REGARDING RESOLUTION OF PHASE 8 ISSUES,
DF.VEL.OPMEN'I' AND MANAGEMENT OF WATER
Sl1PPLIES AND A BINDING COMMITMENT TO
PROCEED PURSIJAN'I' TO SPECIFIED "GERMS
WHEREAS, the State Water Resources Control Board (SWRCB) has
commenced Phase 8 of the Bay-Delta Water Rights Hearing, to assign the
remaining responsibility for meeting the flow-dependent objectives in the 1995
Bay-Delta Water Quality Control Plan; and
WHEREAS, a number ofthe entities who possess water rights or water
entitlements or are otherwise water users within the watershed of the Sacramento
River and its tributaries and/or the State Water Project (hereinafter: Upstream
Water Users) have engaged in negotiations with the Califi~rnia Department of
Water Resources, the United States Bureau of Reclamation and other entities who
utilize the water that is exported from the Sacramento-San Joaquin Delta
(hereinafter: Export Water Users), toward the goal of resolution oi'all Phase 8
issues; and
WHEREAS, the [lpstream Water Users and Export Water Users have reached
agreement as to the appropriate terms and conditions for resolution of all Phase 8
issues, as set forth in the "Agreement Kegarding Resolution of Phase 8 Issues,
Development and Management of Water Supplies, and a Binding Commitment to
Proceed Pursuant to Specified Terms" (hereinafter: Phase 8 Agreement) attached
hereto and incorporated herein; and
WHEREAS, the Board of Supervisors ofthe County of Butte has reviewed the
Phase 8 Agreement and finds and determines that it constitutes a fair and
appropriate allocation of~rights and responsibilities with respect to the resolution
of Phase 8 issues and that participation in the processes described in the Phase 8
Agreement is in the best interest of` the County;
NOW, THEREFORE:, BE IT RESOLVED by the Board of Supervisors
as follows:
1. The foregoing recitals and tindings, and each of them, are true and
correct.
2. The Board of Supervisors hereby supports and approves execution of
the Phase 8 Agreement b_y the Northern California Water Association.
~. That the Director of Water and Resource Conservation is authorized
and directed to participate fully in the processes described in the Phase
8 Agreement and to report to the Board on a regular basis on the status
of such processes.
