(BBA) has completed an analysis of aircraft/airport operations and related noise levels for the Paradise Airport. The analysis has been conducted for the preparation of future year (2005) Community Noise Equivalent Level (CNEL)' noise exposure maps for the Paradise Airport operations. The Federal Aviation Administration's (FAA) Integrated Noise Model (INM) Version 5.01 was used. to prepare CNEL noise exposure maps for the Paradise Airport based upon the FAA noise level data for single engine and twin engine aircraft, and airport operational factors as described below. The INM was developed for the FAA, and represents the federally -sanctioned and preferred method for analyzing aircraft/airport noise exposure. Version 5.01 is the currently -available version of the INM, incorporating an updated data base of aircraft performance parameters and noise levels. Projected data for aircraft activity, aircraft fleet mix and airport configuration used in the noise modeling process were obtained from the most recent (1988) California Aviation System Plan (CASP), and discussions with the Paradise Airport officials. The following report summarizes the data, methods and assumptions used in preparing the CNEL noise exposure maps. The; noise descriptor used by the FAA is the Day -Night Average Level (LdJ. The FAA uses the Day -Night Average Level to describe land use compatibility with respect to aircraft noise exposures. The FAA airport noise compatibility criterion for residential land uses is 65 dB Ldp. The California Department of Transportation Division of Aeronautics uses the 65 dB CNEL descriptor to describe residential land use compatibility with respect to aircraft noise exposures. Generally, the predicted Ld„ and CNEL values agree within 1 dB of one another. The CNEL descriptor is a method of averaging single event noise levels over a typical 24-hour day, applying penalties to noise events occurring during the evening (7 p.m. to 10 p.m.) hours, and nighttime (10 p.m. to 7 a.m.) hours. CNEL is usually defined in terms of annual average conditions, so that the CNEL measured on a given day .may be either less than or greater than the annual average. 1. For an explanation of terms used in this report, see Appendix A. 1 AIRPORT OPERATIONS: Airport operational factors which can significantly affect overall noise levels as described by CNEL include the aircraft fleet mix, the number of daily operations and the time of day when aircraft operations occur. ' Runway use factors `also significantly influence CNEL values. Trip length can affect aircraft single event noise levels, as an aircraft which is prepared for a long flight may carry more fuel'and passengers than for a short flight. The INM applies corrections to air carrier aircraft takeoff profiles to account for these differences, but makes no corrections to general aviation aircraft takeoff profiles. M Aircraft operational assumptions for Paradise Airport are based upon analyses of airport activity provided in the CASP:and discussions with the Paradise Airport officials. Based upon these data, BBA prepared generalized flight tracks for use in the noise modeling process. to describe areas with a concentration of aircraft overflights. Figure 1 shows the flight tracks used for the noise modeling process. i . -' 3 • Y PREPARATION OF CNEL NOISE EXPOSURE MAPS: As discussed earlier in, this report, the Integrated Noise Model (MM) Version 5.01 was used to prepare CNEL noise exposure maps for the airport, based upon the aircraft rioise level and airport operational factors described in the previous sections. The INM was developed for the FAA, and represents the federally -sanctioned and preferred method for analyzing aircraft/airport noise exposure. Version 5.01 is the most recent version of the INM, incorporating an updated data base of aircraft performance parameters and noise levels.. The INM calculates aircraft noise exposure by mathematically combining aircraft noise levels and airport operational -factors at a series of points within a cartesian coordinate system which defines. the location of airport runways and aircraft flight tracks. User inputs 'to the INM include the , following. a. Airport altitude and mean temperature _'b. Runway configuration c. Aircraft flight track definition d. Aircraft stage length e. Aircraft departure and approach profiles f. Aircraft traffic volume and fleet mix g.` Flight track utilization by aircraft types The INM data base includes aircraft performance parameters and noise level data for aircraft classes. When the user specifies a particular aircraft class from the INM data base, the model automatically provides the necessary inputs concerning aircraft power settings, speed, departure profile and noise levels. INM default values were used for all fixed -wing aircraft types. After the model had been prepared'for the aircraft classes described in the preceding section, BBA created INM input files containing the number of operations by aircraft class, time of day and flight track for annual average day aircraft operations for the year 2005. The INM was used with these operational scenarios to prepare 55, 60 and 65. dB CNEL contours, which have been plotted on Figure 2. Total surface areas included in each of these CNEL contours are shown by Table III. TABLE III . SURFACE AREAS WITHIN CNEL CONTOURS Paradise Airport Area, Square Miles Scenario 55 dB 60 dB 65 dB 2005 0.16 0.06 0.02 The ' shapes of the CNEL contours are generated by the INM in response to the directional characteristics of aircraft noise, while the size of the contours is affected by the number of aircraft operations and the noise emissions of the types of aircraft in the aircraft fleet. Predominant aircraft arrivals and departures are to and from the south. Based upon discussions with the Paradise Airport staff, approximately 5 percent of all arrivals are from the north along runway 17, and approximately 1 percent of departures are to the north along runway 35. ACOUSTICAL TERMINOLOGY AMBIENT NOISE The composite of noise from all sources near and far. . In