Planning Land Use, Zoning, & Permitting
• The parcel is zoned Agriculture 40-acre minimum (AG-40). Mr. Royal also owns an adjacent 5-acre parcel zoned G-C (General Commercial).
• The use of the AG-40 property for the earthworm soil factory and production of soil amendment products is determined to be a consistent use in the AG-40 zone.
• The current zoning issue is with the retail use (i.e. the type of merchandise sold). Use of the showroom to display
and sell the soil amendment products produced on site is permitted as an ancillary use to the primary operation.
• Discussed the following options to allow the existing and proposed retail uses at the existing location:
1. Apply for a General Plan Amendment (GPA)/Rezone(REZ)/Lot Line Adjustment (LLA) to relocate the 5 acre
G-C zoned parcel (041-120-128) to the location of the existing operation on 041-120-129 and change the
zoning to AG-40 where the existing commercially zoned area is (so a swap of zoning). Staff believes a
GPA/REZ not involving the G-C owned parcel will not be able to satisfy the criteria in Section 24-14€ of the
Zoning Ordinance. Mr. Royal did not want to lose that 5 acre parcel on Durham-Pentz (he has future plans).
2. Apply for a GPA/REZ/LLA to move a portion of the 5-acre commercially zoned parcel (041-120-128) to the
area where the existing operation on 041-120-129. APN 041-120-128 will be a smaller commercially zoned
parcel and 041-120-129 will have a split zone, but there would be no net loss of agriculturally zoned land..
Planning discussed the processing for both options. The initial application cost for a GPA/REZ/LLA is $11,674.35 as an initial retainer against the actual cost of processing. Mr. Royal felt the county should do all the processing and there should be no cost to him.
• If a LLA to relocate the 5-acre parcel (041-120-128) to the existing operation on 041-120-129, all existing
improvements must be located on the relocated 5-acre parcel (i.e. meet setbacks for structures and wastewater).

Building • Discussed the existing building violations on the parcel and the permit for the 21,000 square foot agricultural building.
• Any future change of the existing use of a building will be required to process a tenant improvement permit.
• Any new structures will require building permits.

Public Works • Parcel fronts on a State Highway. Contact Caltrans for any requirements, such as encroachment permits.
• Drainage – No increase in peak storm runoff is allowed with any additional development.
• On-site grading without a grading permit or approved building permit is limited to 50 cubic yards of material.
Applicant is encouraged to delay grading until a building permit has been approved. Grading over 50 cubic yards
prior to an approved building permit requires a grading permit.
• Application under the State Regional Water Quality Control Board National Pollution Discharge Elimination System (NPDES) is not required unless surface disturbances exceed one (1) acre.
