BUTTE APPROVING THE ADOPTION OF A GENERAL PLAN
AMENDMENT FROM ORCHARD AND FIELD CROPS TO AGRICULTURAL
RESIDENTIAL AND AMENDING THE DURHAM-DAYTON-NELSON PLAN
FROM ORCHARD & FIELD CROPS TO AGRICUL"I'URAL RESIDENTIAL.
WHEREAS, a private individual, James R. Black has petitioned the Butte County
Flanning Commission and Board of Supervisors, through an appropriate application, to amend the
Butte County General Plan Land Use Element and Durham-Dayton-Nelson Pian9 for a change
from Orchard and Field Crops to Agricultural Residential, for that property identified on Exhibit
A-1 attached hereto; and
WHEREAS, the proposed General Plan Amendment has been studied and reviewed
by the Butte County Planning Commission and a public hearing held pursuant to law, at which
time all interested persons were heard; and
WHEREAS, the Butte County Board of Supervisors has reviewed and considered
the contents of the Initial Study {Exhibit A-2) prepared on the amendment pursuant to the
California Environmental Quality Act; and
WHEREAS, the Butte County Board of Supervisors has held hearings on the
General Plan Amendments at which all interested parties were heard; and
WHEREAS, the Butte County Board of Supervisors finds the proposed amendment
complies with all elements of the Butte County General Plan and comprises an overall internally
consistent whole, specifically:

Orchard & Field Crops and Grazing and Open Lands.

Policy 1.3: Designate areas outside of the more intensely developed portions of
the community of Durham far the protection oi`continued agriculture.
Although this area is outside of die nn~re intensely developed areas
of I~rrrharn, adjacent development has occurred which makes this
fatal less desirable for agrierrltrrrul ptrrsrrits, The Board of

agricultural areas of 1~urhant, provided that, in accordance with
Butte County General Plan Agricttlturcrl Plemerrt Program 2.2, urr
agricultural buffer is established 30(~,feet irr width along the south
and west propert~~ lines.
Policy ] .G: Limits the minimum parcel sizes for new land divisions, in areas
identified as Orchard and Field Crops on the General Plan Land Use
Map, to not less than the existing zoning designations from 5 to 160
acres. The densities currently established by the existing zoning on
Orchard and Field Crops lands shall be the minimum lot size
allowable, and further subdivision of Orchard and Field Crops lands
is discouraged.
Polley 1.9: Applies the policies of the Agricultural Element to the Durham-
Dayton-Nelson Area Plan as well as the currently adopted policies of
this plan. States that minimum lot sizes for agricultural land uses
shown on the plan map shall be the minimums of the current zoning.
The Board of Supervisors finds that the Qrchard c~ Field Crops
General Plan ctesigrrcrtion for this property is rro longer applicable,
dire to strrrourrding residential devetopment, urrd that an Agrdeultural
Residential General Plun designation is more suitable for this
property and therefore the limits on minimum parcel sizes and zoning
imposed hl, Policies 1.6 and 1.9 do not apply.

Objective 2: Supports the continued viability of agricultural production as
the major source of income, employment and economic
viability of the Planning Area.
The Board of Supey~~isors finds that the continued vial7ility of
ugriculturcrl production in the Durham, Dayton, Nelson
1'lafrnirrg Area will he supported provided that, in accordance
with Butte County Genera! Plun Agricultural Flenrent
Program 2.2, an agricultural buffer is established 300 feet irr
width along the sor.rth and west property lures.
Goal Vl.
Policy 2: Protects agricultural lands v~rhich currently produce, or have
the potential to produce, from encroaching urban uses.
The Board of Supervisors finds drat adjacent residential
clevelopnrent limits the use of this property for ctgricttltural
pursuits. Goctl VI. Policy 2 shall he upheld for ugricultrrral
!curds adjacent to this property provided that an Agrieu~ltural
buffer is established 300 feet in width along the south crud
west properh~ li~res, in accordance with Cor~rnty General Plcnr
Agr-icultur~rl Elenrerrt Progr~crnr 2. Z.
NOW, 'THEREFORE, BE IT RESOLVED as follows:
1. The General Pian Amendment to Agricultural Residential as shown ou the
attached Exhibit A-l are hereby incorporated by reference.
2. The Genera( Plan Amendment is hereby adopted and by the Board of
Supervisors of the County of Butte as an amendment to the Butte County
General Plan Land Use Element and the Durham-Dayton-Nelson Plan, said
Amendments to be the land use policy for the County of Butte in the
affected area for all findings pursuant to law.
BE IT FURTHER RESOLVED, that pursuant to Government Code Section 65359
that the General Plan be endorsed to show that the above amendments have been approved by this
Board.

day of December, 2000, by the following vote:
