GENERAL CONDITIONS1. lt is understood and agreed that the County has prior right to the use of its rights of way. lt ¡s further understood and agreed by the Permittee thatthe do¡ng of any work under this permit shall constitute an acceptance of all the provis¡ons contained herein and failure on the Permittee's part to comply withany provision will be cause for revocation of this permit. Except as otherwise provided for public agencies and franch¡se holders, this permit is revocable atany time. This permit ¡s to be on the job site at all times while the work is being done. (County Code Chapter 10-75, Article Vl, 10-75 to l0-99)2. All work shall be done subject to the supervision of and to the satisfaction of the Public Works Department of the Gounty of Butte. The Permitteeshall, at all times, during the progress of the work, keep the County Highway in as neat and clean a condit¡on as ¡s possible and upon complet¡on of the workgranted herein, shall leave the County Highway in a thoroughly neat, dean, and usable condition. Best Management Practices (BMP'S) shall conform toCaltrans Construct¡on S¡te BMP Manual March 2003 for sediment and erosion control. BMP'S will be used and maintained dur¡ng and afier construction toprevent any sediment or other construct¡on related pollutants from leaving the job site and entering the county right-of-way or a drainage structure. All costs incuned by Butte County Public Works fromthe encroachment permit holde/s failure to keep the roadway or dra¡nage structures clean dur¡ng and after construction activities will be billed to andbecome the respons¡bility of the property owner. A building permit will not be finaled until all conditions are met to the satisfaction of the Butte County PublicWorks Department.3. The Permittee agrees by the acceptance of this permit to properly maintain any encroachment placed by the Permittee on any part of the CountyHighway and to immediately repair any damage to any portion of the h¡ghway, which occurs as a result of the encroachment, until such t¡me as thePermittee may be relieved of the responsibility of such encroachment by the County Department of Public Works.4. lt is further agreed by the Perm¡ttee that whenever construction, reconstruction, or maintenance work upon the highway may requiinstallation provided here¡n shall, upon request of the County Department of Public Works, be immediately moved by and at the sole expensePermittee.5. No material used for f¡ll or backf¡ll ¡n the construction of the encroachment shall be borrowed or taken from within the County right-of-way.6. At least one lane of any publ¡c road, under the jurisdiction of the Board of Supervisors of Butte County, and other public roads junctioning orintersecting therewith, shall be kept open for travel by the general public at all times. No public road under the jurisdiction of the Board shall be closed totravel by the general public without special pem¡ss¡on, in writing, from the Board of Supervisors.7 . The Permittee, by the acceptance of this permit, shall assume full responsibility for all liability for personal injury or damage to property which mayarise out of the work herein perm¡tted or which may ar¡se out of the failure on the part of the Perm¡ttee to do the work provided for under this permit ln theevent any cla¡m of such l¡abil¡ty ¡s made against the County of Butte or any department, ofñcial, or employee thereof the Perm¡ttee shall defend, indemniff,and hold them and each of them harmless for such claim,8. All excavations shall be backfilled and compacted immediately afrer work therein has been completed. Trenches shall not be left open farther thanthree hundred feet (300') in advance of pipe laying operat¡ons or two hundred feet (200) to the rear thereof, unless otheM¡se permitted by the CountyEngineer. Unless otherwise permitted under the Special Conditions, bacl<fill shall be placed and mechanically compacted in such a manner that the relat¡vecompaction throughout the entire fill with¡n the County road right-of-way shall conform to the percentage of compaction as stated below. Permittee shallnotiff County Public Works lnspector twenty four hours (24) before backfilling and/or paúng.a. The relative compaction from the bottom of excavation to a plane five feet (5') below finish surface grades shall be no less than ninetypercent (90%) as determined by Test Method No. Calif. 216-C of the Materials and Research Department, State of Califomia, TransportationDepartment, Division of Highways, or other approved test method.b. The relat¡ve compaction from a plane five feet (5') below the finish surface grade to sa¡d finish surface grade shall be no less thanninety-five percent (95%) as determined by the above testing method. Permittee shall bear all costs and responsibil¡ty for compaction tests.Material for use as trench backñll in any existing or proposed roadway sect¡on shall be sand, shall be placed in eight inch (8) lifts, and becompacted to a relative compaction of not less than ninety-five percent (95%).c. Material for use as backfill in roads¡de gutter excavations shall be the native material and be compacted to a relative compaction of notless than ninety percent (90%).d. Any pavement cutting shall be scored, or saw cut before trenching.e. Minimum depth of cover over all underground fac¡lities shall be th¡rty inches (30), except drainage culverts.f. All installations, parallel with roadway, shall be placed as close to the right-of-way line as possible. No portion of the backfill(s) shall becompacted by ponding or jetting.g. All pavements, curbs, gutters, sidewalks, borrow ditches, p¡pes, headwalls, road s¡gns, trees, shrubbery, and/or other permanent roadfac¡lities ¡mpa¡red by or as a result of construction operations at the construct¡on s¡te(s), or at other ground(s) occupied by materials and/orequipment, shall be restored immediately upon backfill¡ng or the excavation to the original grades and cross sect¡ons, and to a condit¡on asgood as, or better than, existed pr¡or to the construct¡on.h. All surfacing materials of roadways and driveway approaches cut or damaged by or as a result of construct¡on operations, shall bereplaced within ONE WEEK (7 Days) following the backfilling of excavat¡on, weather permitting, with compacted layers of surfacing materialsat least as thick as the ex¡sting, and not less than two inches (2) of asphalt concrete over eight inches (8') of aggregate base, according tocurrent Califomia State Specifications.9. Whenever necessary to secure permission from abutting property owners, such authority must be secured by the Permittee prior to start¡ng work.10. The future safety and convenience of the traveling public shall be g¡ven every considerat¡on ¡n the location and type of construction. Permitteeshall cause to be placed, erected, and maintained all warning signals, l¡ghts, banicades, signs, and other devices or measures essential to safeguard travelby the general public over and at the site of work authorized herein.11 . lf the construction work covered by this permit is to be done by a private contractor h¡red by the applicant, applicant shall not¡ry contractor as to thespecial conditions and requirements contained herein.Page2 of2re theof the