this LEVEL: - context, the ambient noise level constitutes the normal or existing level of environmental noise a given location. CNEL: Community Noise Equivalent Level. The average equivalent sound, level during a 24-hour day, obtained after addition of approximately five decibels to sound levels in the evening from 7:00 p.m. to 10:00 p.m. and ten decibels to sound levels in the night before 7:00 a.m. and after 10:00 p.m. DECIBEL, dB: A unit for describing the amplitude of sound, equal to 20 times the logarithm to' the base 10 of the ratio of the reference pressure, which is 20 micropascals (20 micronewtons per square meter). Ldn: ; Day-Night Average Sound Level. The .average equivalent sound level during a 24-hour .day, obtained I after addition of ten decibels to sound levels in the night after 10:00 p.m. and. before 7:00 a.m. Ley: Equivalent Sound ' Level. The sound level containing the same total energy as a time varying signal over a given sample period. L,,q is typically computed over 1, 8 and 24-hour sample periods.' Note: CNEL and Ldp represent daily levels of noise exposure averaged on an annual basis, while Ley represents the average noise exposure for a shorter time period, typically one hour. The maximum sound level recorded during a noise 'event. SOUND LEVEL: The sound pressure level in decibels as measured on a sound level meter using the A -weighting . filter _network. In general, the Paradise Skypar-k Airport may be described as a safe airport because the past accident record is entirely free of incidents 1nv'81ving the public or -the pub lic welfare. In addition, structures do not now Intrude into .the air space requirement of the airport and no future problem with height'.restrictions is foreseen. Airport noise policy was adopted to assure that'.new.land'.uses in airport environs are compatible with aircraft generated noise., In general,.Iand uses external to airport boundaries are compatible with the airport from the,perspective of safety. To minimize loss of life in the event of an accident, criteria are set and policies adopted to limit concentration of population in clear and approach zones of airports. Criteria and policy are.the most stringent in'airport clear zones just off the end of runways where residential -development is prohibited and -permitted uses are limited to activities such as equipment'stor'age yards which require few people in their operation. Restrictions on permitted uses.are also set for airport approach zones including.limits on population densities in all uses and on residential uses within 1 mile of the runway end. Within the.approach zone; the area within 1 mile of the end of the 'runway is subject to greater` restrictions than the remaining area. All development within clear and approach zones of airports will be reviewed on a case-by-case basis by the ALUC. Development in the general airport.traffic pattern which results in large concentrations of people will also be subject to review' by the ALUC. 9 _ . F Vit'. Page 2 y Chapter 1 CRITERIA FOR AIRPORT LAND. -USE PLANNING Introduction The objective of the Paradise Skypark Airport Land Use Plan is to promote the orderly development of,the.Par-ad.ise Skypark Airport and the area surrounding the airport in a.manner which: 1. Safeguards the general. welfare .of the inhabitants in such areas, 2.. Assures the safety of.air navigation, 3. -Ma.intains the utility of the airport. Three general areas of concern are',building height restriction, safety, and aircraft noise. This chapter examines each area along with the legal basis for defining the extent of the problem and actions which may mitigate the problems. Building Height Restriction Tall structures in areas near'airport.including areas where aircraft`may be, in the airport traffic pattern preparing to land or subsequent to takeoff, present a, hazard to aircraft. Federal aviation regulations require aircraft to maintain minimum altitudes -above structures whi'le., not in the airport traffic pattern. .Thus, unless near airports, the burden of maintaining vertical separation rests upon the aircraft pilot. In the vicinity of airports, however, aircraft must descend to low altitudes to enter :into the traffic,pattei^n and approach the ground, prior to landing. A similar situation exists after takeoff in which the aircraft must attain:safe operating altitude while safely following a' traffic pattern out ofthe airport area. 'Thus building height restrictions in airport areas must exist to allow necessary low altitude operations with an ample safety margin., Federal Aviation Administration.(FAA), Federal Aviation Regulations (FAR),Part 77 "Objects affecting navigable air space" sets forth criteria for preservation of'navi.gable air space in the area of airport traffic patterns. Obstruction standards and procedure for notification of the FAA prior.to construction or alteration of an existing or potential obstruction to navigable air space are included within FAR, Part 77. , Butte County, in cooperation with the Town of Paradise, may adopt zoning ordinances which include airport approach zone overlays that apply more rigorous standards than generally, imposed by FAR, Part,77. Safety Land use restrictions' in the'vicinity of the airport are designed to minimize the potential tragedy of an aircraft crash. While the Paradise Skypark Airport has experienced no crashes involving the public or scheduled air carriers in recent years, the possibility exists. Approximately 50 percent of civilian aircraft accidents occur within airport boundaries. 'Approximately 15 percent occur outside airport Page 3. boundaries and within 1 mile of airports. Of these near airport . 