Pursuant to Butte County Code (BCC) Section 41-2, we sent you a courtesy notice dated November 30, 1995 notifying you that you are in violation of the BCC at the above -referenced location. As of this date, the following violations still exist: Failure to obtain the required permits, inspections and approvals from this office for construction of a garage in violation of the 1991 Uniform Building Code as adopted by Section 26-1 of the Butte County Code as follows: (a) Section 301(a) Permits Required (b) Section 305(a) Inspections Required (c) Section 305(d) Inspection Approval Required before Use or Occupancy The above violation(s) shall be corrected or abated by you by submitting three (3) complete sets of plans, applying for the required permits, and paying the appropriate fees, including penalties. After permit issuance and field authorization to proceed, the work must be completed and approved by this office within the permit specified time. Constructed a single family residence on your property in violation of the Zoning Code as follows: (a) Butte County Code Section 24-95--AR-1 zone allows one (1) single family dwelling per parcel. The above violation shall be corrected or abated by applying for a use permit from the Butte County Planning Department. If the use permit is granted, permits will be required from this office to do the work. If you do not apply for a use permit or if a use permit is not granted, permits will be required from this office to convert the building to an approved use. Letter to William H. The property is zoned AR -1 (Agricultural Residential 1 -acre minimums). This project is located in Supervisorial District 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If a6y use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This project is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because the density is consistent with the Butte County General Plan and surrounding parcels; and C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under. which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity because of the required conditions; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Use Permit for William Mitchel on APN 068-030-171 to allow two dwelling units is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments., Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved: Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4200), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 2. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 3. Obtain building permits and a final inspection from the Butte County Building Division and Environmental Health Division for the existing 830 sq. ft. dwelling unit prior to issuance of this Use Permit. 4. The septic system for the main dwelling unit shall be. inspected and approved by the Butte County Environmental Health Department prior. to final inspection by the Butte County Building Division. Repairs or improvements required by the Environmental Health Department shall be done under permit from that Division. 5. Applicant must also comply with all other applicable State and local statutes, ordinances., and regulations.
