The order of the documents are as follows: 1. The first 8.5x11 inch sheets are copied from Section 5 of the Butte County Airport Land Use Compatibility Plan adopted December 20, 2000. 2. The next three 11 x17 inch sheets are from the same document section, and are the: A. Airspace Plan providing approach and transitional elevation information. B. Planned Airport Vicinity Land Uses plan providing year 2000 proposed land uses. C. Compatibility Factors Map providing noise, overflight, safety, and airspace factors. 3. The last 11x17 inch sheet is the Oroville Airport Layout Plan with a corrected list of building occupants. These documents, and the Powerpoint presentation, will be used to assist the Commission in gathering and evaluating information and testimony for use in updating the CLUP. You are welcome to contact me prior to, during, or following the meeting. He stated that County and City land use actions have been consistent with the CLUP since 2000, and the County and building permit issuance has been consistent ,with the CLUP since 2000. + + Mr. Durling said he would like the Commission to make the findings; by motion. CLUP Review and Update Oroville Airport — Issues roundtable .by . ALUC board members, additional public input on Oroville Airport issues Mr. Durling gave a brief summary of the Power Point presentation and submitted a hard copy of the ' presentation to the Commission. • He noted that the Oroville CLUP' is being used by. staff and is ' -working. • He said he could not find any inconsistencies between the Oroville Airport CLUP and the ' . City of Oroville. He said the issue that was raised at the previous meeting was regarding open space. He said one of the questions is how to consolidate open space so -itis functional. -He said that in 2001 a a language change was made to page 5 of the Oroville section 5.1 and'Commissioner Sherman gave • him_ a copy.. He asked if the Commission had a copy. Commissioner Hennigan said the copy of the change in the introduction page of the Oroville CLUP was part of the December 2001 packet and was adopted and should be inserted into the CLUP. ' • ,Chairman Wallrich asked if ' staff had a list of who the CLUPs were sent to so they can be sent updates. a K. ' Mr. Baker. said there is always a problem with keeping that type of list. w Commissioner Hennigan said one of the changes that the Commission tried to reflect in 2001 was, that during the base period when the data for the Oroville Airport was done, the Airport rarely saw a business jet. He said at the time the CLUP was done there were one or two jets a month; at the time of the 2001 report there were one or two jets a week and now there are more. Chairman Wallrich rioted that there are things in the past that have fallen through the cracks and have not been done. Mr. Baker said that"any changes in the future to the 'CLUP will be reflected in the CLUPs that ate available.. • Commissioner Hennigan said that there have been several things on their -agenda that the Commission has agreed on, housekeeping matters that should be incorporated in the amendment to the CLUP. He asked if staff has a file with a list of items that need to be done. Mr. Baker said that the County needs to have a document that can be defended. He said it was his understanding that the process was that as the Commission.goes through the updates on each airport we are going to identify specific text 'and places that need to. be amended and then take those y amendments through the process. _ Commissioner Hennigan said ' that- the Commission directed staff that it was the Commission's intention to include the minor changes in the December 2003 CLUP update. He wanted to know if ' staff had a file with the changes listed in it. Mr. Baker reiterated that there is a formal process to be followed for amendments. He thought the formal process for amendments has to be followed. Chairman Wallrich said that items falling through the cracks are why the Commission decided to put items on the agenda and leave them there until they were resolved. ■ Airport Larid Use Commission ■ Minutes of Meeting of November 19, 2003'E Page.5 ■ u- t y +� ' + • Commissioner Hennigan again asked if there was an existing file -of the things to be ;changed that were to be approved at the December 2003 hearing. ' Commissioner Grierson said he was not aware of any changes to the CLUP pending to be voted on at i the December 2003. meeting. ` •,Mr. Baker said he would go back and, research what has or has- not occurred and make the amendments. He said the County wants a document that is defendable. - Commissioner Sherman said• as a procedural suggestion the Commission might want to make motions on things the Commission wants done so there is a record. - Commissioner Harp said there is a need for a file to keep track of changes throughout theyear so they don't get missed that can be voted on in December to amend the CLUP. Commissioner Rosene also suggested a folder for items they want 'to talk about