'accidents, approximately 60 percent are concentrated within narrow strips of land at both ends of the runway.1/ Thus, land uses 16 these areas should be used in which loss of life and property will be minimized and which will pose as small an additional "-hazard as possible to an aircraft's occupants in the event of an accident. h Certain land uses and activities within the approach and clear zones which extend from the end of the runways may distract or cause confusion to t"hAe pilots of landing aircraft and thus may'add materially to the -.hazards within this area and therefore should,be avoided. They ,include: Any use which .would direct a steady light or flashing light of white, red, green or amber col -or toward an.aircraft engaged in an initial -straight climb following takeoff or toward an aircraft engaged in a straight final approach toward a landing at an+airport other than an FAA approved navigational signal light or visual approach slope indicator (Vasi). Any use -which would cause sunlight to be,reflected toward.an aircraft engaged in an.initial straight cl-imb following takeoff or .toward an aircraft engaged in -a straight final approach toward a landing at an airport`.. Any use which would generate smoke or which could attract large concentrations of birds or which may otherwise affect safe air navigation within this area. Any use which would generate electrical interference that may -be detrimental- to the operation of aircraft`6nd/or airport 'instrumentation. Other land uses which are not compatible from a'safety standpoint within approach and clear zones,' or any uses which create concentrations of people in the airport area of influence, particularly the young, elderly or infirmed. (Chapters 2 and 3 delineate specific land uses which are not compatible.and the specific area in which such incompatibility occurs for the.Paradise .Skypark Airport.) In addition to the land use issue, there is a concern about the ability of public safety agencies to effectively'deal with emergencies within clear zone'properties. 'This requires careful attention to emergency services for individual parcels. Examples of.potential issues, include .-location and concentration of fire hydrants, water availability, and s-ite.and building access.2/ 1/"Aircraft-accidents in the vicinity of airports." Page 4 Airport.Noise Noise is defined as unwanted or objectionable -sound. Airport noise is. the sound of aircraft taxiing, taking off, landing, or flying in the airport.traffic pattern or aircraft engines being run up for maintenance, testing or pre -takeoff checks..' Airport noi:se'presents a continual, problem to.many people around airports unlike the incipient probiem•of"airport safety. Aircraft noise may render some•land uses such -as outdoor assemblies impossible. It may disrupt school and work activities. At lower levels it may interfere with,privacy and sleep; and increasingly,. medical opinion is that -it contributes to poor health. Noise Properties and Measurement' Sound is.a form of energy detectable by the human hearing system. It is commonly produced when some object is set into vibration. The vibration -is transmitted.to any surrounding media,`such as air, causing pressure variations. -or "sound waves" among.ai-r particles. These waves spread out from the source, and along"their'paths the waves can reflect off - surfaces, they can -bend -around obstacles, and they can be absorbed by insulative materials. Measurement of sound involves three variables: magnitude, frequency, and duration. Magnitude of variation in air,pressure results 'in the "loudness" of sound. Magni:tude,is expressed.in deci•be"ls (dB) which.are logarithmic ratios comparing measured sound pressure to a referenced pressure. Thus a "loudness" of 70',dB is ten times the sound pressure of'60 dB and twice the sound..pressure "of- 67'dB. An, apparentl y smal -1 . increase in number of decibels can%actually represent a significant increase in sound pressure Frequency refers to the number of times per second the object which produces the sound vibrates. Within the audible ranges,,.subjective response to pitch"varies. People generally find higher.frequency•sounds more annoying. Thus, people may complain more vigorously about a high - frequency but relative low magnitude jet or,turbo prop aircraft noise than lower frequency, sound,of the same or greater magnitude from other sources. Duration is -the length of time a.noise_.lasts. Noise induced hearing foss is directly related to magnitude, frequency content, and duration of noise exposure. To adequately describe a'noise environ., it -is necessary to quantify the variation in noise level over time. An energy equivalent sound level, in which the amount of acoustical energy composed of magnitude and duration for each individual noise is summed, is the basis for the -day/night sound level (LDN),-which is the quantification method being "adopted for use in airport noise legislation in California. x Page 5 Noise'in a residential or other noise -sensitive setting is often more bothersome,at night than during daytime. For LDN calculations, the day is.divided into time periods with the following weightings. Day/N'inht Sound Level The day/night sound level is a•measure of the noise environment at a prescribed point over a 24-hour period. It is the,24-hour A -weighted equivalent.level with a 10dB`wei9hti6g applied to nighttime levels. Noise Exposure Contours Noise exposure contours are the mapped expression of points subject to equal average noise level, analagous to topographic.contours. •Noise contours may be drawn with respect to any noise measures; for airport land use planning, LDN contours are used. Noise contours attempt to refer only to airport noise and aircraft in the traffic pattern as noise sources; although multiple sources such as railroad tracks or 'freeways in combination with airports increase actual noise level in some areas. Airport Noise Lenislation Land use and building insulation standards within this plan are'based on legal guidelines. Specific planning boundaries in areas in which they apply are contained within Chapter 3. Public Utility Code, State of California. Section 21675 . This section mandates formation of this airport land use*plan and creation of an airport area of influence for, the airport. The plan "may specify use of land, may develop building standards, including soundproofing adjacent to airports, within the planning area".' Noise Exposure Control Measures Control of exposure -to airport related noise is complex. 