2522 Clark Road Butte Valley, CA 95965 SUBJECT: Zoning of Assessor’s Parcel APN 041-120-128; South Side of Durham-Pentz Road, 700 feet east of the intersection of Durham-Pentz and Clark Roads, Butte Valley.
Dear Mr. Royal; This office is in receipt of your letter of August 28, 2019 regarding the zoning of your five-acre parcel
located on the south side of Durham-Pentz Road, east of the intersection of Durham-Pentz and Clark Roads in Butte Valley. Your letter states that this parcel has dual zoning; however, this is incorrect. As was explained to you at the Economic Development Assistance Committee (EDAC) on July 17, 2019 and at the subsequent July 24, 2019 meeting with Planning Division Manager Chuck Thistlethwaite and Senior Planner Mark Michelena, your property is designated as Retail and Office in the Butte County
General Plan and is zoned G-C (General Commercial).
Due to an error in Butte County’s Geographic Information System (GIS), both the location of your parcel and the zoning shown on a portion of your parcel are incorrectly represented on maps created on Butte County’s GIS. These errors come from either the coordinate system (projection) used to align the
layers of data that comprise the GIS or (more likely) an error that occurred in adjusting (georectifying) one or more of the images used to depict the property lines and zone boundaries. This error is evident when images of the property boundaries and zoning boundaries are overlain in the GIS upon layers showing roads and aerial photo imagery (see attached map).
The Department of Development Services and staff sincerely regret this error in the GIS and in the
Development Services Information (Parcel Zoning Information) available online. We are actively working with the GIS Division of the Butte County Information Services Department to correct this error. We have documented this error in the County’s TRAKiT property information and permitting software to ensure that correct information is provided in response to any direct inquiries made of this
Department (RFI19-0461). However, it is also important to note that any party that accesses or uses online Development Services Information is required to agree to the following disclaimer:
