J Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use 4. -The terms and conditions -of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This project is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed; use is in accordance with the purpose of Chapter 24 of the Butte County Code, then purpose of the zone in which the site is located, the Butte County General Plan,' d and the development policies and standards of the County; and B. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because the density is consistent with the Butte County General Plan and surrounding parcels; and C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity because of the required conditions; and Section 3: Action. Conditions of Approval: Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 42D0), and all other applicable -State and County codes, ordinances and regulations in effect at the time'of application for improvement permits. 2. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 3. (SB) (UP96-10) (VIDEO) Mr. Betts gave a brief summary of the project. A video was shown. He said Environmental Health said there is a problem on the primary dwelling and Environmental Health is asking for repairs prior to issuance of the Use Permit. Mr. Farrel said this request is pursuant to an application for a building permit. He said the Use Permit needs to be approved and issued prior to the issuance of the building permits. The hearing was opened to the public. Sue Kurtz, a resident of the area, said the area is zoned AR -1, but it was her { understanding they could only put one dwelling on 5 acres. She said there should only be one dwelling on the property. She said that allowing two dwellings on this property would set a precedent. She said she expects the County to protect the designated zoning. She • was against this and said so are her neighbors. Commissioner Nelson said Mr. Mitchel can add another dwelling if the land peres. Mr. Sanders said Mr. Mitchel might not be able to get a perc to divide this parcel, but if the ground would perc, the property could potentially be split into 5 one acre parcels. He said the second dwelling was never an established legal use. Floyd Scott said he has seen changes to the owners of this property since 1976. He said adjoining this property is another parcel being used the same way with an illegal dwelling. He said the property owner does not live on the property.. He said he is against this project and that everyone should abide by the rules. Marilyn Nash Frank, said the 5 acre parcel zoning was changed to AR -1 with 1 dwelling per acre. She said the road will not support a fire engine. Mr. Sanders explained AR -1 zoning. Chairman Seegert said Environmental Health will inspect the situation and have to give the final approval of the septic system for both dwellings. Mr. Kurtz said the Health Department set the limit of one dwelling per 5 acres. He was. against this permit. Commissioner Nelson said he was not aware of allowing only one dwelling per 5 acres. The hearing was closed. Commissioner Cage said she has been in the area several times. She asked if there was an approved drainage system in the area? • Mr. Sanders said no, just natural drainage ways. Chairman Seegert said drainage is not a problem in this area. f Commissioner Lambert said she was in favor of improving this situation and bringing the dwelling up to code. She suggested that a rezone to 5 acres should be initiated either.. by the Planning Commission or the property owners since that is what the applicants believed they had anyway. There was a consensus that the rezone should be addressed as part of the work on the General Plan. It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and unanimously carried for approval subject to the findings and conditions listed in Exhibit A, changing Condition 3 to add after Building Division "and Environmental Health Division" as follows: Section 1: Environmental Findings. RELATED ITEMS: None FOR: Planning Commission Meeting of April 11, 1996 SUMMARY: This project will allow two existing dwelling units on one parcel. The project conforms to the general plan and zoning requirements. Staff recommends approval of this application. , PROJECT CHARACTERISTICS: This request is for a Use Permit to allow two existing dwelling units on a single parcel. The property is located at 340 Plumas Drive, Oroville. The property is 5.01 acres in size and is zoned AR -1. The Land Use Element of the Butte County General Plan designates the property as Agricultural -Residential. Five structures occupy the site: a 2,400 sq. ft. dwelling unit, a 830 sq. ft. dwelling unit, one garage, one carport, and one shed. Domestic water for the property is obtained from Oroville-Wyandotte Irrigation District. Sewage disposal is handled by individual septic tanks and leach line systems for each dwelling unit. Surrounding parcels are zoned AR -1 and have a General Plan designation of Agricultural -Residential. ANALYSIS: The AR -1 zone allows one single-family dwelling or modular home per parcel. Butte County Code 24- 95.C.1 requires a Use Permit for any additional dwelling units, including duplex dwelling, multiple residences, and multiple -family dwellings. There are two dwelling units on this parcel - one of 2,400 sq. ft. and the other at 830 sq. ft. The 830 sq. ft. dwelling was originally constructed as an ag-exempt building. However, it was soon converted into a dwelling unit without obtaining the proper building permits, inspections, and a use permit. The building has been in continuous use as a dwelling unit since it was constructed. The applicant was informed on November 30, 1995, by the Butte County Building Division that he must obtain building permits, inspections, and a use permit for the existing 830 sq. ft. dwelling unit. Because the 830 sq. ft. dwelling unit was constructed as an ag-exempt building and not as a dwelling unit, the County has not done any inspections on this structure. A condition of this use permit will require that the existing 830 sq. ft. dwelling unit obtain building permits and receive a final inspection by the Butte County Building Division. Both dwelling units receive their domestic water supply from the Oroville-Wyandotte Irrigation District. Sewage disposal for both dwelling units is handled by separate septic tanks and leach line systems. The parcel exceeds the minimum parcel size of the AR -1 zone. There is adequate space on the property for off-street parking for both dwelling units. No additional vehicle traffic will be generated by approval of this proposal because the additional dwelling unit is already existing. Because the project site has supported two dwelling units for many years, there will be no change in density on the parcel. The Butte County Environmental Health Department has stated that the septic system for the main house is overflowing, either due to inadequate leach line length or leaks in the house. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. _ 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. _ 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. _ 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful ■ Use Permit Standard. Conditions - Butte County ■ Performance bond shall be posted to guarantee installation and established growth. _ 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. _ 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: _ 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. _ 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. _ 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. . _ 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. _ 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension.