'It may involve a hierarchy of measures ranging from noise suppression at the source to purchase of noise impacted land by airports. The ALUC's role in control of exposure to airport noise is limited by the California statute. It includes: Compatible u'se zoninca which permits only non -noise sensitive uses in noise impacted areas can prevent future incompatibilities The airport benefits by not becoming cramped by encroaching -neighborhood development; the community benefits.by mai"ntaining a comfortable environment for its residents. This is usually the best way to avoid having airport noise impactundeveloped property. Implementation responsibilities rest with the local zoning -Jurisdiction, though the 7 V Page 6 11 t . ALUC may-require adoption of compatible zoning'through,the Airport Land . Use Plan (ALUP) . Buildin4 code provisions insure that.new construction will'incorporate adequate-sound insulation.to keep.inter,i.orI noise'to,,,acceptab'le levels,. A major shortcoming of this-approach is that even with.the hiighest level o'f ,acoustical insulation, attenuation .,,o f. more than 5 to 10 dB' is " ' impossible..if,windows are opened.even a few inches' for ventilation.•. Implementation rests with the local zoni.ng.jur.isdiction,ttiough the ALUC may require compliance, f i Page .7 a ' . Chapter 2 GUIDELINES FOR LAPID USE Airports are significantly affected by and in turn affect adjacent land users. Structure heights and extent can present obstruction in the airport vicinity which are hazardous to aircraft as well as structure occupants. Population concentrations present an aircraft noise exposure and'safety hazard which may,'result in complaints and restriction of a airport operations. Some type of commercial and industrial uses, however, presenting a low building profile, high construction standards and low population densities represent compatible land uses having little effect upon airport operations. Such compatible uses can, in fact, support and complement airport operations. A'balance between airport contiguous land uses and airport operations is a critical -issue in airport and community planning. With the exception of open air assemblies, residential and certain institutional developments, most land uses are compatible with airport operations from a noise standpoint. The Public Utilities Code 1/ gives the Airport Land Use Commission the power "to.assist local agencies in insuring compatible land uses in the vicinity of existing airports to the extent that the land in the vicinity of such airports is not already devoted to incompatible uses". The ALUC must design a proscriptive land use plan for airport environs such that'land uses incompatible with the airport arenot permitted, but maximum discretion is left. -to local jurisdictions to plan land uses for local needs. This chapter pro "vides very broad airport land use guidelines.2/ Within Chapter 3 are parcel specific recommendations for the areas surrounding the Paradise Skypark Airport'... Various land uses have been evaluated and their suitability as airport contiguous land uses are summarized below. Natural uses are compatible with aircraft noise to the extent airport operations are not affected. However, flood and swamp areas may be associated with low visibility or ground fog. Flooding, ponds, swamps, and game and fish preserves may cause a bird hazard. Agricultural uses are compatible with aircraft noise with a few exceptions. Grain and seed crops may.attract birds which may endanger aircraft. ilghways and railroads are good uses except when close to the runway end. were vehicles may intrude into -clear zone air space requirements and motorists may be distracted by low-flying'ai✓rcraft.3 Recreational areas generally are good land uses around an airport. The following are examples of exceptions because of noise exposure and the hazard involved in a large concentration of people in the open. 1. Playgrounds - marginal,. avoid in approach zones 2. Athletic Fields - marginal.in airport zones 3. Outdoor Theaters - poor in airport zones'" 4. Fairgrounds and'Race.Tracks - poor in airport zones No.recreational.use.isappropriate in a runway clear zone. Municipal -Utilities are compatible as far as noise is concerned but the following may present obstructions -or hazards: 1. Gas and oil facilities including above -ground pipelines and, storage facilities marginal under approach zone surfaces 2. Electrical plants marginal under approach,zone surfaces 3. Power lines poor under approach zone surfaces, In additi.on,.trash dumps and incinerators may create a smoke problem and garbage dumps attract birds. Commercial uses, -restaurants; shopping centers, office buildings, public buildings, banks, gasoline stations, hotels, motels and theaters are generally good uses on.an-airport or adjacent to it.but should incorporate sound insulation in buildings for .internal livability. None of these should be constructed in airport clear zones and depend.ing upon location may be inappropriate in an airport approach zone. Industrial uses are 'acceptable except -for those that produce smoke, electronic interference,, or misleading lights. Sound conditioning of structures may be required to reduce exterior noise to acceptable levels for internal operations. Some industries cannot be located near airports because noise and vibrations interfere with delicate instruments. Residential and certain institutional uses are considered poor adjacent to,airport areas -and particularly under the approach zones,because of both noise and hazard. Acoustical treatment will reduce noise -in the buildings but it will not reduce noise during outdoor activities. Page 9 0 r -., Chapter 3 _ PLANNING BOUNDARIES AND AIRPORT AREAS OF INFLUENCE . Introduction The California Public Utilities Code specifies that airport land'use commissions shall determine planning boundaries around each public and - military airport within their jurisdictions. This chapter sets forth criteria in establishing these boundaries. The encompassed area is.. referred -to as the airport area of influence. ' r . The precise methodology for determining planning boundaries is not set forth'in the legislation. Determination of planning boundaries is dependent upon the 20 year forecast of airport operations and aircraft tmix. Anticipated physical development of the airport is shown on the adopted airport master plan and local airport traffic patterns including anticipated approach and departure proceedings. The methodology for establishing airport planning boundaries for the Paradise Skypark Airport is laid out in this chapter. As unanticipated changes in airport operations and/or physical development affect cont,iguous,lands,. , the airport's specific land use plans will require updating. ,. Exhibit 1-A portrays the Paradise Skypark Airport area of influence divided into areas of major concern: height restriction, safety, and noise. Within Zone 1, policies regarding height restrictions apply; within Zone 2, policies regarding safety as well as height apply; within:. Zone 3, policies regarding noise, safety, and height apply. General guidelines for ALUC policy within each zone are detailed below. Zone 1 - airport height restriction area. This most extensive zone defines the air space requirement'of an airport. It is defined in accordance with the Federal Aviation Regulation (FAR), Part 77. The aerial extent of the horizontal plane depends on the size, configuration and category of the airport. The boundaries of the Paradise Skypark-Airport height restriction areas are depicted on Exhibits 1-8 and 1-C. Generally, Zone 1 height limits pose no hardship to any exi:sting,or expected land uses near the Paradise Skypark Airport.- Zone,2 - airport safety area. Within Zorie 2 safety restrictions,' as well -as height limitations, are to be considered. Its boundary conforms to the outer limit of the Horizontal surface t•depicted in Exhibit 1=A... The length of the clear zone for Paradise.Skypark Airport'extends from the runway's end to: Runway ,17 1000 feet Runway 35 - 1000 feet Butte.County in conjunction with the -Town of Paradise should begin negotiations with landowners who presently own land in each of the Paradise Skypark Airport clear zones to either purchase this land, trade the government for that land located in the -clear zone, or acquire C2 avigation easements. Safety Area 2 (Approach Zone) L This, -zone is an extension of the -clear zone' in which uses which do not result in,the concentration of people or particular fire hazard are generally allowed. Height restrictions in,the approach zone.are more. severe than in -other zones except the clear zone and must be absolutely enforced. The length and width of Safety Area_2 (approach zone) for each runway at the Paradise Skypark Airport extends from `the runway's end to: Runway, 17'- length,- 4000 feet .,, width, 1250 feet Runway- 35 - length, 4000 'feet width, 1250 feet Safety Area 3 (Overflight Zone) This most extensive area defines the.air.'space'requir•ement of an. airport.. It is defined in accordance.with the Federal Aviation .Regulation-(F.AR), Part -77. The'aer.ial, extent of the horizontal plane depends on the size, configuration: and_ category of. thie,a i r`port.. Traffic patterns vary due to 1. -Runway-.configurations 2. Prevailing winds 3. Topography 4., Population concentrations 5. .Noise abatement procedures'... Page 14, Portions of the general safety area of any.airport are frequently overflown and others are infrequently overflown. Land use safety recommendations -for this area must -be more'airport-specific.than recommendations for clear and safety zones. Airport .Noise Area' Within this zone land use will be .influenced by airport noise as well as height restrictions and safety. The boundary of*this'zone is determined by using the United States Department of Transportation Noise Standard which sets forththeday/night sound level contour (LDN).• Exhibit 1-A depicts Paradise Skypark Airport 55dB'LDN contour State regulations establish as a general standard that residential uses including mobile homes; schools, hospitals, institutional uses and other, uses that are a basis for large concentration -of people are incompatible with noise levels above 550B LDN. Airport owners and operators are.now considered responsible for noise problems which existing land uses experience from airport operations although local_`. "governments', pilots, and -the Department of Transportation work cooperatively to diminish noise. It is in the noise zone that most airport P potential problems will occur unless future land use deci'sion.s are subject'to,careful controls. Since Dave Feiler purchased the airport, he, has made vast improvements to the.facilities to the point that he is now encroaching onto my property with proposed clear zones. This type of encroachment would make my property worthless.to anyone except the airport and its owner. It is unclear to me whether or not the county can exercise the power of Eminent:Domain in this particular situation due to the Paradise.Skypark being a privately owned, public use airport. This parcel, as near as we are able to ascertain, lies on the boundary line between the clear zone and approach zone to the North of the Paradise Skypark runway. This property is where our personal residence is now located and, therefore; we are greatly concerned with any rules or regulations with respect to the operation of the Paradise Skypark Airport. In this regard, we have specific concerns regarding the following: 1. The limitations the•proposed recommendations would put 'on any future development of our property. It would appear that they recommend that, to the extent any of our property is located in the•clear zone,- we would not be able to divide our property for`the purpose of an additional residence. 