RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COON"I'Y OF
BLI"I°rE NAMING THE DIRECTOR OF THE DEPARTMENT OF
DEVELOPMENT SERVICES AS DESIGNEE TO REVIEW LESS THANTI-IREE-
ACRE CONVERSION EXEMPTIONS AS AUTHORIZED UNDER CALIFORMA
FOREST PRACTICE RULES
WHEREAS, the Z'berg-Nejcdly Forest Practice Act regulates the harvest ol~timbcr
on private lands within the County of Butte; and
WHEREAS, Title 14 of Section 1 104.1 ot-the California Code of Regulations allows
Less Than "Three-acre Conversion Exemption Permits for the harvest of timber on areas of less than
three-acres on private lands within the County of Butte; and
WHEREAS, all Less "Than Three Acre Conversion Exemptions must comply with
local zoning and the General Plan; and
WHEREAS, Butte County Code Section 24.235.10 {c) requires applications for Less
"Phan Three-acre Conversion Exemptions to include an erosion and sediment control plan and
restricts timber harvesting operations associated with Less Than Three-acre Conversions from
occurring between the dates of November 15 through April 1 within the Firhaven Creek, Paradise
Reservoir, and Ma~alia Reservoir watersheds; and
WHEREAS, in accordance with Title 14 of Section 1 104.1 the Board of Supervisors
is authorized to appoint a designee who will ensure that all Less Than Three-acre Conversion
Exemptions conform with all regulatory requirel~~ents of the County;
NOW, THEREFORE, BE ('T RF_,SOLVED that the Board of Supervisors designate
the Director of the Department of Development Services, or his designee, as the County designee
authorized to review all Less Than Three-acre Conversion Exemptions for conformance with all
County regulatory requirements.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the duties ofthe designee
authorised under this resolution shall be as follows:
1. Conducting a rc~-~iew of all Less Than Three-acre Conversion
Exemptions applied for under the California Forest Practice Rules for
conformance with County zoning and the General Plan.
2. Insuring that all applications for Less Than Thrcc-acre Conversion
Exemptions within the Firhaven Creek, Paradise Reservoir-, and
Magalia Reservoir watersheds include an approved erosion and
sediment control plan and prohibit timber harvesting operations from
occurring between the dates of November I S through April 1.
3. Provide assistance to the citizens of Butte County, Registered
Professional Foresters arld the California L~epartr~~ent of Forestry in
reviewing all Lcss Than Thrcc-acre Conversion Exemptions.
4. h~sure that compliance wish all County requirements associated with
Less Than Three-Acre Conversion Exemptions is achieved.
PASSED AND ADOPTED by the Butte County Board of Supervisors of the County
of Butte, Stale of California, on this 11th day of .Tanuary , 2000, by the
following vote:
AYES: Supervisors Beeler, Houx, Josiassen, Davis and Chair Dolan
