AREA NO. 23 (PLEASANT' VALLEY DRAINAGE;) WHh:REAS, on December 28, 1965, the Board oi~ Supervisors of the County of~ Butte, Stale of California, adopted and passed Resolution No. 65-137 establishing County Service Area No. 2 ~ (Pleasant Valley Drainage); and WHEREAS, pursuant to Title III, Division II, Part ?, Chapter 2.2 of the Government Code of the State ofCali(ornia, commencing with Section 25210.1, Rick Coletti for Land's End Real Estate has petitioned the l.oc~Il A~~encv Formation Commission for the annexation of 2.7 acres of private property to County Service Area No.~23; and ~~'IIh;RF.AS_ on October 7, 1999, the Butte Local Agency Formation Commission passel and adoptal Resolution No. 9 1999/00 making determinations and approving the annexation to County Service Arca No. 23 to utilirc District drainage Iacllltles as a condition of subdivlslon approval for residential devclo}~ment of the property ;and WHEREAS, the Local Agency Formation Commission has found the project to he a General Rule Exemption under the California Environmental Qualify Act per Section 15061(b)(3); and WHH;RF,AS, pursuant to Government Code Section 25210.14, the Board ofSupervisors ofthe County of Butte may approve said annexation to County Service Arca No. 23 without notice ol~hcarin~~; and NO~V, THF,RF,EORE, BF, ]T RF,SOI.VED ~uu1 ordered by the Butte C'ount_v Board ol~ Supervisors as follows: 1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 25210. I c~( s~~r/. oi~the Government Code. 2. Said Board hereby determines to approve the annexation to County Scrvicc Area No. 23 (Pleasant Valley Drainage) as specified below. 3. The short form designation of these proceedings arc: 00-07 -Annexation to C.S.A. No. 23 (Pleasant Valley Drainage). d The reason for said proposal is to utilirc District drainage facilities as a condition ol~ subdivision approval for residential development of the property. The parcel to be annexed is ideniifiaj as APN U48-740-024. 6. The Clerk of the Board is authorised and directed to file a certified copy of this resolution with the I;xeeutivc Officer of the Butte Local Agency Formation Commission. 9. County Service Area No. 23 is financed by AB 8 funds established as a result of Proposition 13 and will not rec}wire a vote pursuant to Proposition 218. C'un-ently, there is no additional charge to fund the drainage services within County Service Area No. 23. Any new and/or increased charges would need to be processed in accordance with the provisions of Proposition 21 ~.