2. The lack of limitations placed on airport activity which would mitigate the noise and safety dangers that exist as to existing housing within the clear and approach zone., 3. The economic impact on,property owners' within the clear and approach zones by the imposition of the highly restrictive•limitations on use of those properties as outlined. The State permit lists the runway at 1900 feet while the enclosed'copy of the United States Geological:' Survey dated 1970 shows the runwa .being 2981 feet. In reviewing the use permit from Butte County dated May 2;;1960 there is no limit on the runway length. _ As per' our conversation you said in these situations the County would defer to, the,P. State ermit a 1 unless it.was shown that the runway was longer; or I assume longer at some time before.the State determined the length. FIt is important to remember that in the beginning this was a dirt stripe, and the surface improvements were done over manyyears. I also understand -that forthis type of .`airport at this elevation and,type ofclimate'the standard length,would;be 3050 feet. ' . Obviously the State permit must be revised and to do so the State feels that must start.witti the County. This item was tabled until Mr. Brown arrived. 2. Revision of Butte County Airport Land Use Commission Bylaws. Commissioner Lambert suggested we leave second Vice Chairperson, in Article III, Section I. Section I add criteria for choosing a Chairperson and a Vice Chairperson and 2nd Vice Chairperson. 2.. 2nd Vice Chairperson moves to first Vice Chairperson and new 2nd Vice Chairperson is selected. Going back to the way it was originally. Chairperson Rossas suggested adding an "s" to Vice Chairperson in the last sentence Section 4. Commissioner Gerst, Commissioner Lambert, and Chairperson Rossas suggested on Section 6, it read "Alternate members appointed according to Public Utilities Code, may hold Chair only if they actively served as a voting member for at least 1 year. Commissioner Crotts asked if there shouldn't be a'definition of "Alternates". Staff mentioned a reference to the. Public Utilities Code, "Alternates appointed pursuant to Public Utilities Code section..........." Article V. Section 1. was to be changed to delete "in the Board of Supervisors' Room". Staff noted this should be at the bottom of the page. 2 BUTTE COUNTY AIRPORT LAND USE COMMISSION MINUTES - December 9, 1992 - Staff said there wold be a corrected version of the Bylaws at the next meeting. *********************************** 1 Reguest Butte County Association of Governments (BCAG) Staff noted there were two airports that would qualify for funding under the new bill. At this time Mr. Jim Brown was introduced as the Transportation Planning Consultant. Mr. Brown said to include a project such as the Commission is discussing in the transportation improvement program, the project needs to be clearly identified, as to the scope of the project. An applicant agency needs to be identified, i.e. Butte County. Also the amount of funding required to complete the project. The source of the funding, including both state and local funds to match. The year anticipated for construction of the project, or acquisition of the land that was requested. The adopted transportation improvement program for Butte County, in terms 'of airport projects, only has projects listed on it that are from the city of Oroville for the Oroville airport. The city of Chico for it's airport, has chosen not to pursue aviation funds thru the state of California, because of the nature of the funds, and the lack of funds on a regular basis. There is an adopted project list which would require Butte County advising Butte County Association of Governments they have a project that they would like included in the transportation improvement program. After the specifications are layed out, Butte County Association of Governments would approve that project. What is normally done in the plan, is to rank the projects in priority order. Where there are several types of road funding, there are different project lists, such as state local street and road system, etc. However, with new source of funds, a determination of whether this would be separate from the Oroville airport.needs to be determined before requesting action by Butte County Association of Governments. The people from the State want these applications for these projects to be received by about February 1st, or close to that date. Depending on the Board of Supervisors agreement to be an applicant agency, to identify the specifics of the project, the amount of funds required, and the source of the local matching funds this may or may not be an achievable deadline. Further discussion indicated there is a window for this current funding cycle of funds that are available for this new source of airport revenue for private airports. .The next window for that is approximately 2 years from now and the funds for this cycle would be 93 - 94 fiscal year. The next cycle would 3 BUTTE'COUNTY AIRPORT LAND USE COMMISSION MINUTES - December 9, 1992 - be for 95-96 fiscal year. There is not a lot of money in this account, and it will be very competitive. Approximately $ 1 million will be available in each funding period, for these types of projects. With a maximum amount of $500,000 for these types of projects. The average of projects being funded is approximately $200,000. There may be five, or six projects each cycle, and therefore might be approved. It was also indicated this legislation was also developed for a specific airport .in the Los Angeles area. There is the availability to use local match , such as property owned by the jurisdiction. A specific piece of legislation was written for the benefit of a specific piece of property. There is an opportunity for other privately owned public use airports in the state to take advantage of that. But it will be a very competitive process. Also there will be ranking criteria, along with a lot of competition for the funds. Chairperson Rossas asked if this wasn't a list of just one? Mr. Brown said if there are two sources of funds, and they are run parallel to the State Highway system versus the local streets and road systems, you would have a list of one. If you merge this into the list of existing projects, ( 6.or 8 projects already on the list for the Oroville Airport). Chairperson Rossas said he did not see this as a problem. Oroville is dependant on Butte County Association of Governments. Staff stated there was another level of review to solve any potential conflicts. Chairperson Rossas said the city of Oroville Is. funding is mostly FAA, rather than the State. The Paradise Airport isn't in conflict. with the Oroville Airport. Commissioner Lambert asked if we have priority of one that's interested, but there are two airports that would quality, the. Ranchero and Paradise. Would these compete with the city of Oroville, city of Chico for the same funds? Mr. Brown said it was his understanding if parallels are run that might be the case, as one is publicly owned. and one is private. Two lists would be logical. Those two would compete within Butte County, then those in turn would compete with other projects throughout the state. But private airports would not compete with the public. The condition in the legislation is, if you are successful in receiving these state funds, there is a 20 year commitment that it will stay in use, and if it . is not in use at that point you would have to reimburse the state for the funds 4 BUTTE COUNTY AIRPORT LAND USE COMMISSION MINUTES - December 9, 1992 - granted to you. • Chairperson Rossas stated that even if you merge the Paradise airport into the other lists, the funds that have to go to a private airport, have to go down thru the list until you strike the first private airport. Commissioner Stevens asked what the next step would be? Mr. Brown said he felt a recommendation to the Board of Supervisor's would be the next step, to identify this as a project, identify the matching funds that are to be made available to implement this project. Then the Board 'of Supervisors has to request that Butte County Association of Governments put it on the list. Commissioner Stevens moved that the Board -of Supervisors request that Butte County of Association of Governments add this project for the Paradise Airport to the list, and the Board'of Supervisors work together with the airport owner to identify the limits the project , the cost of the project, and the source of the funds that are going to be used to provide the matching funds. They then request that Butte County Association of Governments include this in the Regional Transportation Improvement Program. Commissioner Crotts seconded the motion. Status Report - Orovi lie 'Municipal Airport Environs Plan text revision. 5 BUTTE COUNTY AIRPORT LAND USE COMMISSION MINUTES - December 9, 1992 - Staff noted the environmental report on the General Plan Amendment has been received and reviewed. No comments at this point. Chairperson Rossas said the City is so involved in the General Plan at this present time, and has finished all the hearings in the districts. Now will move to the Planning Commission level. More hearings will be held there, then it will move to the Counsel level. It is expected to hit that level sometime in June or July. The park definition is still unclear, and needs a lot of work on it. The idea is fine, but needs a new designation as far as the city of Oroville is concerned. It should appear on the next Agenda.. Oroville is in a tremendously tight situation. With all that is going on in the State Legislature, with regard to the State Budget there is no money at all to hire people. The other side of this, is with the Bond Issue, there are large amounts of money to use for capitol outlay. Which is just reverse of the normal. Consequently the next meeting coming up on Montgomery Street, and the Oroville Airport, there is $3.8 million which is half of the grant and is enough to move all the earth, which is the first phase, plus several other items. There is also money coming from property acquisition. City funds are used to get the property, then FAA is applied to for reimbursement, and 90% comes back which is used for the airport. This will take care of the 10% which is used to match on the big grants. The airport project seems to be going unless the State stops it. Staff should prepare everything by July 1st. -Engineering firms will have to be hired from outside, instead of in-house. 4. Status Report - Chico Municipal Airport Environs Plan and Airport Noise Compatibility Program. Staff said Commissioner Crotts will bring us up to date as to what is happening in Chico. Commissioner Crotts reported the Airport Noise Compatibility Program report is completed and the Final Report is out. Staff asked if the County was to receive copies? This bill would make an appropriation by additionally authorizing the department to allocate the continuously appropriated funds to a city or county designated by the Airport Land Use Commission, on behalf of any privately owned, public use airport that meets specified conditions. The bill would provide that, upon request, California Aid to Airports (CARP) projects included within the adopted State Transportation Improvement Program, may be funded in advance of the year programmed, with the concurrence of the department, In order to better utilize funds in the account. The eligible airport and aviation purposes are limited to those specified in paragraphs (4), (5), (6), (9), and (14) of subdivision (f) of Section 21681, and, further, any such capital Improvements or acquisitions shall become the property of the designated city or county. Matching funds pursuant to subdivision (a) of Section 21684 may Include the in-kind contribution of real property, with the approval of the department. (c) Any grant of funds held iri the Aeronautics Account in the State Highway Account on behalf of any privately owned airports shall contain a covenant that the airport remain open for public ttse for 20years. Any grant made to a city or county on behalf of it privately owned airport shall contain a payback provision based upon existing market value at the time the private airport ceases to he open for public use. (d) Upon request, California Aid to Airports (CARP) projects included within the adopted State Transportation Improvement Program, may be funded in advance of the year programmed, with the concurrence of the department, in order to better utilize funds In the account. (e) There is, in the Aeronautics Account in the State Transportation Fund, a subaccount for the management of funds for loans to local entities pursuant to this chapter. All funds for airport loans in the Special Deposit Fund are hereby transferred to the subaccount. With the approval of the Department of Finance, the department shall deposit in the subaccount all money received by the department from repayments of and interest on existing and future airport loans including, but not limited to, the sums of five hundred forty thousand dollars ($540,000) In repayments from the General Fund due In July 1987, and July 1988, and may, upon appropriation, transfer additional funds from the Aeronautics Account in the State Transportation Fund to the subaccount as the department deems appropriate. Interest on money in the subaccount shall be credited to the subaccount as it accrues. The State permit lists the runway at 1900 feet while the enclosed copy of the United States Geological Survey dated 1970 shows the runway being 2981 feet. In reviewing the use permit from Butte County dated May 2, 1960 there is no limit on the :runway length. As per our conversation you said in these situations the County would defer to the State permit unless it was shown that the runway was longer, or I assume longer at some time before the State determined the length. It is important to remember that in the beginning this was a dirt stripe, and the surface improvements were done over many years. I also understand that for this type of airport at this elevation and type of climate the standard length would be 3050 feet. '' . At this point in time I would like to bring this airport into compliance with all permit requirements. Obviously the State permit must be revised and to do so the State feels that must start with the County. I do not wish to start a use permit application and end up through public hearings lowering the usage allowed under the current use permit, or even subject myself and my neighbors to an unnecessaryprocess. However, should it be required I will be glad to submit the plans and application for use permit. I am sending a copy of this letter to Jim Michel along with copies of the map, use permit. I am also requesting that Jim look into how the permitted length was established. Through interviewing people who have been around this airport for 25 years, they say what is now paved was always considered runway and was used as a runway. He said he would -review the plan with others in his office. Last week I called him and reminded him that I was awaiting his response. We will probably maintain the runway's current position with a realignment. Mr. Michael did ask me to not submit my use permit application until I saw their recommendations. State law requires such Commissions -to develop Airport Land Use Plans. It is optional to include other general aviation or mili.tary.airports in such plans. In.this Airport Land Use, Plan, the Paradise Skypark Airport is,addressed in detail. This plan is intended to complement and enhance the local comprehensive planning process of agencies responsible for the land use in areas surrounding the Paradise Skypark Airport. Basic goals of the Airport Land Use, -Commission are: 1. 'Preservation,of navigable air space around airports, 2.. General'.safety of people and property around.'airports, .3. Mitigation of aircraft impacts. Powers and duties of the Airport Land Use Commission as set forth in Sections 21670=21678 of the Public Utilities Code.are: 1. To assist local agencies in ensuring compatible land uses in the vicinity of existing airports to the extent that land in the vicinity of such airports its not already devoted to incompatible uses, 2. To coordinate planning at the state, regional and local levels so as to provide for the orderly development of•air transportation' while at the same time protecting the public health,�.safety.and welfare, B. I't is important to recognize that the.Commission has,no powers or control over the following: ! i 1. This plan establishes planning boundaries around,.the Paradise.Skypark Airport area of influence., It sets forth appropriateland use; ' including building height restrictions, to the extent that such land is not already devoted to incompatible uses. Neil McCabe and Barry Hogan, manager of the Planning Division. Our focus centered around conditions at the airport in 1962 when the original use permit was issued, the existing extent of development, and your proposed extension of the runway. As a result of our review it is recommended you should at this. time make an' application for a conditional use permit that will provide for both the improvements as they are today but will also cover' your desired runway addition. We also recommend you concurrently apply for an amendment to the airport land use plan. One of the considerations in granting the use permit will be its consistency with the ALUP. For your convenience an application form for the use permit is enclosed. Amendment of the ALUP can be initiated by writing the Airport Land Use Commission with a description and any diagrams showing the proposed changes to the existing plan. We will make every effort to process the requests promptly upon receipt. These recommendations may seem a departure from the direction of conversation on Monday. However, on reflection and discussion with Neil it is our opinion that you will be better served by achieving full consistency and removing any uncertainty that could result from attempting to rely on the existing permit. A use permit process will also enable a forum for public comments, and it would seem more beneficial for you and the county to address the long term future of the airport before more residences or other. conflicting uses are built in the area. The reason for amending the ALUP is because it currently specifies a runway length of 2710 feet, and your plans are to lengthen beyond that.
