RESOLUTION OF THE COUNTY OF BUTTE DELEGATING AUTHORITY
TO THE RISK MANAGER TO RE.IECT OR RETURN TORT CLAIMS
FILED AGAINST THE COUNTY
WHEREAS. the `'Calif-ornia Government Tort Claims Act", as set forth in Government
Code Section 900 et seq. (hereinafter `'the Act"}, requires the governing body of a public entity
to take action on tort claims which may be presented to it in accordance with the .pct; and
WHEREAS. Section 935.E of the Act provides that the governing body of the local
public entity may, by resolution, delegate to an employee the authority to reject or return tort
claims_ and
WHEREAS, the Board of Supervisors desires to delegate to the Risk Manager authority
of the Board to reject or return tort claims, subject to certain limitations and reporting
procedures.
NOW, THEREFORE, BE [T RESOLVED BY THE BOARD OF SUPERVISORS
AS FOLLOWS:
That the authority of the Board of Supervisors to reject or return claims pursuant to the
California Tort Claims Act is hereby delegated to the Risk Manager; and
2. Prior to the return or rejection of any claim, the Risk Manager shall obtain the
concurrence of County Counsel, or his or her designee; and
3. On a quarterly basis, during the months of July, October, January, and March, the Risk
Manager shall file a written report with the Board of Supervisors listing the number of
claims filed during the preceding quarter of the current fiscal year, which were denied.
Such report shall include the name of the claimant, the amount of the claim. the nature of
the claim, and the date of denial; and
4. In the absence of the Risk Manager, the General Services Director shall have the
authority to perform the functions delegated by this resolution.
PASSED AND ADOPTED by the Butte County Board of Supervisors this ?7`" day of
April 2000 by the following vote:
