claimants' intend to drill four..(4) .four inch prospect holes
approximately 250 feet deep to obtain core samples. The claimants
submitted a proposed plan of operations which describes their intention to
drill for mineral samples. This will help give them a better underst edit
of the geological structure of the underlying ore body. Drill pads wiJ_1 be
located on existing roadways and skid trails. All resource disturbance
will be kept to a minimum. Surface disturbance will be rehabilitated when
drilling is complete. None of the drill pads will be located near or
adjacent to streams or water sources in this area.

PERFORMANCE RECLAMATION BOND

The route of access is by Forest Service Roads 23NOO and 23N28.2 by way of
. ...... Highway 70. Access through and over private property will be the
claimants responsibility to obtain. A Road Use Permit will be issued to
Pan Cana Minerals Inc. for F.S6 Roads 23NOO and 23N28.2, over which
drilling equipment will be transported.
F. DESCRIPTION OF OPERATIONS
Drilling operations, under this addendum to the Hornet Mine Plan of
Operations will be confined to the area referred to as areas A, B, and C
on Map #2 attached to and made part of this addendum.
Pan Cana Minerals Inc. intends to drill a total of six holes approximately
600 feet each, (two per site). The core samples will help give a better
understanding of the sites geological makeup. A bulldozer will be used to
construct a total of three drill pads to support a skid mounted drill rig

(one per site). Each drill pad will be approximately 15 to 20 feet
square. Access to Drill site B will require walking the buldozer a
distance of about 450 feet to construct the pad. Sites A and C are
located adjacent to roadways. Soil disturbance will be kept to a minimum.
No new.roads will need to be constructed.
A mixture of Bentonite and water will be recirculated and stored in two
skid mounted mud tanks. Disposal of waste mud will be at a location
acceptable to and approved by the Forest Service if on National Forest
Lands.
Reclamation will take place as each drilling operation is completed. Each
site will be reshaped and contoured to natural conditions found prior to
disturbance. Revegetation of disturbed areas will be by grass.seeding and
mulching. .
The roadways within the claim site will be waterbarred, graded, and
rebuilt as necessary to restore them back to their original condition as
found.
G. TEMPORARY OCCUPANCY
1. Holding tanks or other chemical toilets must be emptied at dump'
stations or at facilities designated for sanitary disposal of human
wastes.
2. Occupancy to be by tent, trailer or existing facilities during the
drilling period.
3 Occupancy by only the Claimant(s)/Oerator(s)'is hereby authorized.
Occupancy by any other individual(s3 not named in this addendum other
than the drilling crewmen is not authorized and shall not occur
without the express, prior written permission of the District Ranger.
Occupancy is defined as any one or more person(s) remaining on the
area of operation for more than forty-eight (48) hours.

I. PERIOD OF OPERATION
1. This operation will begin upon approval of this addendum, Road Use
Permit and Performance Bonds, and terminate on May 31, 1986•
J. ENVIRONMENTAL CONSTRAINTS
1. The operator shall pack out or otherwise remove from National Forest
land all unburnable refuse resulting from the operation under this
addendum. "
2. Storage facilities for materials capable of causing water pollution,
if accidentally discharged shall be located so as to prevent any
spillage into waters, or drainages that would result in harm to fish, .
wildlife or domestic water supplies.
3. All roads and drill pads will be properly drained. (The Forest
Service will designate on'the ground locations of drainage structures
such as waterbars and cross drains.) :..Erosion control structures will
be maintained on a day by day basis.
4. The utility road from Stony Creek to:the office, workshop, and
bunkhouse area will be closed for resource protection. An earth berm
will be constructed to impead traffic..flow at both ends of the road.
All other roads will be kept open.
5. Prior to using present water sources in the drilling operation,
__operator shall obtain all necessary documents necessary to acquire the
water rights.
6. All equipment shall remain 25 feet from any water source. To protect
water quality from fuel spillage, a dike with impervious materials
such as compacted clay soil shall be constructed around any containers
with fuel or oil.

K. REHABILITATION
1. Topsoil: Redistribution. After final grading and before the
replacement of topsoil, regraded land shall be treated as required to
eliminate slippage surfaces and to promote root penetration.

2. Topsoil shall be redistributed in a manner that achieves an
approximate uniform, stable thickness consistent with the postmining
land uses, slopes, and surface drainage system; prevents excess
compaction of the topsoil; and protects the topsoil from wind and
water erosion before and after it is seeded and planted.
3. All drill pads will be ripped after use and top soil replaced for
vegetative stabilization.
4. All distrubed areas will have grass seed applied as per page 2, in the
original Plan of Operations. Straw mulch will be applied at 2,500
lbs./acre.

Dear Mr.-Stromberg:
Numerous attempts were made to contact you on April 15, 16, 22,
and July 2, 1992. Certified mail sent to the address in Carson
City, Nevada, per your request, was returned as unclaimed.
Section 2207 of the Public Resources Code requires that you
submit to the Department of Conservation a reclamation plan,
proof of approval of -that plan, and any accompanying documents
for the Hornet Mine mining operation. The Department of
Conservation is concerned with gaining compliance with the
surface Mining and Reclamation Act (SMARA), rather than with
./ issuing fines or closing operations.
Responses to previous correspondence indicates that there is some
confusion onyour part regarding information required under
SMARA. The Proposed Fee Schedule and Financial Assurance -
Appeal Procedure Regulations, as well as the USFS Plan of
Operations, submitted by you are not lead agency approved
reclamation plans. Butte County is your lead agency, and a
reclamation plan must be submitted for their approval under
SMARA.
We will at this time accept a good -faith effort towards complying
with statute on your part. This is based on your agreement to
provide a realistic timetable for achieving compliance with,
SMARA.
As a measure of your good faith, we will need the following from
you within 30 days of your receipt of this letter:
1. A timetable for full reclamation plan (and permit)
compliance for the operation listed above. This should be
completed in cooperation with your lead agency, and should'
include, at a minimum:
• The date you will have complete permit and
reclamation plan applications on file with the lead
agency;

• The date financial assurances.will be in place.
Financial assurances for reclamation purposes were
required on January 1, 1992, and may take the form of
irrevocable letters of credit, trust funds, or bonds;
The date contracts are to be let for any California
Environmental Quality Act (CEQA) documents;
• The proposed date for contractor completion of*any
required CEQA documents, (Negative Declaration,
Notice's of.Preparation, Environmental Impact
Reports, etc.);
• The proposed date for County certification of any.
required CEQA'documents and for project approval;
• The name and phone number of the lead agency contact
with -whom you have been dealing; and,
• Any other milestone dates that you feel are
appropriate to include.
The proposed dates should be realistic and achievable, but,
the process should begin without undue delay. Again, the
County should be consulted with in arriving at these dates*.
.Z-' While.some slippage of the dates may be expected and
explained, a substantial failure to meet the projected dates
would necessarily be treated as a breach of good faith.
As you may be aware, the Department has the authority to impose.
fines of .up to $5,000 per day on mining operations which do not
comply with the law, and to close operations without approved
reclamation plans. My Office has authority to impose severe
penalties on those operations that continue to refuse at this
time to make a good -faith effort to comply. I am confident,
however, that operators, local governments, and the State can
work together to gain compliance with SMARA.
