HomeMy WebLinkAbout01-013WHEREAS, the Myers-Milias-Brown Act, Government Code §3500 et seq., requires Butte County to meet and confer concerning the subject of wages, hours and working conditions for employees; and WHEREAS, the County of Butte has met with all of the bargaining units and has agreed to Memoranda of Understanding with the bargaining units; and WILEREAS, each Memorandum of Understanding sets forth the procedure for employees to grieve issues concerning management interpretation or application of Memorandum of Understanding, the County Personnel Ordinance or the Personnel Rules; and WHEREAS, it is the intent of the grievance procedures to allow the parties the opportunity to resolve workplace problems at the lowest possible level and to develop mare harmonious employerlemployee relations; and WHEREAS, the grievance procedure envisions an employee, as represented by the employee's bargaining unit, to meet with the Director-Personnel, in consultation with County Counsel and the atTected Department Head, in an attempt to resolve the grievance; and WHEREAS, the grievance procedure sets forth several steps through which the parties attempt to resolve the grievance; and Pa~~ 1 0l'3 (rriecxnce S~tlemc~it ~4uthority ~~ ~ RESOLUTION OF THE COUNTY OF BUTTE DELEGA`T'ING AUTHORITY TO THE D[RECTC?R-PERSONNEL TO SETTLE GRIEVANCES WHEREAS, the Director-Personnel must be able to negotiate in good faith in an attempt to respond to and possibly resolve the grievance thereby avoiding costly arbitration or litigation. NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors that: I . The authority of the Board of Supervisors to respond to, and negotiate on behalf oi'the County, grievances presented by employees and employee bargaining units, as set forth in the grievance procedures of the current and any future Memoranda of Understanding, is hereby delegated to the Director-Personnel, in consultation with County Counsel and the affected Department Head. 2. The Director-Personnel, in consultation with County Counsel and the affected Department Head, is granted authority to negotiate and settle grievances. On monetary settlements, the Director-Personnel, in consultation with County Counsel, the affected Department Head, and the Chief Administrative Officer, is granted authority to negotiate and settle such grievances up to an amount of $IQ,000 per grievant. All settlement proposals exceeding $10,04Q, which are not the result of an arbitration hearing and decision rendered by an arbitrator, shall be submitted to the Board of Supervisors for payment authority. 3. The authority stated in this resolution encompasses making negotiated settlement arrangements that allow for special and unique provisions to be made that may exceed the rules and procedures set forth in the Personnel Rules and the Page 2 of 3 Grievance settlement Authority Memoranda of Understanding in order to settle a grievance in a less costly and more harmonious manner. 4. The Auditor is directed to accept the terms of a grievance settlement and to pay those amounts as defined herein or make any other arrangements as called far in the grievance settlement.
