RESOLUTION TO ABANDON A PUBLIC RIGHT OF WAY
PROPOSED ALLEY ABANDONMENT GLENDALE ADDITION TO CHICO NO. 1
WHEREAS, this matter came on regularly [or hearing before the Board of Supervisors
of the ('aunty of Butte, State of California. an March 14, 2000, in the Board Chambers. Butte
Cuunt~~ administration Building. 25 County Center Drive, Oroville, Calilornia; and
WHEREAS, it appearing to said Board that notice of the time and place of the hearing
on the petition for the abandonment of the public right of way in question was duly and regularly
<,ziven as required by law, and
WHEREAS, testimony and evidence, both oral and documentary, having been produced
at said hearing, ii-om which said Booed now finds that: (I) there is no possibility the proposed
ahandonment of this public --i~~ht of way may have a significant effect an the environment_ and it
is therefore not subject to the ('alilornia 1?nvironmental f1ct; (2) the proposed abandonment is in

NOW, THEREFORE, IT IS HEREBY ORDERED AS follows:
1. 'I~hat the alley abandonment situated in the County of Butte, State of California, as hereinafter
more particularly described. is hereby abandoned pursuant to Chapter 3 of Part 3 of Division
9 ol~the California Streets and 1-fighways Cade (commencing with Section 8320).
?. ~l-hat said alley so abandoned is located in the unincorporated area of the County oC Butte.
State of California, in the Chico area, identilicd as a portion of Assessor's Parcel Number
039-X10-Od0 throu~~h O6 ~ and U67, and is more particularly described as i~>llows:
Being a portion of Section ?, Township 2I North, Range 1 East, M.D.M., Butte County,
State of Calilornia and also being a portion of Lots 10 and l4 as shown on the "Map
showing Subdivisions of the McIntosh Tract, Butte County, Cal.," which map was tiled
in the office of the Recorder of the County of Butte, State of California, October 27,
1900, in Boole 2 of Maps at Page 164 and described as follows:
Being those 16~ (foot) wide public alleys as shown on the aI'1lcial map entitled,
"C;LI?ND~I.I: addition to Chico No. l," which map was filed in floc ollicc of the
[Zccarder of the County ol~ Butte, State of Calilornia, April 1 1, 1907, in Baok 6 of Maps
at Page d5, and also being shown on that certain Record of Suwey for .lohn P..leffries,
Robert C. Walters, Patrick S. Bernedo and Kevin Moretti, which map was filed in the
office of the Recorder of the county of Butte, State of California, March 27, 1992 , in
Book 124 of Maps at Pages 77 and 78 and being more particularly described as follows;

Being all of that portion of the 16~ (toot) wick public alley as shown on said maps lying
northerly of and contiguous with Lot 1 through Lot 12 of said GLI;NDALIJ Addition to
Chico No. 1 and lying between the northerly prolongation of the easterly right of way line
of Olive Street and the southerly prolongation of the westerly right of way line of Second
Street as shown rn~ said maps.
PARCEL. NO. 1-B
Being all of that portion ol~ the 16" (foot) wide public alley as shown on said maps lying
southerly of and contiguous with Lot 13 through Lot 24 of said GLINDALL Addition to
Chico No. 1 and lying between the southerly prolongation of the easterly right of way
line of Olive Street and the southerly prolongation of the westerly right of way line of
Oal< Street as shown on said maps.
PARCEL NO. 1-C
Being all of that portion ol~ the 16" (loot) wide public alley as shown on said maps lying
southerly of and contiguous with Lot 28 of~ said GLENDALE Addition to Chico No. I
and lying between the southerly prolongation of the easterly right of way line of Oak
Street and the westerly right of way line of` the Southern Pacific Railroad as shown on
said maps.
LXC1P"PING AND RGSL;RVING, as may be necessary, any existing alley and/or rights
of way at any time, or from time to time, to maintain, operate, replace, remove, renew or
enlarge the existing public service facilities and facilities incidental thereto, including
access to protect the property from all hazards in, upon, and over the highway herewith to
be abandoned.
The above described lands are hereby combined with and become a part of these lands as
described in the deed to Patrick S. Bcrnedo and Jill Bernedo. husband and wife as
community property as filed for record in Butte County Ot~ficials Records at Serial
Number 90-07958. No additional lots or parcels are created hereby.
3. That a map showing the alley hereby abandoned is on file in the Office of the Butte County
Department of Public Works, 7 County Center Drive, Oroville, California. 95965.
4. "That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of
the Board ol~ Supervisors of the County of Butte, State of California, to be recorded in the
Uflicc ofthe Recorder of the County of Butte, State of California.
