ITEM: Butte County Use Permit #97-17 (Anderson Brothers Corp.) on APN 047-270-027: A
request for consistency findings for a Use Permit to allow a 500 unit mini -storage business
on property zoned C-2 (General Commercial), located on the east side of Highway 99,
approximately 600 ft. north of Wilson Landing Rd., at 13664 State Road 99, Chico. Staff
recommends the Commission find the project consistent with the Chico Municipal Airport
Environs Plan.
FOR: Airport Land Use Commission Meeting of March 19, 1997
SUMMARY: The County of Butte is presently processing the above mentioned project and has
submitted a comment sheet and map to ALUC for review and comment. Staff recommends the
Commission find the project consistent with the Chico Municipal Airport Environs Plan.
ANALYSIS: This Butte County project is a Use Permit for a 500 unit mini -storage business on
a 10.5 acre parcel located on the east side of State Road 99, approximately 600 ft. north of
Wilson Landing Rd., at 13664 Highway 99, Chico. The project site is located within the North
Chico Specific Plan area. The mini -storage units will be located on approximately 3 acres of the
10.5 acre parcel. The project site is zoned C-2 (General Commercial). The project description
was referred to the Airport Land Use Commission staff on January 8, 1997 for comment as part .
of the routine Request for Comments, and the Commission must respond within 60 days. Staff
review consisted of land use compatibility, noise sensitivity and a comparison with the draft
Policy Plan guidelines as indicated below. Based on this data and that the land use is not a
significant change from what is currently planned, staff informed the Butte County Planning
Division that the project was tentatively found to be compatible with the adopted Environs Plan
and would receive a formal ALUC recommendation at its February 19, 1997 meeting.
Land Use Compatibility
Staff reviewed the request pursuant to the currently adopted Chico Municipal Airport Environs
Plan (CMAEP). A determination was made that the project site is located in the FAR Part 77 20:1
Conical Surface of the Chico Municipal Airport Study Area (CIC -5) and is not located within any
Compatible Land Use Zone Areas as depicted on CIC -13. There are no restrictions on land use
for properties located in the 20:1 conical surface area. Height limits of buildings and towers
apply to properties in the 20:1 conical surface area, but the proposed use will not project into the
reserved airspace.

Noise Sensitivity
The project site is outside of the 55 dB CNEL noise contour as depicted in Figure CIC -2 of the
CMAEP. CIC -3, which shows future CNEL noise contours, indicates that the project site is still
outside of the 55 dB CNEL noise contour. There are no restrictions on land uses outside of the
55 dB CNEL noise contour. In addition, the FAR Part 150 Noise Compatibility Program prepared
for the City of Chico was reviewed for additional noise impact evaluation. While it is understood
that this document has not been accepted or adopted by the ALUC as a recognized noise study
or environs plan, it does provide additional information to assist staff in the review of projects.
The FAR Part 150 study shows that the project site is currently outside of the 55 dB CNEL
contour and projects the noise level to also be outside the 55 dB CNEL contour in 2010. Based
on this data the project site is within an area where the proposed use would be compatible with
identified noise level contours. It should be noted that all of the above data does not address
_ single event noise levels over the project site.
Draft Policy Plan
The project site is not located within any of the three flight.safety areas as defined in the draft
Policy Plan. There are no restrictions on land use outside of the three flight safety areas. This
Plan is only in draft form and has not been adopted nor does it replace the existing Environs
Plan. However, this Plan does provide the baseline for the Chico Municipal Airport
Comprehensive Land Use Plan update that will direct land use compatibility in the area.
RECOMMENDATION: Staff recommends that the Butte County Airport Land Use Commission
find that the proposed Butte County Use Permit # 97-17 (Anderson Brothers Corp.) on APN 047-
270-027 is consistent with the Chico Municipal Airport Environs Plan subject to the following
findings and recommended conditions in attached Exhibit "A".
If the ALUC would like to take additional action on this project it would be limited to a
recommendation to the Butte County Planning Commission that although the project is consistent
with the currently adopted Chico Municipal Airport Environs Plan, the ALUC does have additional
concerns. This recommendations would only be advisory and would not require any overriding
findings to dismiss.

BUTTE COUNTY AIRPORT LAND USE COMMISSION CONSISTENCY FINDINGS FOR:
Butte County Use Permit # 97-17 (Anderson Brothers Corp.) on APN 047-270-027
The following findings have been prepared at the direction of the ALUC and, are for the
consideration of the County of Butte (local agency) when making'a decision on this project.
Section 1: ENVIRONMENTAL FINDINGS
A. No environmental documentation was submitted at time of review. However, it is not
foreseen that there will be any significant impacts at this time.
Section 2: PROJECT CONSISTENCY FINDINGS
A. The ALUC finds the project is consistent with the Chico Municipal Airport Environs Plan
and that the project is compatible with the viable; responsible operation of the Chico
Municipal Airport subject to the following recommended conditions.
+ Section 3: RECOMMENDED CONDITIONS
A. Property owner shall sign an avigation easement granting the right of continued use of the
Chico Municipal Airport in the airspace above the subject parcel and acknowledging any
and all existing or potential airport operational impacts.
