HomeMy WebLinkAboutOrdinance 2259ORDINANCE NO. 2259 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "PA-C" (PLANNED AREA CLUSTER) DISTRICT, PURSUANT TO CHAPTER 24-29. l The Board of Supervisors of the C6unty of Butte, State of 2 !!California, under and pursuant to Chapter 24-29 of the Butte County 3 Code of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, shall be and is hereby 6 zoned "PA-C" (Planned Area-Cluster) District, amending Ordinance 7 #1120 with regard to the expansion of the recreation building, and 8 subject to the restrictions, restricted uses, and regulations of 9 Section 3 below, Ordinance #1120, and pursuant to Butte County Code 10 Section 24-126. 11 Said area so zoned being located in the unincorporated 12 area of Butte County, north of Paradise, more particularly described 13 s follows: 14 All that portion of Section 26, T23N, R3E, MDB&M described as follows: 15 16 17 18 19 20 21 22 23 24 25 26 Beginning at a 2" iron pipe tagged R .• C. E. 9 0 33 marking the most southerly corner of Lot 116 of Paradise Pines Unit No. 6 as said Lot 116 is shown on the official plat thereof, filed in the office of the Recorder of Butte County, in Book 35 of Maps at Pages 92, 93, and 94; thence from said point of beginning along the southerly boundary of said Paradise Pines Unit No. 6 the following five (SJ courses: (1) N 45° 29' 50" E 135.00 ft. (2) N 84° 43' 04" E 40.00 ft., (3) from a tangent that bears S 05° 16 1 54" E, southeasterly 81.95 ft. along the arc of a curve concave to the northeast, having a radius of 380. 00 ft., through a central angle of 12 ° 21' 23", ( 4) tangent to said curve S 17° 38' 19" E 349.73 ft., and (5) southeasterly 67.52 ft. along the arc of a tangent curve concave to the southwest, having a radius of 370.00 ft., through a central angle of-10° 27' z3u; thence leaving said boundary southwesterly 134.26 ft. along the arc of a tangent curve concave to the northwest having a radius of 220.00 ft., through a central an8le of 34° 58' 02"; thence tangent to said curve S 27 47' 06" W 157.68 ft.; thence S 52° 36' 09" W 575.00 ft.; thence N 51° 03' 15n W 276.39 ft.; thence N 28° 33' OS" E -1- 1 2 3 4 !I !\ I ! I 387.07 ft.; thence N 10° 00' 29" E 258.94 ft.; thence N 49° 01' 47" E 352.39 ft. to the point of beginning and containing 10.275 acres, more or less, Smiles north of Paradise. SECTION 2. The use and development of said property shall 5 e in accord with the development plan submitted by the applicant, 6 s conditioned and incorporated herein by reference. Said condi- 7 ioned development plan collectively consists of the following 9 Exhibit (a) Development Plan (showing the site plan, 10 anitation details, roof plan, and vicinity plat for an addition 11 o the recreation building). 12 Exhibit (b) Parking Plan. 13 SECTION 3. Notwithstanding the provisions of Chapter 24- 14 26 of the Butte County Code the following provisions shall govern 15 use and development of said property: 16 (a) The buildings as shown on the development plan shall 17 e limited to recreational uses and activities; and l8 (b) The storage of materials and objects around the re- 19 reational buildings and facilities as shown on the development plan 20 hall be limited to those which are necessary to, appurtenant to and 21 ustomarily associated with the residential and recreational use of 22 he development; and 23 (c) The height of all principal structures as shown on 24 he development plan shall not exceed a height of two (2) stories 25 r 35 feet. 26 SECTION 4.
