RESOLUTION OF INTENTION TO ESTABLISH
COUNTY SERVICE AREA NO. 174 DURHAM LAND ESTATES
WHF,REAS, pursuant to Chapter 2.2, ]'art 2, Division 2, Title 3 of the Government Code of the State of
California, commencing with Section 25210.1, the Butte County Baard of Supervisors has petitioned the Local
Agency Formation Commission for the formation of County Service Arca No. l74 (Durham Land Estates); and
WHEREAS, on the S`~' day of April, 2001, the Local Agency Formation Commission approved the
formation of County Service Arca No. 174;
NOW', THEREFORE, BE IT RESOLVED that County Service Area No. 174 is proposed to be
established under the terms of the aforesaid chapter in the unincorporated area of Butte County.
1. The boundary line of the territories proposed for inclusion in the county service area are
described in Exhibit "A" attached hereto and made a part hereof by this reference.
2. The county service area shall be called County Service Area No. 174 Durham Land
Estates. The type of extended services to he provided are maintenance of storm drain facilities and
street lighting for the approved residential subdivision,
3. The Butte County Board of Supervisors has conducted a Property Owner Ballot
Proceeding pursuant Proposition 218, and will adopt a resolution confirming the services charges to
be levied on each parcel ~f real property within the county service area prior to the {ding of the
Certificate of Completion; and
4. That a public hearing will be held on April 24, 2001, at 10:30 a.m. in the Board of
Supervisors Chambers, County Administration Building, 25 County Center Drive, Orovillc,
California, for consideration of the establishment of said area.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 10'x' day of April, 2001, by the
following vote:
AYES: Supervisors Beeler, Dolan, Houx, Yamaguchi, and Chair Josiassen

All that certain real property situate in the County of Butte, State of California, described
as follows;
Being a portion of Section 25, T,21 N., R.1 E., M.D.M., and a portion of Section 30, T.21
N., R.2 E., M.D.M., more particularly described as follows;
BEGINNING at the southwest corner of the Tracy Subdivision as shown in Book 30 of
Maps, at Page 50 in the office of the Butte County Recorder, more particularly described
as follows;
"Thence leaving said Point of Bcgimiing along the south line of said Subdivision, North
89°52'57" East, 636.75 feet;
Thence leaving said south line, North 00°07'03" West, 142,00 feet to a 20.00-foot radius
curve concave to the southwest;
Thence following said curve through a central angle of 90°00'00" a distance of 31.42 feet
to the south line of Durham-Dayton Highway;
Thence along said south line, South 83° 15'23" Fast, 100.55 feet to a 20.00-foot radius
curve concave to the northwest;
Thence leaving said south line of Dlu-ham-Dayton Highway and following said curve
through a central angle of 90°00'00" a distance of 31.42 feet;
Thence South 00°07'03" Fast, 130.00 feet to said south line of Tracy Subdivision;
Thence along said south line, North 89°52'57" East, 96030 i'ect;
Thence leaving said south line of said Subdivision, South 00°04'45" West, 602,68 feet;
Thence South 89°55' 15" East, 160.50 feet to the west line of Holland Avenue;
Thence along said west line, South 00°04'45" West, 60.00 feet;
Thence leaving said west line of Holland Avenue, North 89°55' 15" West, 160.50 feet;
Thence South 00°04'45" West, 541.97 feet;
Thence South 89° ] 0'45" West, 1665.30 feet;
Thence North 00°2T49" West, 1225.16 feet to the True Point of Beginning.