later for possibler changes. . Commissioner: Harp said that review of applications sometimes bring up other questions to be clarified and this type of item should go in a "to do" file. Chairman Wallrich said that he reviewed previous minutes and found an action regarding updating the Standard Operative Procedures. He said staff should be'responsible for„these changes., He,said regarding the CLUP, which has only been adopted by the City of Oroville. He said he requested that, Mr. Siedler, with the City of Chico, be contacted to update the Commission on the City's adopting the CLUP. He said he talked to Mr. Siedler yesterday. He noted that the Paradise airport has been discussed in the minutes, with' the contact names of Mr. Rough and Mr. Franklin to be contacted, which to his knowledge has not been done.. Mr. Baker discussed what is happening in the City of Chico. He said he will be meeting with the City of Chico each Monday, and the issue is that the County is trying to align our processes with the City of Chico's process in terms of the areas of interest around the airport: ,Commissioner Rosene said he would like to keep moving forward as the Airport Land ' Use Commission. He said he is tired of hearing what will be done and nothing ever happens. Mr. Baker explained the General Plan update and time lines. Commissioner Rosene said historically things have not been accomplished. It was moved by Commissioner Hennigan, seconded by Commissioner • Harp, and unanimously ' carried directing staff to outline a procedure for the annual amendment of the CLUP to include the elements that both Jo and Bob explained. Commissioner Sherman's point was that the Commission• needs to be=very specific about their direction, make it in the form of a motion of intent. on all , changes the Commission wants included in the CLUP update. Commissioner Harp added that there • needs to be a formal process for keeping track of Plan changes and that a file be made that preserves those things that the Commission intend to do, and then in the fall of the year the Commission,will = ` s , need to follow all of the steps that are required by the Brown Act and the Airport Land Use Law and . all of the Codes so that the staff reports includes those time lines and the requirements of the statutes, - - - ■ -Airport Land Use Commission 0 Minutes of Meeting, of -November. 1 ,age 6 0. ' 4, i - ,� - � „• ..+- as 3,t - t � Chairman Wallrich discussed the • fact that there - have been staff -changes and said that the Commission has not established procedures in the past to keep track of proposed changes. ; Mr. Baker restated the above motion to state "that there be a procedure outline, for the annual update of the CLUP, that there be in fact Motions of Intent adopted along the way, and that a formal process - for keeping track of the amendments be 'established,-, and that in the fall of the year that a formal amendment be effected.- Commissioner ffected:Commissioner Harp amended the motion to 'see the list of proposed updates at every meeting in the folder. Mr. Durling gave a summary of the project, and handed out maps consisting of numbers corresponding to his power point presentation with a copy of the presentation. He listed the topics for discussion. Commissioner Sherman said there was approval of a Tentative Parcel Map in September for 65 units on 18 acres within the City of Oroville and it met the requirements of the CLUP. She discussed a possible future industrial parcel and infrastructures. She said the City does not put their applicants through a formal CLUP review process. She said that is one reason they adopted the CLUP, both to protect the airport, and also to provide a convenience for the applicants. She said through the environmental review process staff sends notices of the projects to the County Planning Division. Mr. Durling discussed storm water retention. He said the Commission might consider fog related items from large bodies of water. He asked for a critique of the presentation. Mr. Baker said efforts were made to notify the public of this meeting. Chairman Wallrich said the clustering and open space should be looked at during these review hearings. Commissioner Sherman said the City of Oroville is allowing open space requirements to be handled on a case by case bases. She said she could use some guidance from the Commission as to how large an area might be necessary for open space. Commissioner Grierson discussed the amount of land needed for a controlled crash site. Commissioner Sherman said the open space policies would be hard to define. Brief discussion. She stated that street trees and light poles can be a problem. Mr. Durling discussed alternative lighting on residential streets. He mentioned doing building and parking lot orientation so that the buildings were rectangle instead of square. He said an alternative for storm water retention is underground oversized piping to store water in the pipes. Commissioner Grierson asked how advance our GIS system was and could it produce a map showing the areas of potential incompatible development and another map with the possible in -fill sites. Commissioner Sherman said she looked at the infill criteria for a couple of projects and found that the density within the B2 zone is practically nil. She said there are not many areas within the C zone that will have any density either. She said in terms of incompatible uses she was not familiar with what might be within the C zone that is not in the city, but within the B zone, most of which is in the City of Oroville, there are one or two single family residences in the manufacturing zones. She did not think there was any remarkable nonconforming use, at least up to the B2 zones. 