GENERAL CONDITIONS1. lt is understood and agreed thal the County has pr¡or r¡ght to the use of its r¡ghts of way. lt ¡s further understood and agreed by the Perm¡llee lhalthe doing of any wo|k under this permit shall conslitute an acceptance of all the provisions contained here¡n and failure on lhe Permittee's part to comply withany provis¡on w¡ll be cause for revocation ol this permit. Except as olherwise provided for publlc âgencies and Íranch¡se holders, this pemlt ¡s revocable atanytime. This permil is lo be on the job sile at all limes while the work ¡s berng done. (County Code Chapter 10-75, Article Vl, 10-75to10-99)2. All work shâft be done subject to the sLrpervision of and to the salsfaction of the Publ¡c Works Depârlment of the Counly of Butfe. The Permitteeshall, at a times, dur¡ng the progress of the work, keep lhe County Highway in as neal ând clean a condilion as is possible and upon complelion of the workgrânled herein, shalt leave the County Highway ln a lhoroughly neat, clean, and usable condition. Best l\¡anagement Pract¡ces (Bl\¡P's) shall conform toÕaltrans Construction Site BMP l\¡anuâl l\¡arch 2OO3 for sediment and erosion control. BIvIP's will be used and maintâined during and after construction toprevent any sediment or other construction related pollutants from leav¡ng the job s¡le and entering the county right-of-way or a drainage structure. All costs incured by Butte County Public Works Íromthe encroachment permit holdeis failure to keep the roadway or drainage structures clean dur¡ng and aftel construction activ¡t¡es will be bilfed to andbecome the responsibility of the property owner. A building permit will not be fìnaled until all conditions are met lo the salisfaction of the Bulte Counly Publ¡cWorks Depadment.3, Ihe permittee agrees by the acceptance of th¡s permit (o properly maintain any encroachment placed by the Permittee on any part of the CountyHighway and to ¡mmediately repair any damage to any polion of the highway, which occurs as a Íesult of the encroachment, unt¡l such time as lhepermit(ée may be relieved of the responsibili(y of such encroachment by Ihe County Department of Publ¡c Works.4. ll is further agreed by tho Permittee that whenever construction, ¡econslruction, or naintenance wo¡k upon the hlghway may requ¡re lheinstaflâtion p.ovided herein shati, upon request of the County Department of PLrbl¡c Works, be immedialely moved þy and al the sole expense of thePermittee.S. No materiat used for Íll or backfill in lhe construc(ion of the encroachment shall be borrowed or taken from within the Counly right-of-way.6. At least one lane of any publ¡c road, under the jurisdiction of the Board of Superv¡sors of Butte County, and other publlc roads iunction¡ng orlntersecting thercwith, shall be kept open for travel by lhe genercl public at all times. No publ¡c road under the Jur¡sdiclion of the Board shall be closed totravel by the general pL¡bl¡c without special permission, in w ting, from lhe Board of Superuisors7. The permittee, by the acceptance of this pemit, shall assume full responsibility for all liability for personal iniury or damage lo property which mayarise out of the work hereiñ permitted or which may arise out of lhe fallure on the part of the Permittee to do lhe work provided for under th¡s permit ln {heevent any claim of such liabiiity ¡s made against thé Counly of Butte oÍ any department, oflìcial, or employee theleof, lhe Permiltee shall defend, indemnify,ând hold them ând each of them harmless for such claim.e.
