RESOLUTION TO ABANDON A PUBLIC SERVICE EASEMENT
OVER LOT 13 "HERITAGE ESTATES, PHASE TWO"
RECORDED IN MAP BOOK 130 AT PAGES 27, 28 & 29
WHEREAS. this master came on regularly for hearing before the Board of Supervisors
of the County of Butte, State of California, on March 14, 2000, in the Board Chambers, Butte
C<~unt>> hdministration Building, 25 County Center Drive, Oroville, California; and
WHEREAS, it appearing to said Board that notice of the time and place of the hearing
on the pCtlhon for the flbandOllmenl Of the pnbflC SCl'VICe eaSCmelll In C~LICStl017 WaS dLlfy and
regularly given as required by law; and
WHEREAS, testimony and evidence, both oral and documentary, havi~lg been produced
at said hearing, Ii~om which said Board now finds that: (1) there is no possibility the proposed
abandonment of this public service easement may have a significant effect on the environment,
and it is therefore not subject to the California Environmental Quality net; (2) the proposed
abandonment is in conformance with the Butte County General Plan; and (3) the public service

NOW THEREFORE IT IS HEREBY ORDERED as follows:
1. "that the public service easement situated in the County of Butte, State of California, as

of Division 9 of the California Streets and I-lighways Code (commencing with Section 8320).
?. That said public service casement so abandoned is located in the unincorporated area ol~ the
County of Butte. State oC California, in the Oroville area, identified as a portion of nssessor's
Parcel Number 069-610-003, and is more particularly described as follows:
n strip of land 20.00 feet in width lying southerly of adjacent to, and parallel with the
following described line;
Commencing at the southeast corner of said lot "B", according to said map, said point
being a point on a curve concave easterly, having a radius of 2040.00 feet, a central angle
of 10°20'30"', and having a radial line that bears N 68°10'21" E, thence northerly along
said curve and along the easterly line of said lot "B", 368.21 feet, to the end of said curve,
thence N 1 1 °30'00" W, 230.00 feet, thence S 78° 10'00'°W, leaving said east line. 25.00
feet: 1o the true point oP beginning [or the herein described line; thence continuing S

3. That a map showing the public service easement hereby abandoned is on file in the Office of
the Butte County Department of Public Works, 7 County Center Drive, Oroville, California,
95965.
4. "That the Clerl< of this Board shall cause a certified copy of this Resolution, with the seal of
the Board oP Supervisors of the County of Butte, State of California, to be recorded in the