0 Airport Land Use Commission 0 Minutes of Meeting of October 15, 2003 ■ Page 8 0 Commissioner Grierson said the physical configuration of the airports is going to be constantly evolving. He said development adjacent to airports happens rapidly and most people do not know what is happing next to the airports and a map would help. Mr. Baker said the GIS section can do the map they are requesting. He said it looks like staff needs to get the Commission a list of what applications have occurred in the past year within the various zones, and also the number of building permits that have been issued stating type, residential, or commercial, by airport zones. He said staff will look at identifying incompatible development and infill sites on the GIS map. Commissioner Grierson asked how many noise complaints were received last year. Mr. Durling said the Oroville Airport Operations Manager said he had one complaint which was a repeat complaint by the same person. Chairman Wallrich said the number of complaints against an airport is a measure of how successful ALUC has been. Mr. Durling discussed ultra lights and how they are not regulated. He said ultra lights are a source of complaints. Commissioner Grierson said that the ultra light planes are a big problem and a very lightly regulated industry. He said people can not get insurance for ultra lights. Commissioner Hennigan said that Oroville has been very business -like concerning their airport and the City made a policy that they want to protect their airport. He said the CLUP is a living document that will remain useful and in use. He said the Commission needs to know what changes there have been at the airport, what is changing in the environment of the airport, and if there is any indication that the Commission's planning has been successful in preventing conflicts or not. He said noise complaints are a pretty good barometer of success. He said they need to know what is changing at the airport and around the airport, and if the airports and the communities are still getting along. Commissioner Sherman said one of the reasons she expressed concern related to the subdivision in Chico is than there is a problem if the company exceeds 100 employees per acre on a single shift. She said the market is limited. Chairman Wallrich asked if the County is in line with the airports as far as density issues are concerned. Mr. Baker discussed precautions against large casualties in case of an accident. Mr. Durling discussed things done in the past, i.e., berms, trees, etc. He said there are techniques that can be used to decrease the risk. Commissioner Hennigan said he would be sympathetic to measures that attempt to mitigate the problems. ■ Airport Land Use Commission ■ Minutes of Meeting of October 15, 2003 ■ Page 9 ■ Commissioner Baldridge said he likes the concept of long thin buildings. Commissioner Sherman said that Oroville has not had any complaints, but they need to look to the future. Mr. Baker said they need to understand what the risks are and to identify. mitigation measures. He said staff will look at what is going on around the airport and will report on that next time. He said at the next meeting they will also look at some of the alternatives regarding the incompatible areas and infill areas. He said he and staff would talk to the GIS people and try to get a graphic that shows the areas, figure out the noise complaints and focus on what has happened on adjoining development, and provide the Commission with numbers in terms of permits, by district and by zone, and also what has happened in terms of number of applications and lots that have been approved around the area by zone over the past year. Chairman Wallrich complimented Mr. Durling on his presentation. He said the Commission will probably review annually any future concerns. Mr. Durling said they are talking about two different boxes, a policy box that is for the airport, and a box for issues raised that are general policies County wide that affect all airports. Commissioner Hennigan said that the University of California Institution of Transportation Studies did the accident scatter that is the basis for most all of safety planning. He .said the Institution has published a new accident scatter, and he said the County needs to think in terms of applying the new accident scatter pattern. He said this is an example in the change of the art or thinking. Chairman Wallrich said that clustering is not a concern in Oroville, but is something as they move forward with other airports, it is something the Commission will want to address. Commissioner Hennigan said there has been discussion about clustering being a mitigation, and maybe it would be appropriate at this point to suggest to staff that they make clustering one of the possible mitigations. Mr. Baker discussed the process explaining how the planners will interact with each other. The hearing was opened to the public. Fred Gerst said that one of his concerns is on the open space and how they are going to determine the size of the open space. He said the least that an average airplane could descend would be 10 feet for 1 foot. Brief discussion on how much area it takes to land, 500 versus 1000 feet. Commissioner Hennigan said he has talked about needing 1,000 feet for open space. Mr. Gerst discussed who would maintain the open space and what would be allowed in this open space. He said they need to cut down on development to allow sufficient open space in case of an accident. Chairman Wallrich agreed that the open space area is a concern. ■ Airport Land Use Commission ■ Minutes of Meeting of October 15, 2003 ■ Page 10 ■ Commissioner Sherman said that 75' x 300' is what was adopted in the Oroville CLUP. She noted that clustering is not what the realtors or public is looking to do. Commissioner Hennigan said he has seen clustering work on a frontage area such as a golf course or a lake. Mr. Baker talked about obtaining open space. Commissioner Sherman asked how they can configure open space and can they accept occasional gathering of open space and use it as a park. She said her concern for a storm water retention facility, is how much they can be allowed to excavate. She discussed the wildlife area in Oroville and area as being a viable area to land a plane. Chairman Wallrich said the Commission needs to keep thinking about open space. This type of periodic review is required on all county airports, under the Comprehensive Land Use Plan (CLUP) and the regulations governing this Commission by the State of California. It is purpose and desire of the ALUC that all public airports within Butte County remain viable to its citizens and the business community, which rely on these facilities for a variety of services. This review was completed by Mr. Carl Durling, Associate Planner under the supervision of Mr. Joe Baker, Planning Manager for Butte County. The Commission found this review to be complete and very comprehensive as it relates to the Airport and the surrounding area. We thank both of these gentlemen for a job well done! As indicated, the Commission found that land uses approved within the Airport Compatibility Zones surrounding the Airport, between the adoption of the CLUP in December 2000 and the present are consistent with the provisions of said document. Land Use Review and Evaluation • The following task were accomplished to evaluate land use compatibility: o All building permits issued between January 2000 and October 2003, both City and County were identified. All were determined to be in conformance with the CLUP. o All parcel maps for the same period were evaluated and found consistent with the CLUP. o All subdivisions maps for the same period were evaluated and found consistent with the CLUP. • 2. Public Comment,and Input ; 5 Background Data: Oroville Municipal Airport INTRODUCTION Oroville Municipal Airport is situated within an extension of the Oroville city limits some 2.5 miles west of the remainder of the city. Although the city's sphere of influence extends'a mile west of the airport, only the airport property and some private land to the north and west are currently within the city boundary. The surrounding unincorporated area includes the community of Thermalito situ- ated northeast of the airport. To the southwest and southeast, lie state-owned water project and wildlife refuge lands. An airport has existed on the present site since 1936 when the City of Oroville acquired the original 188 acres. During World War II, the U.S. Army took temporary control of the airport: The Army made various improvements including establishing the basic runway configuration which remains today. The facility reverted to the city in 1947. In the subsequent half century of owning and oper- ating the airport, the city has acquired additional land and made numerous improvements to the fa- cilities. Among the many changes, the recent project which extended and shifted the primary run- way to the southwest has been the most significant from an off -airport land use compatibility per- spective. The airport's historically moderate activity levels, together with the extensive agricultural and open space lands in the surrounding area, have kept compatibility conflicts to a minimum.
