Lasen Sheet Metal - has started to set the registers in the suspended acoustical ceiling system, completed the installation the sheet metal flashing at the window sills along Grid Line 7 and has set the grilles in the ceilings of the toilet rooms for the Judges Chambers, Miller Electric - continuing with the installation of the light fixtures in the ceilings of the corridor and offices along the north side of the building. Telecom Networking Systems, Inc. - subcontractor for Butte County, continues with the installation of the cabling and equipment for the data and communications systems in the building. Timmons Painting - continues with the painting of the offices & the door frames along the north side of the building east end and is continuing with the staining of.the doors. Browning Fire Protection - has started with the installation of the drops & heads for the fire sprinkler system in the offices along the north side of the building. Ceiling Masters - continues with the installation of the suspended acoustical ceilings in the open office areas adjacent to the Copy / Mail Area. Steve Smith Construction - continues with the installation of the cherry wood paneling in the Courtrooms. Ashland Glass & Millwork - continued with the installation of the case work in the Copy / Mail area. Fozco Engineering - continues with the site cleanup & grading on the south side and west end of the building, trenched for the recessed light fixtures in the concrete walkway at the Rotunda and dug the footings for the flag poles and their subcontractor has finished the application of the AC paving on the north side of the building. The questioned change orders have been processed by in order to keep the project moving and to maintain a harmonious working relationship with the architects through project completion. However, the time has come to.develop our policy position(s), and if we feel financial responsibility rests with the architects/engineers, we need to pursue notification (or claim). At least Oreyfuss and Blackford Architects are aware of our concern (and perhaps Michael Ross ♦ Charles Drulis Architects also). My letter to Virgil Hancock is being sent to you under separate cover for a couple of reasons: O Our contract for inspection services was with the architects. Hence, there has always been the potential for a conflict of interest situation arising. • A few months ago Virgil was given notification that he passed his AIA certification test. Subsequently, he was offered and has accepted an architects position with Dreyfuss and Blackford: I have discussed these concerns openly with Virgil and he has given me every assurance that he will honor his personal and professional commitment to Butte County. To this end, he told me he has advised John Webre, President, Dreyfuss and Blackford Architects, there are problems regarding change orders and of our concerns. He, in turn, has been informed by Webre to treat this situation as if he were not employed by the architects. As you know, Butte County has processed all change orders presented to us by the contractor and architects. We have done so in order to keep the project moving and to avoid creating an adversarial relationship. However, we have questioned approximately ten of the change orders with Mitch Bjorgum because we do not believe the County should be expected to pay for some of the apparent architectural or engineering mistakes and/or omissions. Mitch has advised me that our concerns should be addressed to either Michael Ross or John Webre. In time, and if such warrants, we will do just that. In the mean time, however, we need assistance to review each of the 66 change orders that have been approved and determine, in fact, if financial liability rests with persons other than Butte County. In past months I have consulted with our Chief Deputy County Counsel David McClain, Chief Building Inspector Michael Vierra, and others. We need to meet, discuss the changes orders, reach a consensus, and develop an action plan. If, in fact, the architects and engineers are deemed by us to be financially responsible, we should pursue our case with them. The purpose of this letter is seek advice and participation on your part as you were the project �l inspector on the job and are best familiar with some of the issues.
