold of the runway they are only 260 feet above the threshold altitude. Depending on the altitude of the land at that distance from the runway, they may be even lower to the ground and closer to any homes in the approach path. This can be very disturbing to a homeowner and is certainly very noisy. A member of the Commission, Fred Gerst, has been unsuccessful in an attempt to obtain current copies of the master plan and FAA CFR Part 77 maps of the airport. While these materials may have been sent to the consultant, ALUC is wrestling with current project approvals and we need to know now how much airport we should be protecting. The Commission believes that generally the recent body of public testimony before it, public testimony before City Councils, statements by public officials and public interest groups, the expertise and experience of the Commissioners themselves, documentation of varying currency, and the consultant's recommendations, augmented by a public hearing process, should be a sufficient basis on which to proceed with CLUP approval. i ALUC needs your Council's written policy statement of intentions for Oroville's airport. We hear that you want industry and development, but we see you taking up your welcome mat. In fact, both the city and county are proceeding with projects that will make approaches by commercial and business aircraft problematic, if not impossible. Mr. Davis, of your planning department, insists that ALUC is interfering in Oroville's business and has no authority in this area. State law does direct the Commission to plan around public use airports. However, absent any statement from the Council to the contrary, we must assume that Mr. Davis does speak for the City and that the Oroville City Council has determined that they do not wish to retain the ability to add an instrument approach in the future. Have you been informed of the requirements of'ihe grant assurances signed by the City when Oroville accepted $8 million in FAA funds to renovate the runway? 'If the recipient fails to protect the utility of the airport, the FAA may require repayment of those funds. FAA Administrator, Jane Garvey, has announced a "get tough" policy on compliance with the grant assurances. Given the current schedule for the CLUP development and approval, your response will be timely if received by March 3, 2000. Our next meeting is .February 16 at 9:00 a.m. in the Supervisor's chambers. We would be glad to discuss the implications of various policies with your council members or airport manager. The plan is divided into three (3) volumes: Volume I Policy Document ' Volume II - Environmental Impact.•Report Volume III - Environmental Setting Document The planning area -covered by the draft General Plan is depicted on the attached map. The primary study area corresponds to the current town limits. The secondary study area reflects the existing sphere of -influence boundary. The tertiary study area includes a considerable are to the south located between Honey Run Road, Highway 99, Durham-Pentz Road, and Penta Road. The level of detail in the Draft General Plan is greatest -in the primary study area, yet goals, objectives and policy statements are included for the secondary -and tertiary study areas. Copies of the draft revised Paradise General Plan and EIR are available for public review and inspection at the -Paradise Community Development Department, Town Hall, 5555 Skyway, Paradise..
