HomeMy WebLinkAboutTPM16-0006_Approved_ConditionsPLANNINi nPROVEDDate: jd-J'-/ /!o By: "2...on. 1:t} AdN1.ct1.1.ftn:.:t,ov­Tentative Parcel Map for Tuscan Ridge Associates, LLC on APN's 040-520-100 & -103, File # TPM16-0006: A request to subdivide approximately 172.35 acres into four lots: 11.28 acres (Lot I), 8 acres (Lot 2), 13.1 acres (Lot 3) and 139.97 acres (Lot 4). The proposed tentative parcel map is for financing purposes only and the project site will not receive any additional entitled uses or development rights as a result of the tentative parcel map. The project site is located in a PUD General Plan Land Use Designation and PD (Planned Development) zone district. The General Plan and zoning designations on the project site were approved by the Board of Supervisors as part of the 2010 General Plan 2030 update and 2012 Zoning Map update at the request of the prope1ty owner. The PD zone allows for specific uses as specified in an approved PD Development Plan. There is no approved PD Development Plan for the project site and no application for such is pending. A.Conditions of Approval: Planning 1.Place a note on a separate document which is to be recorded concurrently with the Parcel Map or on anadditional map sheet that states: "The parcels created by this map are located in a PD (Planned Development) zone. The PD zone allows for specific uses as specified in an approved PD DevelopmentPlan and there is no approved PD Development Plan for these parcels. The Parcel Map is for financingpurposes only and the project site will not receive any additional entitled uses or development rights as aresult of the Parcel Map." Public Works 2.Prior to recordation of the parcel map, provide a fully executed road maintenance agreement for allnon-publicly maintained access roads on the county approved form. A note shall be placed on aseparate document which is to be recorded concurrently with the map or on an additional map sheet of the parcel map stating "in accordance with Civil Code Section 845, maintenance of the road as shownheron shall be shared by those properties with a legal interest in it." 3.All access rights shall be reserved by deed per County Ordinance, offered for dedication, and depictedon the Parcel Map. Place the following note on the Parcel Map: "approved road name is a non­ exclusive easement for ingress, egress, road and public services purposes, to be reserved in deeds andis hereby offered for dedication to the County of Butte." 4.Prior to recordation of the parcel map, relinquish abutter's rights of access to Butte County along the frontage of Parcel 4 except at approved access points. 5.Prior to recordation of the parcel map, provide street name signs per requirements of the Department of Public Works. Street names shall be reviewed by the County Address Coordinator and one name for each new street shall be recommended to the Board of Supervisors for approval prior to recordation of the parcel map. A minimum of five alternate names for each new street shall be submitted. 6.Prior to final road inspection, install all necessary traffic safety signs including stop signs. For all non­publicly maintained access roads, a note shall be placed on a separate document which is to be recorded concurrently with the map or on an additional map sheet of the parcel map stating: "No public entity shall be responsible for the maintenance of the traffic safety signs including stop signs. In accordance with Civil Code Section 845, maintenance of the traffic safety signs shall be shared by those properties with a legal interest in them." •Conditions or Approval• Tuscan Ridge Associates. Prior to recordation of the parcel map, provide approved access to each parcel being created. Construct or provide a performance, labor and material bond for construction of interior road in conformance with county improvement standard RS-8 LD-IV, 24 feet wide with 4” of CL II aggregate base and double sealcoat. Submit road and drainage plans to the Department of Public Works for plan checking and approval prior to construction. 8. Prior to grading, a construction storm water permit will be required by the State Water Resources Control Board if the project results in a disturbance (including clearing, excavation, filling, and grading) of one or more acres. The permit must be obtained from the State Water Resources Control Board prior to construction. If a construction storm water permit is required, place a note on an additional map sheet that states: “The development of this parcel map required a construction storm water permit. Construction activities that result in a land disturbance of less than one acre, but which are part of a larger common plan of development, also require a permit. Development of individual lots may require an additional permit(s).” 9. In accordance with Butte County Code (BCC) 20-100.1 place a note on a separate document which is to be recorded concurrently with the parcel map or on an additional map sheet stating: “Construction of the improvements outlined in these Conditions of Approval will not be required until such time as a permit or other grant of approval for development of the parcels is issued by the County or until such time as the construction of such improvements is required pursuant to an agreement between the subdivider and the county.” Should this note be utilized and the improvements deferred than additional notes shall be included on the separate document or on the additional map sheet restating those Conditions that are being deferred under BCC 20-100.1. 10. Show all easements of record on the Parcel Map. 11. Prior to recordation of the parcel map, pay in full any and all delinquent, current and estimated taxes and assessments as specified in Article 8 of Chapter 4 of Division 2 of Title 7, of the California Government Code commencing with Section 66492. 12. Pay the recording fees in effect at the time the parcel map and related documents are recorded. Processing Fees 13. Prior to recordation of the Parcel Map, pay any outstanding project-related processing fees. II. NOTATION A. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment.
