AP 039-520-017 ASSESSORS PARCEL NUMBER Use Permit - Mid Valley Baptist Church: A Use Permit to allow the construction of a 7,150 square foot gymnasium facility on 4.71 acres of land located on the east side of Durham Dayton Highway, approximately 190 feet south of the corner of Durham Dayton Highway & McAnarlin, in a SR -1 zone in the Durham area. This project is located in Supervisorial District 4. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte county Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. The approval of the Use Permit and improvements will not cause environmental damage to fish or wildlife or their habitat and a de minimus exemption to the collection of Department of Fish and Game Environmental Filing Fees is recommended; and C. The Planning Commission has independently reviewed, analyzed and considered the proposed Negative Declaration prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of the County of Butte; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone"ih)which the land lies in that it is currently designated on the General Plan as Agricultural Residential and is already developed with a church. B. The use would not be unreasonably incompatible with, or injurious to surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood in that the proposed uses in this permit are only expanding the current uses at this location, and the operational characteristics of the proposed use will not conflict with, or adversely affect the operation of mixed uses on the surrounding properties. C. The use would not be unreasonably incompatible with, or injurious to the general health, welfare and safety of the residents of Butte County in that conditions imposed by this permit, if adhered to by the applicant, will ensure that the public safety is protected. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Use Permit for Mid Valley Baptist Church on AP# 039-520-017, to allow the construction of a recreational facility, is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification' is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: Planning Division 1. If parking lot is lighted, all outside lighting fixtures shall utilize "low spillover" design where all direct lighting shall remain on-site, allowing only reflective lighting to spillover into those areas off-site. (MM) Land Development 2. Prior to the issuance of building permits deed to Butte County, in fee simple, 40 feet of right-of-way from the centerline of Durham Dayton Highway. The right-of-way shall be sufficient for the installation of standard No. S-5 at all street intersections. 3. Prior to the issuance of building permits, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of .4"A ublic Works. -The .drainage p!ans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Pay Drainage Fee of $4200/acre for area impacted by the development. Environmental Health 4. Prior to issuance of building permits, provide verification of potable water. 5. Prior to issuance of building permits, meet Environmental Health requirements for sewage disposal. California Department of Forestry 6. Applicant shall install an automatic fire sprinkler system for the kitchen, bath(s) and storage area. 7. Maintain a fire lane access and prohibit parking next to the curb on the south side of the existing church and the curb on the west side of the new building. 8. Applicant shall provide an extinguishing system installed over the kitchen stove. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. This project is located in the Durham Dayton Nelson Area Plan. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting July 11, 1996 SUMMARY: This application for a Use Permit is to allow the construction of a recreational facility, a gymnasium, on church grounds, in an SR -1 zone, located on Durham Dayton Highway. This project is an expansion of a permitted use in a SR -1 zone. Staff recommends conditional approval of this application. PROJECT CHARACTERISTICS: The proposed project is located on church grounds, located on Durham Dayton Highway, approximately 190 feet south of the corner of Durham Dayton. The property consists of a 4.71 acre parcel with a sanctuary, offices and classrooms, and a paved/striped parking lot. The property fronts Durham Dayton Highway which provides access the length of the paved parking area, approximately 200 feet. The property site is level (0-1% slope), and is covered with grasses and star thistle. The proposed gymnasium is to be 7,150 square feet in size. Water is provided by an on-site well, and the gymnasium will have its own septic system. The surrounding land uses are mixed: rural and urban single family residential and agricultural. The proposed project is located outside of the Durham Urban Area. All plans and specifications for proposed drainage facilities, sewerage, street lighting, water distribution systems and site improvements must be approved by the Butte County Public Works Director. Sewage disposal for the project shall have to meet Environmental Health requirements. ANALYSIS: The approval of a Use Permit for the proposed project would allow for the construction of a recreational facility (gymnasium) for the church's youth ministries. The intended use of the facility appears to be consistent with the activities already permitted, i.e., church activities. At present, a church exists on-site, including offices and classrooms, all in one structure. The emphasis of use with the proposed recreation facility will be for the youth of the church. This recreation facility, a gymnasium, will be approximately 7,150 square feet of metal building. The building is scheduled to have a kitchen, two bathrooms, and a storage area over the kitchen. Parking is adequate and already includes a paved/striped lot. An additional improvement requiring approved handicap parking will be a condition of approval. Primary access will be from Durham Dayton Highway which fronts the site. Road improvement requirements of the Durham Urban Area Plan will be a condition of approval for the project. This project does not present any major concerns for the County. Potential issues such as drainage, lighting, and road improvements are either less than significant or will be addressed with the appropriate conditions required for approval. