HomeMy WebLinkAbout00-093E~O~RD-. ~~~ UP'~~1~~~`-C~R CaQl:1IVTY ~lr BUTTE, aTATE <OF CALIF4~N#A RE~sc~lution No. 00-93 RESOLUTION ES7'AI3I,ISNING INCREASED ANNUAL SERVICE CHARGES IN COUNTY SERVICE AREA #82 FOR FISCAL YEAR 2000-2001 AND FUTURE FISCAL, YEARS WI IEREAS, on May 16, 2000, the Board of Supervisors adopted Resolution 00-Sb entitled "RESOLUTION DIRECTING COMMENCEMENT OF PROCF,DURES TO IMPOSE AN INCREASED ANNUAL SERVICF, CHARGE IN COUNTY SERVICE AREA #82 AND SETTING A PUBLIC' HI~ARING TO CONSIDER SUCH CHARGE"; and ~'VHEREAS, notice having bccn duly given and a public hearing having been held to consider establishing such increased service charges for fiscal year 2000-2001 and future fiscal years in accordance with the procedures specified in Governmental Codc Section 25210.77a, Butte County Code Section 21-85 et seq., and Article X[li D, Section E, of the California Constitution, and to consider protests filed against such increased service charges. NOGV, T1fEREFORE, BE [T RESOLVED, It is hereby found that written protests against the proposed inercased service charges have not bccn presented by a majority of the property owners within County Scrvicc Area (CSA) #S2. ?. h~7 accordance with Article XIIf D, Section 6, of the California Constitution, and particularly Subsection (c) thereof, such inercased sewer service charges are hereby established without the necessity for approval by a majority vote of the owners of the property within said County Service Area, and the maximum permissible service charges per parcel of real property per year for sewer services for fiscal year 2000-2001 and future fiscal years, is the sum of the S 10.00 baseline plus $131.50 per unit = S 141.50 per unit. 3. As to those increased charges, which are approved, the Board directs the Auditor to place the charges on the Fiscal Year 2000-2001 and subsequent tax bills. Provided, however, that if the final budget adopted for the County Service Arca is less than the proposed budget upon which the charges were based or the fund carryover is greater, then the Auditor is directed to make a con-esponding reduction in the service charges to be placed on the tax bills. It is found that each of the fees imposed by this Resolution: do not exceed the cost of the services to be provided in the County Service Area; are to be used only for the purpose of providing the extended services in County Service Area 82; do not exceed the proportional cost of the extended services to be provided to each affected parcel of real property; and arc for extended services which arc used by or immediately available to the owner of each such affected parcel of real property.
