HomeMy WebLinkAbout00-003RESOLUTION CONTINUING REDUCED STANDARD OF AID FOR GENERAL ASSISTANCE (SB 1033) WHEREAS, pursuant to section 17000 et seq, of the Welfare and Institutions Code, the County of Butte is obligated to relieve and support all incompetent, poor, indigent persons and those incapacitated by age, disease, or accident, lawfully resident herein, who are not otherwise supported by relatives or friends or by their own means; and WHEREAS, section 17000.6 of the Welfare and Institutions Code requires that relief from the general assistance mandate be based on a showing by the county that maintaining the grant level of section 17000.5 would result in "significant financial distress" to the county. "Significant financial distress" is defined as the inability to maintain basic county services (ones considered fundamental or essential) adequately or effectively; and WHEREAS, on October 29, 1996, the County of Butte received a 12-month finding of significant financial distress from the Commission on State Mandates. The period of this finding, which was statutorily extended to three years, expired on December 28, 1999; and WHEREAS, Resolution No. 96-128 was approved by the Butte County Board of Supervisors, which adopted a standard of aid and care pursuant to section 17000 et seq. of the Welfare and Institutions Code equal to 40°fo of the 1991 Federal official poverty level; and WHEREAS, on August 27, 1999, the County of Butte filed a Reapplication to the Commission on State Mandates for a finding of significant financial distress for a period of 36 months. The Commission on State Mandates has issued its final decision. and order, which became effective December 1, 1999, which findings conclude that meeting the standards in Welfare and Institutions Cade section 17000.5 would result in significant financial. distress to the County and that basic county services, including public safety, cannot be maintained; and WHEREAS, said finding permits the County of Butte to continue a reduced standard of aid which is not less than 40°l0 of the 1991 Federal official poverty level for a period of 36 months; and, NOW, THEREFORE, it is hereby resolved as follows: 1. The County of Butte shall continue a reduced standard of aid and care until December 2$, 2002, pursuant to section 17000 et seq. of the Welfare and Institutions Code. Said rate shall be equal to 40% of the 1991 Federal official poverty level which rate is the equivalent of $221.00 per month.