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and is subject to the requirements of CEQA. An Initial Study has been prepared by County staff. Based upon the review of the Initial Study, staff has determined that the project has no significant impacts. # Butte County Department of Development Services - Planning Division # PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper. Public notices were mailed to all property owners within a 300 foot radius of the subject property. RECOMMENDATION: Staff recommends that the Planning Commission approve the application on APN 039-520- 017, subject to the findings and conditions listed in Exhibit A. (SH) (UP96-11) Mr. Hackney described the project. It is recommended that Condition 3 be deleted regarding street frontage improvements. Mr. Sanders said that the property is outside the Durham urban area and does not require the road improvements. The property is within the urban reserve of the Durham Dayton Nelson plan which covers the area between Highway 99 and the Sacramento River. Mr. Farrel said that the Board of Supervisors defined by Resolution the areas that are subject to urban area improvement standards versus rural improvement standards. There was some discussion about whether the D2N Plan itself triggers urban area improvements beyond the urban core, but after reviewing the documents and having discussions with Public Works, it was determined that urban area improvements are not applicable to this property. Commissioner Cage asked if this project would increase the traffic, and if street improvements would be needed in front of the project. Mr. Hackney said the project itself will not expand usage of the site, since the use will only be for the current church membership. Commissioner Cage asked if the facility would be used more than just on Sunday. Mr. Hackney said the facility would be mostly used on Sunday, and would be used by the church membership mainly to enhance the youth ministries. Mr. Farrel said that street frontage improvements would not be appropriate since the property is outside the urban area and there are no curb, gutters or sidewalks on the adjacent properties. Commissioner Cage thought an apron for turning would be a good idea. Mr. Sanders said that the current driveway approach must meet county standards, otherwise Public Works would have requested a standard road approach. HEARING OPEN TO THE PUBLIC Robert Wiley, on the Deacon's Board of the Church, said that they had been concerned about the requirement for curb, gutter and sidewalk. They are also concerned. about Condition 4 for a drainage solution. There has never been a drainage problem and this building will not increase the runoff. On a 5 acre parcel that requirement could cost $20,000. Mr. Wiley said the church objects to having to install the fire sprinklers, except near the stove, since there is very little to burn and the sprinklers would not operate if the electricity failed. The big open building will have plenty of doors. Only church members will use the facility. There are no plans to use the building for such things as weddings. The purpose of the building is for recreational activities for children. Non church members will be welcome to join in the activities for the children. The building will not be used for school classes. Mr. Farrel recommended leaving the drainage condition and fire sprinkler condition unchanged since the Public Works Department and Fire Department are the technical experts on those items, however there is flexibility, and those departments are sensitive about cost considerations, and if the concerns are passed on, those problems can be worked out. The drainage condition mainly requires that the drainage issue be addressed. Item B allows for minor changes to be made in the conditions so they can be reasonable. Commissioner Cage said that Condition 9 requires an extinguishing system over the stove so more sprinklers. might not be necessary. Mr. Farrel said the Planning staff cannot make a judgement in that technical area, which should be made by the fire specialists. Commissioner Lambert said Condition 4 mainly requires a drainage plan indicating where the drainage will go. Mr. Sanders said the $4200/acre drainage fee would relate to the size of the building only and should be about $700. HEARING CLOSED TO THE PUBLIC Commissioner Lynch said that fire sprinklers are a standard requirement. In a kitchen fire there would probably not be a general power outage. Chairman Seegert said the fire sprinkler condition is governed by the fire codes. Mr. Sanders said that the sprinklers are also required by the Uniform Building Code. Commissioner Lynch noted that the sprinklers are only required for certain locations in the building. It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and carried unanimously to grant the Use Permit for Mid Valley Baptist Church on AP 039-520-017 according ; to the findings and conditions of the Agenda Report, deleting Condition 3, and correcting the AP " number and file number on Exhibit A. -_ FINDINGS BUTTE COUNTY PLANNING COMMISSION MINUTES—July-11, 1996 �_. SITE DEVELOPMENT The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated _, 19_ and is incorporated herein by this reference. _ 2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. _ 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. _ 2: A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. _ 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, ■ Use Permit Standard Conditions - Butte County ■ planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. _ 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. _ 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING _ 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: _ 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. _ 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. _ 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which ■ Use Permit Standard Conditions - Butte County ■ C time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. _ 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. _ 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. For your information, Gridley's General Plan Circulation Map indicates that at some point Washington Street will be extended through the Stuke property to intersect with an extension of Obermeyer Avenue. At present, the right-of-way for Washington Street dead -ends at the north boundary of the Stuke property. Despite the proposed extension of the street, the City of Gridley is not concerned about the proposed construction of greenhouses within the future right-of-way. We do not foresee a need to construct the street until the property owners who will be served by it -- iricluding..the owners of the Stuke property -- are ready to develop their property to the higher -value density uses permitted by the zoning of the area. At that time, we anticipate that the owners themselves will willingly remove structures within the proposed roadway extension, and any other structures that interfere with higher density development of the site. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Vlfdhin this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the C Use Permit Standard Conditions - Butte County 0 i County approved Orchard Management Agreement. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after comencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobilehome park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees. The specific locations and fire flow requirements shall be in accordance with the Fire Department specifications and to the satisfaction of the County Fire Warden.
